Subject: Appeal of Denial of Conditional Use Permit No.
89-41
Mayor and Common council Meeting of
December 17, 1990
REOUEST
The applicant, Randy Wyatt, Jr., is appealing the denial of
Conditional Use Permit No. 89-41 by a 5 to 3 vote of the
Planning commission. The applicant requests that the Mayor
and council uphold the appeal and approve conditional use
Permit No. 89-41.
BACKGROUND
conditional Use permit No. 89-41, requests approval to
construct and operate an outdoor go-cart track on 0.92 acres
located at 2066 West Foothill Boulevard, in the CH, Heavy
commercial land use designation. The proposed go-cart
operation consists of a racing track with a capacity of
twenty go-carts, a two story 3,420 square foot building for
office and cart storage, and a parking lot and a picnic area.
currently, the subject site consists of an unpaved parking
lot and the--race track. On June 20, 1990, the applicant was
first cited for operating without an approved conditional use
Permit, Business License, and Certificate of occupancy. At
that time the operation consisted of the race track, portable
restrooms, and large refuse containers used to store the go-
carts. On July 9, 1990, the applicant was convicted on all
counts.
The application for the proposed project was submitted to the
planning Department on August 21, 1989, and was deemed com-
plete on October 11, 1990. After numerous reviews, on
October 11, 1990 the Development Review committee (DRC)
cleared the site plan, floor plans, and elevations for
planning commission approval.
COMPATIBILITY WITH SURROUNDING LAND USES
The proposed site, along with parcels to the east and west
are designated CH, Heavy commercial. Properties south of
this project are designated CG-1, commercial General. The
parcel backs up to a County Flood Control maintenance road
for Lytle Creek (north of the site) which is designated PFC,
Public Flood control. Current land uses consists of the
Veteran of Foreign Wars Post 8737 (VFW) to the east; vacant
land to the west; and vacant land and a non-conforming. single
family residence to the south. The proposed go-cart facility
is not compatible with the VFW facility or the single family
residence. However, fraternal organizations and single
family residences are not permitted in this land use classi-
fication. These uses are legal but non-conforming uses.

CALIFORNIA ENVIRONMENTAL OUALITY ACT
At its regularly scheduled meeting of August 9, 1990, the
Environmental Review Committee (ERC) proposed a Mitigated
Negative Declaration. The proposed Mitigated Negative
Declaration was advertised and available for public review
and comment from August 16, 1990 to September 5, 1990. No
comments were received from the public during that period.
COMMENTS RECEIVED/PLANNING COMMISSION MEETINGS
On September 6, 1989, the planning Department received a
written complaint about the go-cart track operation from the
VFW. At that time, the facility was operating illegally. The
complaint was in regards to insufficient parking, littering,
and the use of the VFW restrooms. The complaint was turned
over to the Code Enforcement division who investigated the
case. Another letter of objections was received by the
Planning Department on November 20, 1990 (Exhibit "C").
On october 10, 1990, the Planning Department received a
memorandum to the Planning Commission from T.L. Cain. Liabil-
ity Claims Specialist, City of San Bernardino Risk Management
Department. The letter, also signed by the Director of Risk
Management, victor F. Lorch, recommends that one of the
conditions of approval for the Conditional Use Permit be that
the grantee carry general liability coverage of $1,000,000
with the city as a named additional insured in the policy.
This request stems from Mr. Cain's personal experience as an
insurance claims adjuster for "Go-Karts of San Bernardino." A
collision at this facility maimed the left leg of a young man
and resulted in a lifetime disability.

conditional Use Permit No. 89-41 was continued from the
Planning Commission meeting of November 7, 1990. At that
time, the commission directed staff to coordinate a meeting
between the owner and applicant, the planning Department and
Risk Management to discuss the recommended condition which
requires that the grantee carry general liability coverage of
$1,000,000 with the City named as an additional insured in
the policy.
The requested meeting was held on November 16, 1990. Risk
Management maintained their recommendation for general lia-
bility coverage of $1,000,000 with the city named as an
additional insured in the policy. The reason is that the
business is a potential dangerous operation.
The applicant questioned the legitimacy of the condition. The
applicant contended that there is no nexus for the condition
(i.e., connection between the proposed business and the
liability of the city). Staff contended that the nexus is
created by the approval of a Conditional use permit; a
Conditional Use Permit is a discretionary act and the City's

action of approving a Conditional Use permit creates the link
to the City. The applicant presented a letter from Terbest
and Associates, Insurance services, Incorporated. The letter
indicates that their company will only issue a certificate of
Insurance only if the named insured is performing a service.
The applicant did indicate at the meeting that they intended
to carry $100,000 of liability insurance.

