Fees for use of parks and recreation facilities, parking lots, sports facilities, sturges Auditorium and alcohol use permits were last modified in January 1991. This resolution is primarily to establish electrical energy fees for youth sports organizations. The city has built and maintains 37 lit ballfields throughout the city. Over 20 of these fields are used year-round by little leagues, youth soccer, youth winter baseball and tackle football. Electrical energy costs for these facilities used by youth sports organizations runs approximately $75,000 a year. Resolution 91-35 currently exempts youth organizations from paying fees for these facilities. Actual lighting costs on the city's 37 ballfields varies significantly. This variance in costs is due essentially to the amount of fixtures at each respective field. Fields range from the 20's to the 40's in fixtures and consequently may consume from 25 to 50 kilowatts per hour when the lights are on. Additionally, Edison's rates per kilowatt hour vary from winter to summer. It would not be practical to establish and charge a separate rate for each field. It should also be noted that th~ proposed energy fees for youth organizati0ns is significantly ~dSS th~n the $10 hourly rate currently ocing applied to adult sports programs. It is proposed that the youth league users be charged a rate of $4.50 per hour for little league fields and $5.50 per hour for senior league fields. This rate is based on the "average" little league field which would have 28 1000-w fixtures consuming 31.44 kw and an adjustment to cover the concession stands, scoreboards, and security lighting, and the "average" senior league field with 35 1000-w fixtures and a similar adjustment. Both rates use $.13 per kilowatt hour which is the average annual rate charged by Edison. -1- 75-0264 I; III . . Respective youth organizations would be requested to provide a light use schedule for their season. Leagues would be required to pay fees monthly with payment due prior to the start of each month. Additional fee modifications will include fees paid by San Bernardino city Unified School District for Sturges Auditorium and other park and recreation facilities. The district currently pays 100 percent of the establish rate even though they were partners in the development of sturges including providing portions of the parking lot and providing improvements to the facility. RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION 91-35 MODIFYING FEES FOR USE OF BUILDINGS, SPORT FACILITIES, PARK AND RECREATION FACILITIES, ALCOHOL USE PERMITS, PARKS AND PARKING LOTS, EQUIPMENT AND SERVICES AND STURGES AUDITORIUM BY ESTABLISHING ELECTRICAL ENERGY FEES FOR YOUTH SPORTS ORGANIZATIONS AND ESTABLISHING 50% OF THE CURRENT RATES FOR USE OF PARK AND RECREATION FACILITIES BY SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Findinqs. The Mayor and Common Council hereby find: A. Hearing has been held by the Mayor and Common Council pursuant to the provisions of Government Code Section 54990, et seq., to consider the levy of new and additional fees and service charges for various services provided by the Parks, Recreation and Community Services Department, and for uses of certain buildings, facilities and equipment, which hearing was held following public notice published in a newspaper of general circulation in the City of San Bernardino. B. None of the proposed increases exceed the actual cost of providing such s:..cv:"c.:ls and facilities, dn.~, for those services which are not completely paid for by the proposed fees, the additional expense to the City of providing the services shall be borne by the general fund of the city of San Bernardino. C. The proposed fees and charges are reasonable and necessary to enable the City of San Bernardino to more nearly meet the actual costs of providing such services and facilities. Public parks and recreation 2. buildings and swimming pools, under the jurisdiction of the Parks, Recreation and community Services Department, are public property and as such are available for use by any person or persons in accordance with the following specifications and as deemed appropriate by the Director. (This fee is in addition to any rental of staffing fees.) 2. Private Gatherinas. A. Alcohol Permit Fee: $50.00 (-150 participants); $100.00 or more (151 participants). This fee is in addition to any rental or staffing fees. E. Priority of Use: The priorities of use shall be in the following order: 1. Parks, Recreation Community Services and Department sponsored activities. 2. Parks, Recreation Services and Community Department co-sponsored activities. 3. Non-Profit, youth-service organizations located permanently in and serving the city of San Bernardino and tax supported groups. 4. Civic and social groups (resident and non- profit) . 5. Bernardino City Unified School District shall pay 50 percent of the established rates. G. Non-profit, located youth-serving organizations permanently in and serving the City of San Bernardino are those organizations whose principal purpose is to provide a service or program to participants, generally under the age of 18, of which at least fifty-one percent (51%) reside in the City of San Bernardino. H. A non-residency surcharge of ten percent (10%) for all facility or equipment rentals, class registration fees and excursion fees (not to exceed $10.00 on excursions) and a five dollar ($5.00) per non-resident surcharge for adults sports programs and art display programs shall be charged. 1. The word 'local' as used herein is defined to mean an organization whose membership is comprised of fifty one percent (51%) of City residents. J. As a condition of exemption, the Mayor and Common Council may require that the association, corporation, organization or group seeking exemption perform services or provide labor beneficial to the City or its residents. SECTION 6. Refundable Deposit. Refundable deposits held pursuant to this resolution may be refunded in full or in part within fourteen (14) days after completion of the use period. No refund shall be made until the using party or group has secured a signed inspection and release form from the appropriate facility manager, and delivered this executed release form to the Parks, Recreation and Community Services ~~l1;pt-'l.ent;. SECTION 8. Trust Fund Account. There is hereby established a trust fund account to be designated the "Sturges Auditorium Replacement Account." Of the fees established for Sturges Auditorium in section 5. of this resolution, $150.00 of the first hour operational cost, and $28.00 of each additional hour operational cost shall be deposited into the Sturges Auditorium Replacement Account.
