Authorization to Analvze the Feasibility of MerRina
Redevelooment Pro1ect Areas
The Chairman has requested staff to analyze and evaluate the
feasibility of merging or combining some or all redevelopment project
areas within the City of San Bernardino. The merger process is one
that has been used or explored by other redevelopment agencies within
the State of California. Mergers are allowed by the California
Redevelopment Law, irrespective of geographical contiguity.
Notwithstanding the occurrence of a merger, each affected redevelopment
project area must adhere to its respective redevelopment plans and
limitations. Such action does not obviate the legal requirement to
address municipal housing needs for low-moderate income
families/persons by use of twenty percent (20%) set-aside redevelopment
tax increment funds. Generally, the option of mergers are explored to
enhance the eligibility and availability of financial revenues,
facilitate the restructuring of debt and allocate existing debt limits
in a more efficient fashion.
Absent an amendment effectuating a merger by the State Legislature,
project mergers follow a statutorily prescribed process and require
fiscal review by the County of San Bernardino, the San Bernardino
Unified School District and other taxing entities which were originally
entitled to participate in the fiscal review process when the project
area was initially formed. From a procedural standpoint, the merger
process is similar in many respects to the forming of a new project
area.
It is appropriate for the staff to commence proceedings on the merging
of all redevelopment project areas. Staff requests, authorization to
do so. Such authorization should necessarily include tasks to be
accomplished by staff and legal and financial counsel whose specialized
expertise will be needed to accurately assess the overall feasibility
of a proposed merger of project areas.
Staff recommends adoption of the form motion.
