The current annual salary of the Mayor is $32,000. This dollar amount was established in
the early 1970s and has not been increased since. Last year a survey was conducted relative to the
salaries of other Mayors and Council members. That survey is attached to this staff report. Under
the City's Charter, the Mayor is the City's Chief Executive Officer. As such, the salary of that
person in charge of the City's present and future should be more compatible with the responsibilities
and duties of that elected position.
As of July 1, 2002, the annual salary of a Superior Court Judge for the County of San
Bernardino is 139,476. It was felt that the Mayor of the City of San Bernardino -- the County seat--
is certainly entitled to make at least one-half of what is made by a judge in the County. Fifty percent
(50%) of $139,476 translates to an annual salary of $69,738. The monthly salary would be
$5,811.50. The Mayor is currently paid twice a month, and that mechanism would not be altered
so that each installment would be $2,905.75.
Tying the Mayor's salary to a percentage of what is made by a San Bernardino County
Superior Court Judge removes the "local politics" from the process because ajudge's salary is set
by the State Legislature.
If approved by the voters, this salary adjustment would become effective January 1,2003.
Thereafter, the annual salary would be adjusted and implemented each subsequent January I of each
subsequent year at the same fifty percent (50%) figure ofthe salary for a San Bernardino County
Superior Court Judge then in effect on that January I date.

10 the electors the Charter Amendment set forth below in bold type in this resolution.
II SECTION 2. Submittal to Electors. The following proposed amendment set forth in bold
12 type to the Charter of the City of San Bernardino is submitted to the qualified electors of the City
13 of San Bernardino for their approval or rejection at the consolidated special municipal election to

It is proposcd that Section 24 of the Charter of the City of San Bernardino be amended by
substituting a new second sentence in bold type so that the entire Section would now read as follows:
Section 24. Salary of Mayor. The Otnce of Mayor shall be a full
time position and the incumbent shall not engage in any business.
professional or occupational activities which interfere with the
discharge of the duties of such office. Effective January I, 2003,
the annual salary of the Mayor shall be set at fifty percent (50%)
of the salary for a Superior Court Judge, County of San
Bernardino, State of California, as of July 1, 2002, and shall
thereafter be adjusted and implemented January 1 of each
subsequent year at the same fifty percent (50%) figure of the
salary for said Superior Court Judge then in effect on said
January 1 date.

AMENDMENT TO THE CHARTER OF SAID CITY RELATING TO
THE SALARY OF THE MAYOR

4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS:
6 SECTION I. Recitals.

(a)
In accordance with the Constitution of the State of California, the City of San
8 Bernardino. a municipal corporation, has adopted a Charter.

(b)
The Mayor and ConUTIon Council of the City of San Bernardino desire .to submit to
10 the electors the Charter Amendment set forth below in bold type in this resolution.
11 SECTION 2. Submittal to Electors. The following proposed amendment set forth in bold
12 type to the Charter of the City of San Bernardino is submitted to the qualified electors of the City
13 of San Bernardino for their approval or rejection at the consolidated special municipal election to
14 be held on Tuesday. November 5. 2002.
15 PROPOSED CHARTER AMENDMENT NO.
16 It is proposed that Section 24 of the Charter of the City of San Bernardino be amended by
17 substituting a new second sentence in bold type so that the entire Section would now read as follows:

Section 24. Salary of Mayor. The Office of Mayor shall be a full
time position and the incumbent shall not engage in any business.

professional or occupational activities which interfere with the
21
discharge of the duties of such oftice. Effective January 1,2003,
the annual salary of the Mayor shall be set at fifty percent (50%)

of the salary for a Superior Court Judge, County of San

Bernardino, State of California, as of July 1, 2002, and shall

thereafter be adjusted and implemented January 1 of each

subsequent year at the same fifty percent (50%) figure of the
salary for said Superior Court Judge then in effect on said

January 1 date.