Noise: The music and the P.A. system were loud and annoying
when the business was in operation. On several occasions Mr.
and Mrs. Davey requested the applicant to turn the music
system down. The applicant would comply, but only for a
short period of time, and the music would be loud again.
Hours of operation Mr. and Mrs. Davey noted that there
were occasions in which the applicant operated his business
until 12:00 to 1:00 a.m. in the past and expressed concern
over allowing them to do so in the future.

unsafe for foot traffic along Foothill Blvd. due to the lack
of sidewalks and traffic along Foothill.
Drinkinq and Loiterinq: Mr. and Mrs. Davey indicated that
there were several occasions in which the applicant's friends
would loiter on the property drinking and creating distur-
bance.
APplicant's Past Record of operation: Mr. and Mrs. Davey
expressed concern over the applicant's defiance in the past.
They recalled that the city and cited the applicant for
operating without proper permits, and that the applicant
continued to operate in defiance of the city's citation. They
recalled how the city had terminated the applicant's
electrical power in an effort to have him cease his opera-
tion, and that in defiance the applicant employed a portable
generator to maintain operation.

This is my official appeal to Mayor Holcomb and
City Councilmembers. The decision made by the planning commission
on November 20,1990 regarding C.li.P. #89-41. The C.li.P. was
denied approval on the basis of a $1,000,000 insurance bond as the
city of San Bernardino the additional insured.
Mr. Stone, Mr. Cole, Mr.. Sharp were the only
planning commissioners that agreed there was no nexus between the
city of San Bernardino and my private business, although I provided
proof from my insurance agent that this process could not be done.

CONDITIONAL US PERMIT FINDINGS (SECTION 19.78.050 SBHC)
1. The proposed use conforms to the objectives of the City's
General Plan in that amusement parks, which encompasses go-
cart racing facilities, are permitted in the CG-I, commericial
General, General Plan land use designation with a Conditional
Use Permit.
2. The proposed use will not adversely affect the adjoining land
uses and the growth and development of the area in which it is
located in that the proposal will be compatible with the heavy
commercial uses permitted along Foothill Boulevard. In
addition, conditions of approval will lessen any impacts to
existing legal but non-conforming uses.
3. The size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use in
a manner not detrimental to the particular area nor to the
peace, health, safety, and general welfare of the residents in
that the site can adequately accommodate the proposed go-cart
facility and satisfy all requirements for setbacks,
landscaping, parking and circulation.
4. The City Engineer has determined that the traffic generated by
the proposed use will not impose and undue burden upon the
streets and highways deSigned and improved to carry the
traffic in the area.
5. The granting of this Conditional Use Permit could be
detrimental to the peace, health and safety, and general
welfare of the citizens of the City of San Bernardino in that
potential liability concerns have not been adequately
mitigated or addressed.

SUBJECT: Objections to Opening Go-Cart Track on Foothill Blvd.
1. There is not enough parking in the immediate area to accommadate
the amount of cars that are attracted to the area. Hence, the
overflow uses the parking lot of VFW Post 8737 thereby causing our
members to be inconvienced with no place to park.
2. Some of the crowd that is attracted to the Go-Cart area are
members of Gangs which make our property unsafe for our members at
night.
3. When the area was opened ~ur parking lot was used as an overgrown
Trash Container.
4. The ~verflow crowd used our parking lot as a drinking area, each
morning empty beer cans, consumed by minors at times, other bottles
etc. had to be policed to make the area safe to drive a car on the
parking area.
5. The minimum we consider to be acceptable would be a fence
constructed to seperate the two properties, with a uniformed guard to
control drinking during their operating hours and to keep parking on
their property. This parking is extremely critical on weekends.
6. Another complaint we had when the track was in operation
people where urinating on our property with no consideration
thems~lves or our members, this should be eliminated with a

I am writing to let you know how much we enjoyed renting your go-
cart track. We had 14 young men (age 14 - 18) from our church youth
group, who had earned the money themselves through fund raisers.
Each boy, and adult leader, felt that this was the best and most
enjoyable use of the money, compared to anything else they had
done. They have each expressed a strong desire to do it again.
Several of the boys have gone out there on their own since to ride
the cars. This is all because of the professional manor in which
we were treated by your staff.
It is good to see someone providing real value in wholesome family
entertainmeht. Keep up the good work, and we hope to continue doing

