STAFF REPORT
Rockwell DrainR~e Easement
The City Public Works Department has requested that the Development Department execute
a drainage easement over the new Rockwell International parking area (Wade property).
The easement is required for a new drainage system (already installed), which was
needed to alleviate any flooding of the Rockwell International parking area. It is
also a condition of approval of the parking area.
Initially, staff was concerned about granting an easement, inasmuch as the Development
Department has yet to acquire fee title to the Wade parcel. Consultations with Mr.
Dennis Barlow of the City Attorney's office and Mr. Steven Abbot of Redwine & Sherrill
(the law firm handling the eminent domain action) indicated that there is no legal
difficulty with executing the subject easement prior to obtaining title to the
property. It would not, however, have any legal effect until title is obtained.
As an accommodation to the City Public Works Department, I recommend adoption of the
form motion.

Northeast~rly along said curve and the Southeasterly line of said parcel, through
a central angle of 40 21' 33", a distance of 682.39 feet, to the True Point of
Beginningi thence South 820 27' 12" West, a distance of 81.25 feet, to the
beginning of a tangent curve, concave Northerly, and having a radius of 50.00
feet; thence Westerly, along said curve through a central angle of 190 37' 29",
a distance of 17.13 feet; thence North 770 55' 19" West, a distance of 195.33
feet, to a. point here,inafter referred to as Point "A" , and the Point of
Termination.
The side lines of said 15.00 foot easement are to be extended or shortened to
begin on the Southeasterly line ot said Parcel 5, and terminate in a line
perpendicular to said centerline, through said Point "A".
The easement herein granted shall include the right to construct, reconstruct,
inspect, maintain and repair the drainage line and appurtenant facilities.
The easement herein granted shall also include the right to use such areas
adjacent to the easement liS may be rellsonably necessary for performing the work,
and for access to the work during construction and/or repair.
