STAFF REPORT
In 1950, as part of the construction of the 5th Street overpass, the City of San
Bernardino entered into an agreement with the State of California for the maintenance
of four "mini-park" areas located North and South of 5th Street and East and West of
the 1-215 Freeway. The maintenance is being performed by the Ci ty Parks, Recreat ion
and Community Services Department.
Adjacent to the areas of maintenance on the West side of the 1-215 Freeway, Atchison
Topeka and Santa Fe Railway Company currently has right of way for the operation and
maintenance of its track system.
The railway company is presently expanding its facilities in this area. Part of the
proposed expansion includes the construction of a lead yard track, which would
traverse across one of the areas currently under City maintenance.
The State of California is ready to issue an encroachment permit to allow construction
of the track. Since the area is under City maintenance, the City IlUst also give access
to the rai lway company.
Annie Ramos, Director of the Parks, Recreation and Community Services Department was
contacted for comments and did not indicate any conflicts with this proposal. we are
proposing to amend the agreement with the State to relinquish the area from the City's
maintenance. This wi 11, however, take several months to accomplish. Grant ing of the
Permit to Enter to the railway company will allow them to proceed with construction in
a timely manner.
We recommend that the Permit to Enter be granted to the Railway Company.
URGfNCY CLAUSE: Santa Fe's project to upgrade the "A" yard is behind schedule due to
unexpected negotiations with Caltrans. It is vital that this itell be ~.u..cd at the
Council Meeting of 2-20-95 in order to _intain the schedule for upgrading service for
Metrolink patrons.

MEASURED WESTERLY ALONG SAID NORTH LINE FROM THE NORTHEAST