REQUEST
The applicant requests approval of a Conditional Use Permit under
the authority of the Municipal Code, Section 19.83.300 to construct
a go-cart racing track. The proposed go-cart operation consists of
a racinq track with a capacity of twenty qo-carts, a two story
3,420 square foot bUildinq for office and storage, a parking lot
and a picnic area.
SITE LOCATION
The proposed 0.92 acre site is located at 2066 West Foothill
Boulevard, qenerally situated on the north side of Foothill
Boulevard apprOXimately 650 feet east of Terrace Street, in the CH,
Commercial Heavy land use desiqnation (Attachment Il.
MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
Under the Table of Permissible Uses, Use Classification number
6.280, amusement parks are allowed with a Conditional Use Permit in
the CH, Commercial Heavy and IL, Industrial Liqht land use
designations. The project as proposed is consistent with the
Municipal Code and is in conformance with the General Plan
(Attachment Al .
CALIFORNIA ENVIRONMENTAL OUALITY ACT
At its regularly scheduled meetinq of August 9, 1990, the
Environmental Review Committee (ERC) proposed a Mitiqated Negative
Declaration. The proposed Mi tiqated Neqative Declaration was
advertised and available for public review and comment from August
16, 1990 to September 5, 1990. No comments were received from the
public durinq that period (Attachment E).
BACKGROUND
Currently, the subject site consists of an unpaved parkinq lot and
the race track. On June 20, 1990 the applicant was first cited for
operatinq without an approved Conditional Use Permit, Business
License, and Certificate of Occupancy. At that time the operation
consisted of the race track, portable restrooms, and large refuse
containers used to store the qo-carts. On July 9, 1990 a the
applicant was convicted on all counts.

The a?plication for the proposed project was submitted to the
Plann~ng Department on August 21, 1989 and was deemed complete on
October 11, 1990. After numerous reviews, on October 11 1990 th
Development Revie.w Committee (DRC) cleared the site PI'an, f100~
plans, and elevat~ons for Planning Commission approval (Attachment
H) .
ANALYSIS
COMPATIBILITY WITH SURROUNDING LAND USES
The proposed site along with parcels to the east and west are
designated CH, Commercial Heavy. As mentioned previously, a go-
cart racing track is a permitted use in this land use designation
with a Conditional Use Permit.
The CH land use designation is intended for limited commercial and
industrial uses that require outdoor sales, display and/or storage
areas such as auto repair yards, new and used car and truck lots,
lumber yards, plant nurseries and other retail uses which require
extensive enclosed or outdoor storage areas.
Properties south of this project are designated CG-1, Commercial
General. The parcel backs up to a County Flood Control maintenance
road for lytle Creek (north of the site) which is designated PFC,
Public Flooo Control. Current land uses consists of the Veteran of
Foreign Wars Post 8737 (VFWl to the east; vacant land to the west;
and vacant land and a non-conforming single family residence to the
south. The proposed go-cart facility is not compatible with the
VFW facility or the single family residence. However, fraternal
organizations and single family residences are not permitted in
this land use classification. These uses are leqal but non-
conforming uses.

BUILDING ELEVATIONS

BUilding elevations were of particular concern to both staff and
the DRC. A revised plan called for a masonry bUilding with a
partial mansard roof and little articulation. The applicant was
directed to upgrade the bUilding by providing more windows and
landscaping, and extending the mansard roof to the east elevation.
Revised elevations were submitted and the bUilding was changed to
a metal bUilding. The proposed metal bUilding includes a mansard
type canopy on the south (facing Foothi 11 Boulevard) and east
elevations (facing VFW) , and partially on the west elevation
(facing the track). A number of windows have been added to the
south elevation, a color band is proposed around the roof line, and
a balcony is proposed at the southwest corner of the building. The
go-cart track is enclosed by a four foot high precision block wall
with a four foot high chain link fence on top (Attachment H).
FLOOR PLANS
The floor plans provided include storage space and an office on the
second floor and storage space for the go-carts and restrooms on
the first floor. The proposed office includes a file room and
bathroom. The bathroom includes a shower which is not allowed.
The conditional use permit has been conditioned to not include any
shower facilities (Attachme~t H).
PARKING
Parking requirements for the proposed go-cart track facility are
found under Municipal Code. Section 19.56.080 (A) (amusement,
recreational facil i ties) . This section requires a parking study
submitted with the application for a Conditional Use Permit
indicating parking needs for the proposed use. Based in part on
the parking study and on the recommendations of staff, the Planning
Commission shall determine the required number of parking spaces.
The applicant was unable to locate any other go-cart racing
facilities in the area. He did however, provided staff with a
survey of three amusement parks, Fiesta Village in Colton,
Bullwinkles in Ontario, and Grand Prix in Pomona. These facilities
differ from the proposed go-cart racing track in that they all have
an arcade. Bullwinkles and Fiesta Village also have batting cages,
miniature golfcourses, and restaurants. Fiesta Village has 56
parking spaces and operates a 12 go-cart racing track, Bullwinkles
has 130 parking spaces and a track capacity of 18 go-carts, and
Grand Prix has 60 parking spaces and a track capacity.of 40 0'0-
carts.

