Staff Report
Subject:
Resolution of the Mayor and Common Council of the City of San Bernardino, California,
amending Resolution 1999-173 to increase administrative fees for business registration
liens.
Background:
In an effort to streamline the process for business registration lien record keeping and
records retention, an increase of $12.00 is proposed to the administrative fee to cover the
cost of recording a "Release of Lien" with the San Bernardino County Recorders Office.
Presently, when a lien is satisfied a "Release of Lien" is prepared and mailed to the party
that has shown proof of payment. However, many times this document is not recorded
with the San Bernardino County Recorder's Office and the lien (although satisfied)
remains as record on the affected property. This results in the division receiving many
future inquiries, particularly from title and escrow companies, as to the status ofthe lien
and staff time to research and prepare duplicate documents.
In addition, this situation makes it difficult to set a destrnction date for lien files. Although
a release may have been issued by the Clerk's office, if the document was not recorded we
may have inquires in the future and need to produce a new "Release of Lien".
The City Clerk's Office proposes to record the "Release of Lien" with the San Bernardino
County Recorder's Office when the lien has been satisfied. This will then ensure that the
release becomes public record as soon as possible. In addition, this will substantially
reduce the number of inquiries from title and escrow companies regarding the status of a
lien, thereby reducing staff time. Also, as the clerk's office will be recording the document,
a destruction date can more easily be set for these files.
Recommendation:
That the current fee for placing business registration liens be revised from the current $70
to $82 to cover the $12 fee charged by the San Bernardino County Recorder's Office to
record the Release of Lien.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Part III: City Clerk's Office of Resolution No. 1999-173 is hereby
amended to read as follows:
"Section 1. An $82.00 fee shall apply for placing liens on parcels for
uncollected business registration fees."
