STAFF REPORT
During December, 1989, and January, 1990, urgency
ordinances and resolutions were adopted by the Mayor and Common
Council relating to the infrastructure fee for the Verdemont
area of the community. This fee is to be used to construct
right-of-way improvements in the area. One Mello-Roos Community
Facilities District has been formed to pay this fee, and others
may be formed in the future.
In the final ordinance, as adopted, a statement that the
fee would be adjusted by duly adopted resolutions by the Mayor
and Common Council, as deemed necessary to cover the cost of the
proposed improvements, carrying costs, inflation, etc., was
included.
In all meetings concerning the formation of Mello-Roos
districts, one of which has formed, staff presented the public
with the information on the escalation of fees anticipated for
the area. The escalation to cover increased costs for the work,
inflation and administration was to be adequate as well as
providing encouragement to join districts or make advance
payments of the fee.
The end of the first year is approaching and staff is
recommending the attached resolution be adopted, setting forth
the escalation in the fee. Language is still contained within
the ordinance to revise, either up or down, the escalation based
on actual experience and the desires of the Mayor and Common
Council as it relates to additional items being added to the
work. However, a yearly amending resolution will be needed to
adjust this fee annually until project completion. It may
assist in the formation of additional financing districts.
The first amendment to the Engineer I s Report has been
prepared and is available in the office of the Director of
Public Works. The amendment sets forth the basis and
justification for the fee adjustment of approximately 15%
(escalation of construction costs, contract administration,
payback on improvements, and reduction of dwelling units) as
well as providing information on charges to the area and fee.
Staff recommends the new fee be approved.

OF RESOLUTION 90-2 RELATING TO THE AMOUNT OF AN INFRASTRUCTURE
3 FEE TO BE LEVIED FOR RIGHT-OF-WAY IMPROVEMENTS AND PUBLIC
IMPROVEMENTS.

WHEREAS, the City of San Bernardino, California (the

"City") has on January 3, 1990, previously adopted an Urgency
Ordinance (MC-695) which established and authorized the levy of
7

an infrastructure fee (the "Infrastructure Fee") for the purposes
of funding the costs of certain Right-of-Way Improvements and
9
Public Improvements, all as more fully described in the January
urgency Ordinance; and
WHEREAS, in connection with its adoption of the January
urgency Ordinance, the City on January 3, 1990, also adopted a
Resolution (Resolution 90-2) setting the amount of the
Infrastructure fee; and
WHEREAS, on June 25, 1990, Section 1 of Resolution 90-2 was
amended by Resolution 90-253, revising the amount of
Infrastructure fee; and

WHEREAS, the City deems it necessary to adopt this

Resolution in order to provide for a revision to the amount of
20
the Infrastructure Fee set in Resolution 90-2, as amended, by
21
Resolution 90-253 which revision is attributable to the
22
escalation of the infrastructure fee for Right-of-Way
23

Improvements as defined in the ordinance.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

"SECTION 1. Infrastructure Fee. The Infrastructure Fee as
established pursuant to the Urgency Ordinance and set by
Resolution No. 90-2 is hereby revised to set a fee in the amount
of $6#976.00 effective sixty (60) days from the date of this
Resolution, per Equivalent Dwelling Unit, as said term is defined
in the Ordinance.
Said Infrastructure Fee shall also be subject to further
increase pursuant to the terms of any subsequent resolutions to
be adopted by the Mayor and Common Council as may be deemed
necessary in the best interests of the City. Said fee makes NO
provision for any part of the water transmission, distribution,
storage or delivery system in the area defined and all water
related fees shall be paid per established policy of the City of
San Bernardino Water Department."
SECTION 2. The Mayor and Common Council of the City of San
Bernardino do hereby find and determine that the fee increase as
provided in this Resolution does not exceed the estimated
reasonable cost of providing the service or facility for which
the fee is imposed.
