Synopsis of Previous Council action:
12-04-89 -- Ordinance MC 690 adopted levying an infrastructure

01-03-90 Ordinance MC 695 adopted extending effective date of
Ordinance MC 690.
01-03-90 Resolution 90-2 adopted revising the amount of an
infrastructure fee to be levied.
06-25-90 Resolution 90-253 adopted revising the amount of; the
infrastructure fee to be levied, from $7,375 to
$6,068, due to deletion of water system.
01-07-92 -- Resolution 91-9 adopted revising the amount of the
infrastructure fee to be levied, from $6,060, to
$6,976.
02-17-92 -- Public Hearing to consider increase of infrastructure
fee from $6,976 to $7,699, continued to 3-02-92.
Recommended motion:
That the hearing be closed, and the resolution establishing the
increase of infrastructure fee from $6,976 to $7,699, be adopted.

STAFF REPORT
In the adoption of the Verdemont Infrastructure Fee, pro-
visions for revision of the fee, based on actual costs incurred,
were included in the ordinance. In January of 1991, the fee was
increased based on what had occurred in that year.
Staff has completed the Second Amendment to the Engineer's
Report and is recommending an increase in the fee from the
present level of $6,976 to the proposed $7,699. The increase is
based on actual construction costs, loan repayment for funds
advanced for additional construction and adjustments based on the
construction cost index published in the Engineering News Record.
The increase is approximately a 9.4% increase and is less
than last year's 15% increase. All area residents were advised
that the fees would be adjusted and estimates placed the adjust-
ment at 15% per year for the first three years and 10% per year
for the next two. However, compliance with AB 1600 requires the
adjustments to reflect actual changes in costs as reflected in
the Engineer's Report.
Staff recommends that the hearing be closed and that the
resolution establishing the increased fee be adopted.

WHEREAS, the City of San Bernardino, California (the
"City") has on January 3, 1990, previously adopted an Urgency
Ordinance (MC-695) which established and authorized the levy of
an infrastructure fee (the "Infrastructure Fee") for the purposes
of funding the costs of certain Right-of-Way Improvements and
Public Improvements, all as more fully described in the January
Urgency Ordinance: and
WHEREAS, in connection with its adoption of the January
Urgency Ordinance, the City on January 3, 1990, also adopted a

90-2)
setting the amount of the

WHEREAS, on June 25, 1990, Section 1 of Resolution 90-2
was amended by Resolution 90-253, revising the amount of
Infrastructure fee: and
WHEREAS, on January 7, 1991, Section 1 of Resolution 90-
253 was amended by Resolution 91-9 revising the amount of the
infrastructure fee: and
WHEREAS, the City deems it necessary to adopt this
Resolution in order to provide for a revision to the amount of
the Infrastructure Fee set in Resolution 90-2, as amended, by
Resolutions 90-253 and 91-9, which revisions are attributable to
the escalation of the infrastructure fee for Right-of-Way
Improvements as defined in the ordinance.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

Said Infrastructure Fee shall also be subject to further
increase pursuant to the terms of any subsequent resolutions to
be adopted by the Mayor and Common Council as may be deemed
necessary in the best interests of the City. Said fee makes NO
provision for any part of the water transmission, distribution,
storage or delivery system in the area defined and all water
related fees shall be paid per established policy of the City of
San Bernardino Water Department."
SECTION 2. The Mayor and Common Council of the City of
San Bernardino do hereby find and determine that the fee increase
as provided in this Resolution does not exceed the estimated
reasonable cost of providing the service or facility for which
the fee is imposed.
