Synopsis of Previous Council Action:
11/20/00 Authorization to execute Agreement with Lim and Nascimento Engineering, Inc.
(LAN) for Civil Engineering and Construction Management Services for seismic
retrofit of 4 bridges.
Recommended Motion:
1) Adopt Resolution.
2) Authorize the Director of Finance to establish Account No. 242-362-5504-1748 in the
amount of $223,200 and Account No. 129-367-5504-1748 in the amount off28,900 from
Measure I funding in the FY 2002/03 budget and also increase the corresponding revenue
Account No. 242-000-4658 (Federal reimbursement) by $223,200 to reflect the Federal
reimbursement to be received for Rialto Ave at Burlington Northern Santa Fe Rail Road

Staff Report
Subject:
Resolution awarding contract to Dalaj International Corp. for bridge seismic retrofit at four
locations, and replacement of rail barrier at Rialto Avenue, per Plan No. 10309 and
authorization for the Director of Finance to amend the FY 2002/03 budget.
Background:
This project consists of strengthening four bridges over railroad tracks in order that they will
be able to withstand stronger earthquakes by installing reinforcement bars and additional
concrete work. These bridges, all over existing railroad tracks, are located on south Waterman
Avenue south of Caroline Street, north Mt. Vernon Avenue north of Highland Avenue, west
Rialto Avenue near Lytle Creek and west Rialto Avenue west of Macy Street. Seismic studies
prepared for these bridges determined that currently they might not withstand more than small
to moderate earthquakes, depending on depth and distance from earthquake center.
Seismically retrofitting these bridges will better enable them to withstand a larger earthquake.
Also as part of this project, the contractor will replace a damaged rail barrier at Rialto Avenue
bridge over BNSF railroad track.
The City received authorization for Federal and State funding for Seismic Retrofitting of these 4
bridges from Highway Bridge Replacement Rehabilitation (HBRR) grants in the total amount of
$834,000 (Federal $667,200) and (State $166,800). Additionally, $223,200 in HBRR grants has
been authorized for replacing the rail barrier at the Rialto A venue bridge over BNSF railroad
track. The Seismic Retrofitting projects are 100 percent reimbursable by Caltrans. The rail
barrier replacement at the Rialto A venue Bridge requires a $28,900 local match. Due to the fact
that the seismic retrofit of the bridges and the replacement of the rail barrier at the Rialto
Avenue Bridge are two different projects, CALTRANS requires that costs be kept separated for
the two projects.
Plan and specifications for this project are complete and it is ready to be awarded. The
estimated project costs are as follows:

This project was advertised locally in the San Bernardino County Sun Newspaper, Construction
Trend Newspaper, the City's web site, and with the San Bernardino Area Chamber of
Commerce. The following companies responded:

After the bid opening, Lehigh Construction Company was the apparent low bidder in the amount
of $250,475.00. However, after staffs review of the submitted bid documents, the total basic
bid Project amounts were not correct (it was $902,007.00), the Bid Bond was not signed, and
the bidder's acknowledgement of Addendum No. 3 was not signed. Therefore, Lehigh
Construction Company was not a responsive bidder. Based on review of the sealed competitive
bids received, staff has determined that Dalaj International Corp, the apparent responsive low
bidder, has met the minimum requirements of the specifications and bid guidelines, and
therefore recommends that the Mayor and Common Council award the referenced contract
accordingly.
Financial Impact:
Funding for Seismic Retrofitting of these 4 bridges in the amount of $950,000 has been
included in the FY 2002/03 budget. Staff recommends that the Director of Finance be
authorized to establish Account No. 242-362-5504-1748 with $223,200 and Account No. 129-
367-5504-1748 with $28,900 from Measure I funding in the FY 2002/03 budget, and increase the
corresponding Revenue Account No. 242-000-4658 (Federal reimbursement) by $223,200 to
reflect the Federal reimbursement to be received for Rialto Avenue at Burlington Northern
Santa Fe Rail Road Crossing (replace rail barrier). The Seismic Retrofitting of 4 bridges
project is 100% reimbursable through Federal and State grants, however the City is required to
provide $28,920 in matching funds for the Rialto Avenue at Burlington Northern Santa Fe Rail
Road Crossing project.
Recommendation:
I) Adopt Resolution.

amount of $223,200 and Account No. 129-367-5504-1748 in the amount of $28,900 from

RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AWARDING COl'iTRACT TO DALAJ INTERNATIONAL CORP. FOR
BRIDGE SEISMIC RETROFIT AT FOUR LOCATIONS AND REPLACEMENT OF
RAIL BARRIER AT RIALTO AVENUE, PER PLAN NO. 10309.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Dalaj International Corp. is the lowest responsive and responsible bidder
for bridge seismic retrofit at four locations and replacement of rail barrier at Rialto A venue,
per Plan No. 10309. A contract is awarded accordingly to said bidder in a total amount of
$934,341.30 of which $694,671.30 is for seismic retrofit of four bridges, and $239,670.00 for
Rialto A venue replacement of rail barrier at BNSF, with a total contingency amount of
$40,000, but such award shall be effective only upon being fully executed by both parties. All
other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to
execute said contract on behalf of the City; a copy of the contract is on file in the office of the
City Clerk and incorporated herein by reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage of the resolution.
