The hearing was then "continued" until December 2, 1991 for the second required public hearing. The hearings are for the public to comment on the City's Solid Waste Source Reduction and Recycling Plan, along with the Household Hazardous Waste Element. The October 7th meeting gave the public the opportunity to comment on our draft Plan and Element. which had been available for the required 30 day's review. No public comment was received. The final version of the Plan and Element was expected from the consultant by November 1 in order to be available for the 30 days' review prior to the second public hearing on December 2. However, the'consultant, EMCON, notified us they would be unable to maintain our mutually agreed~upon deadline in publishing the final version of the Plan and Element. Mayor and Council tabled the second public hearing and adoption of the final version Plan and Draft until the final documents could be prepared and the CEQA process completed. The final Plan and Element has been published for Council and 30- day public review. Council set the second, and final, public hearing for March 2, 1992. Notice was placed in the local paper informing the public of the document review availability and of the March 2nd public hearing. The CEQA review process has been completed and all comments answered. Following closure of the public hearing, staff recommends adoption of the CEQA-process resolution with a mitigated negative declaration. Staff also recommends adoption of the final Source Reduction and Recycling Plan and the Household Hazardous Waste Element. 75-0264 I I-liT . . 1 Resolution No. 2 3 4 5 6 7 8 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING THE MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND THE MITIGATION REPORTING/MONITORING PROGRAM, AND ADOPTING PUBLIC WORKS PROJECT NO. 91-09B, THE SOURCE REDUCTION AND RECYCLING ELEMENT AND HOUSEHOLD HAZARDOUS WASTE ELEMENT. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals (a) This Resolution and Public Works Project 91-09B, the 9 Source Reduction and Recycling Element and the Household 10 Hazardous Waste Element, were prepared pursuant to the California 11 Integrated Waste Management Act of 1989 (AB 939) (Public 12 Resources Code Section 40000 et seq.) and Title 14 of the 13 California Code of Regulations, Chapter 9, Division 7. 14 (b) The first of two noticed public hearings to receive 15 public testimony on the elements of Public Works Project No. 91- 16 09B was held by the Mayor and Common Council on October 7, 1991. 17 (c) The elements of Public Works Project No. 91-09B were 18 reviewed by the Solid Waste Advisory Task Force during a 45 day 19 review period from September 9, 1991 through October 17, 1991, 20 and comments received were addressed in the final draft. 21 (d) The elements of Public Works Project No. 91-09B were 22 reviewed by the California Integrated Waste Management Board 23 during a 45 day review period from September 9, 1991 through 24 October 17, 1991, and comments received were addressed in the 25 final draft. 26 (e) The final draft elements of Public Works Project No. 27 91-09B were reviewed by the Final Review Committee of the Solid 28 Waste Advisory Task Force during a 15 day review period. The February 21, 1992 1 II III . . 1 Solid Waste Advisory Task Force's endorsement has been considered. 2 by the Mayor and Common Council. 3 (f) In compliance with the California Environmental Quality 4 Act (Public Resources Code Sections 21000 et seq.), an Initial 5 Study was prepared on November 8, 1991, and reviewed by the 6 Environmental Review Committee who determined that Public Works 7 Project No. 91-09B would not have a significant effect on the 8 environment and therefore, recommended that a Mitigated Negative 9 Declaration be adopted. (Attached as Exhibit I and incorporated 10 herein by reference.) 11 (g) The proposed Mitigated Negative Declaration received a 12 30 day public review period from December 16, 1991 through 13 January 17, 1992 and all comments relative thereto have been 14 reviewed by the Mayor and Common Council in compliance with the 15 California Environmental Quali ty Act (CEQA) and local 16 regulations. 17 (h) A Mitigation ReportinglMonitoring Program was prepared 18 on February 19, 1992, and included in the Proposed Mitigated 19 Negative Declaration. (Attached as Exhibit II and incorporated 20 herein by reference.) 21 ( i ) The Mayor and Common Council held a second noticed 22 public hearing to receive public testimony and fully reviewed and 23 considered proposed Public Works Project No. 91-09B, the proposed 24 Mi tigated Negative Declaration, and the Mi tigation 25 ReportinglMoni toring Program, the Public Services Department 26 Refuse Division Staff Report, and all public comments on March 2, 27 1992. 28 III February 21, 1992 2 . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 . SECTION 2. Negative Declaration NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor and Common Council that the proposed Public Works Project No. 9l-09B will have no significant effect on the environment, and the attached Mitigated Neg~tive Declaration and Mitigation ReportinglMonitoring Program heretofore prepared by the Environmental Review Committee as to the effect of this proposed project is hereby ratified, affirmed and adopted. SECTION 3. Adoption of Elements BE IT FURTHER RESOLVED by the Mayor and Common Council of the City of San Bernardino that it does hereby adopt Public Works Project No. 9l-09B, the Source Reduction and Recycling Element and the Household Hazardous Waste Element. (Attached as Exhibit III and incorporated herein by reference.) SECTION 4. Submittal of Elements To County The Public Services Department is hereby directed to submit a copy of the Source Reduction and Recycling Element and the Household Hazardous Waste Element to the County of San Bernardino for incorporation into the Countywide Integrated Waste Management Plan. SECTION 5. Notice of Determination The Planning and Building Services Department :is hereby directed to file a Notice of Determination with the County Clerk of the County of San Bernardino certifying the City's compliance with CEQA in preparing the Mitigated Negative Declaration.
