STAFF REPORT
SUBJECf
Resolution of the Gty of San Bernardino authorizing the obligation and expenditure of the allocated
FY 07108 Justice Assistance Grant GAG) funds and authorizing the signing of an interlocal JAG
grant agreement with the GJuntyof San Bernardino.
BACKGROUND
Ax President Bush's request, GJngress consolidated the Byrne Grants and LLEBG into a single
program known as the Edward Byrne Memorial Justice Assistance Grant GAG) in order to
streamline funding and grant administration. The following new JAG guidelines were implemented
that changed the grant application, funding formulas and grant administration processes.
. JAG funds are split 60-40%, with 60% going to the State of California for the Edward
Byrne Memorial grants administered by the Office of Emergency Services. The
remaining 40% go to local law enforcement agencies as grant funds formerly known as
the Local Law Enforcement Block Grant.
. One aggregate grant application for all JAG funds allocated to county law enforcement
agencies must be filed with the Bureau of Justice Assistance.
. One jurisdiction in the county must act as the grant administrator and fiscal agent for
JAG funds and may charge an administrative fee for performing these duties.
. The mandatory 10% grant match was eliminated.
. The public hearing and advisory board requirements were eliminated.
. An Interlocal Agreement concerning the JAG program must be signed by all
jurisdictions in the GJuntyand must accompany the grant application.
The GJunty Law & Justice Group has agreed to serve as the grant administrator and fiscal agent for
JAG program funds and will charge each recipient a 5% administrative fee. The GJunty of San
Bernardino has prepared an Interlocal Agreement between the cities within San Bernardino GJunty
and the GJunty of San Bernardino, identifying the GJunty Law & Justice Group as the grant
administrator and fiscal agent and detailing JAG grant administration and billing procedures. Each
jurisdiction's Chief Executive, Gty Attorney and Gty Oerk must sign and submit the agreement to
the GJunty Law and Justice Group.
For FY 07108, the Police Depanment's allocation after deducting the 5% administrative fee isl$269,904. This amount is $107,486 (66.18%) more than last year's JAG allocation of $162,418. In
FY 06/07 the Department used JAG funds to cover 72.6% of the salary and benefits costs of the
following positions:
(1) Forensic Specialist III
(3) Dispatcher I/ll
In FY 07108 the Depanment will fund 100% of the salary and benefits of the Forensic Specialist III
and (3) Dispatch positions and $10,304 in computer equipment.

The chairperson of the Grants Conunittee determined that this item could be submitted directly to
the full Council as funding was allocated on a per capita basis.
FINANOAL IMPACT
The Department will be using the JAG allocation to fund 100% of the salary and benefits of four (4)
full-time police civilian positions. For FY 07/08, personnel costs are projected to be $259,600. The
civilian positions are existing and filled. The remaining JAG funds will be spent on computer
equipment. The FY 07/08 General Fund budget will be responsible for all overtime costs
associated with the four (4) grant positions.
RECOMMENDATION

BE IT RESOLVED BY THE MAYOR AND COMMON COUNOL OF THE
OTY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor and Common Council of the Gty of San Bernardino are hereby
authorized to obligate and expend the allocated Justice Assistance Grant monies in the amount of
$269,904 from the U.S. Depamnent of Justice and Bureau of Justice Assistance for law
enforcement support expenditures as outlined in the attached Expenditure Plan submitted by the
Chief of Police, marked as Exhibit A
SECTION 2. The Mayor and Common Council of the Gty of San Bernardino hereby
authorize the Gty Manager, Gty Attorney and Gty Oerk to execute on behalf of the Gty the
Interlocal JAG Grant Agreement between the cities within San Bernardino County and the County
of San Bernardino, a copy of which is attached hereto, marked as Exhibit B, and incOlporated
herein by this reference.

Since FY 99/00, LLEBG GAG) funding has been used to cover the personnel costs of a Forensic
Teclmician III position. The Forensic Specialist III supervises both the Identification and Evidence
units, comprised of one Administrative Oerk II, (10) Forensic Teclmician IIII, three Property
Teclmician IIII positions. These employees collect, process, store, and safeguard property and
evidence in police custody and protect the department and Gty from liability arising from the
mishandling or loss of these items. For FY 07108, the salary and benefits of the Forensic Specialist
III will be approximately $77,000.
Additional Dispatchers
Since FY 99/00, LLEBG GAG) funding has been used to augment staffing in Police Dispatch,
providing for three additional dispatcher positions. These positions are essential to maintain quality
service for the public and department personnel and handle 9-1-1 calls and other calls for police
service. For FY 07108, the salaty and benefits of the three grant funded Dispatcher II's will be
approximately $182,600.
Computer Equipment
The remaining $10,304 in JAG funding will be used to purchase needed replacement printers for the
Patrol Repon Room and Detective Bureau.