amusement. The site plan proposes 17 parking spaces. Based on the
survey provided and an evaluation by the City Traffic Engineer 17
parking spaces were deemed adequate for the proposed use
(Attachment F).
TRAFFIC AND CIRCULATION
The Public Works/ Engineering Department has determined that the
two proposed Twenty-four foot, one-way driveway approaches off of
Foothill Boulevard will provide adequate ingress and egress from
the site. Internal circulation was also deemed adequate.
SETBACKS, LANDSCAPING, AND INTERNAL PLANTING
The proposal satisfies the setback requirements for development in
the CH, Commercial Heavy land use designation (See Attachment A).
Excluding the 10-foot landscaped front setback along Foothill
Boulevard, the proposal includes approximately 19 percent interior
planting which exceeds the interior landscaping requirements.
COMMENTS
On September 6, 1989 the Planning Department received a written
complaint about the go-cart track operation from the VFW. At that
time the facility was operating illegally. The complaint was in
regards to insufficient parking, littering, and the use of the VFW
restrooms.' The complaint was turned over to the Code Enforcement
division who investigated the case.

On October 10, 1990 the Planning Department received a memorandum
to the Planning Commission from T.L. Cain, Liability Claims
Specialist, City of San Bernardino Risk Management Department. The
letter, also signed by the Director of Risk Management, Victor F
Lorch, recommends that one of the conditions of approval for the
Conditional Use Permit be that the grantee carry general liability
coverage of $1,000,000 with the City as a named additional insured
in the pol icy. This request stems from Mr. Cains personal
experience as an insurance claims adjuster for "Go-Karts of San
Bernardino." A collision at this facility maimed the left leg of
a young man and resulted in a lifetime disability (Attachment Gl.
As requested, this condition has been incorporated in the attached
Conditions of Approval.
CONCLUSION
The proposed project is an allowable use in the CH, Commercial
Heavy land use designation with a Conditional Use Permit. The site
plan meets the requirements of the Municipal Code in that it
provides for adequate landscaping, setbacks, and circulation. The
City Traffic Engineer has determined that 17 parking spaces are
adequate for the proposed facility. However, any additional
amusement uses such as an arcade will require more parking and will
be subject to a separate conditional use permit.

The proposed use conforms to the objectives of the City's

located in that the proposal will be compatible with heavy

COMPOSITE DEVELOPMENT PLAN
A composite Development Plan (CDP) shall be filed with the
Engineering, planning, and Building and Safety Departments
prior to Final or Parcel Map processing by the City pursuant
to Ordinance No. MC-592. The COP shall provide additional
survey and map information including, but not limited to,
building criteria (e.g. setbacks), flood control criteria,
seismic and geological criteria, environmental criteria and
easements of record. The CDP shall be labeled with the title
"Composite Development Plan", and contain a section entitled
"Composite Development Plan Notes". The applicant shall have
listed under the COP Notes section the following conditions or
mitigating measures required for the development of the
subject property:

agreeing that if the required landscaping is not maintained,

Dear Sir:
On or about July 1. 1989, a Midget Car Racing Track was opened,
to the public, at 2024 W. Foothill Blvd., adJacent our property.
It is not known if a building permit was secured to grade and
install this race track. However, a retaining wall, to hold the
grade, from spilling on to the V.F.W. parking lot should have been
required. The first rain will wash their grade allover our parking
lot.
At the present time the race track has insufficient parking
space for their patrons and consequently they are using the V.F.W.
parking lot.
In addition, to the use of our lot, their patrons are
scatteringdebris (bottles, papers, drink containers, etc..) over
our entire' parking lot, and no provisions have been made for
cleaning our area, by the race track operator.
The patrons or the race track are also coming into our building
to use our toilets as their porta-potties are not sufficient to
handle their crowds.
Request this entire situation be investigated and corrected to
everyone's satisfaction and citations be issued, if appropriate.

Enclosed is a copy of the pertinent business license records
requested from the City Clerk's office. Your attention is
directed to the last entry thereon.
I was the independent insurance claims adjuster employed by the
liability insurer for "Go Karts of San Bernardino" to investigate
and report on an extremely serious bodily injury claim which
resulted from a collision accident on that track. The injury
maimed the left leg of a young man and resulted in a lifetime
disability. This personal experience is the source of my
knowledge of the inherently dangerous nature of such an amusement
or entertainment activity.
It is recommended that one of the conditions for the permit (when
granted) is that the grantee carry general liability coverage of
$1,000,000 with the City as a named additional insured in the
policy;
