vacation be approved.

Staff Report
SUBJECT:
Authorization to Proceed and Plan Approval- proposed vacation of portions of Rosewood Drive,
between Orchard Drive and Tippecanoe Avenue and Orchard Drive, south of Rosewood Drive.
BACKGROUND:
The "HUB" project, which is a proposed development in the area generally along Laurelwood
Drive and Rosewood Drive, west of Tippecanoe Avenue, will require a realignment of
Laurelwood Drive from its present intersection at Tippecanoe Avenue, to Harriman Place. This
first phase of this development involves the relocation of Sam's Club to the new site. The
Economic Development Agency is the project manager for this development, and the City is
overseeing the design and construction of street improvements.
The realignment of Laurelwood Drive, and the proposed development, will require that a portion
of Rosewood Drive and a portion of Orchard Drive be vacated. The Agency has either purchased
all of the property along the proposed vacation, or will obtain right of possession through the
court prior to the vacation being complete.
Since this is a City initiated project, the normal $1,000 processing fee will not be collected. If
authorization to proceed is given, all affected utilities will be notified and posting and
publication will be done as required by law. Although we are aware of some utilities being
presently located within the area proposed to be vacated, these utilities would need to be
relocated relative to construction and development of the site. An easement document for the
new alignment of Laurelwood Drive will be processed prior to the completion of the vacation,
and recorded after the vacation is complete. The attached Plan shows the areas proposed to be
vacated and also delineates the new alignment of Laurelwood Drive. The remaining right of way
for Laurelwood Drive, west of the new alignment, and Orchard Drive will be vacated at some
future date, since development of this area is proposed as a future phase. Also, the easterly
portion of Rosewood Drive, immediately west of Tippecanoe, will not be vacated until such time
that In-and-Out Burger relocates their present facility at the northwest corner of Tippecanoe
A venue and Rosewood Drive, since they presently use this portion of Rosewood Drive for
access.
FINANCIAL IMPACT:
None
RECOMMENDATION:
Staff recommends that authorization to proceed with the proposed vacation is given and that Plan
10503 is approved.