INTERLOCAL AGREEMENT
BETWEEN THE TOWN OF APPLE VALLEY AND THE CITIES OF BARSTOW, CHINO,
COLTON, FONTANA, HESPERIA, HIGHLAND, MONTCLAIR, ONTARIO,
RANCHO CUCAMONGA, REDLANDS, RIAL TO, SAN BERNARDINO, UPLAND,
VICTORVILLE, AND THE COUNTY OF SAN BERNARDINO, CA
CONCERNING DISTRIBUTION OF THE
2007 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD
This Agreement is made and entered into this day of , 2007, by and
between THE COUNTY OF SAN BERNARDINO, acting by and through its governing body,
the Board of Supervisors (hereinafter referred to as "COUNTY"), and the aforementioned
TOWN (hereinafter referred to as "TOWN") and named CITIES (hereinafter referred to as
"CITIES"), acting by and through their respective governing bodies, the Town Council and City
Councils, all of whom are situated within the County of San Bernardino County, State of
California, as follows:
WHEREAS, each governing body, in performing governmental functions or in paying for
the performance of governmental functions hereunder, shall make that performance or those
payments from current revenues legally available to that party; and

WHEREAS, each governing body finds that the performance of this Agreement is in the
best interests of all parties, that the undertaking will benefit the public, and that the division of
costs fairly compensates the performing party for the services or functions under this
Agreement; and
WHEREAS, the COUNTY agrees to release to TOWN and CITIES their respective
grant allocation from the JAG Award within sixty (60) days upon receipt of funds, less five
percent (5%) for administrative fees, as reflected on Appendix 1 here attached and hereby
incorporated by reference as part of this agreement; and COUNTY agrees to use the five
percent (5%) of JAG award funds received from TOWN and CITIES under this agreement for
administrative fees toward the administration of TOWN's and CITIES' programs during the
entire permissible duration of said programs; and TOWN and CITIES agree to deposit their
JAG award funds into a separate trust account in accordance with JAG guidelines; and TOWN
and CITIES each agree to the five percent (5%) reduction of their respective grant allocation
from the JAG award, as reflected on Appendix 1 for administrative fees toward the
administration of this program; and additionally the TOWN and CITIES each agree that it is
their responsibility to ensure these funds are expended in accordance with JAG guidelines,
and that the interest generated from such funds shall be solely applied and expanded in
accordance with these same JAG guidelines; and
WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate
the JAG funds, '

Section 1.
COUNTY agrees to release to TOWN and CITIES their respective grant allocation from the
JAG Award within sixty (60) days upon receipt of funds, less five percent (5%) for
administrative fees, as reflected in Appendix 1 here attached and hereby incorporated by
reference as part of this Agreement; and COUNTY agrees to use the five percent (5%) of JAG
award funds received from TOWN and CITIES under this agreement, for administrative fees
toward the administration of the TOWN's and CITIES' programs during the entire permissible
duration of said programs.
Section 2.
TOWN and CITIES agree to deposit their JAG award funds into a separate trust account in
accordance with the JAG guidelines; and TOWN and CITIES agree to the five percent (5%)
reduction of their respective grant allocation from the JAG award, as reflected in Appendix 1
for administrative fees toward the administration of this program; and additionally, TOWN and
CITIES each agree that it is their responsibility to ensure these funds are expended in
accordance with JAG guidelines; and that all interest generated from such funds shall be solely
applied and expended in accordance with these same JAG guidelines.
Section 3.
TOWN and CITIES agree to provide COUNTY with sufficient timely information on request as
necessary for COUNTY to meet JAG requirements for quarterly and annual financial and
performance reports.
Section 4.
Nothing in the performance of this Agreement shall impose any liability for claims or actions
against COUNTY other than what is authorized by law.
Section 5.
Nothing in the performance of this Agreement shall impose any liability for claims or actions
against TOWN and/or CITIES other than what is authorized by law.
Section 6.
Each party to this Agreement will be responsible for its own actions in providing services under
this Agreement and shall not be liable for any civil liability that may arise from the furnishing of
the services by any other party.
Section 7.
The parties to this Agreement do not intend for any third party to obtain a right by virtue of this
Agreement.

Section 8.
By entering into this Agreement, the parties do not intend to create any obligations, either
express or implied, other than those set out herein; further, this Agreement shall not create any
rights in any party not a signatory hereto.
WHEREFORE, all parties freely and voluntarily agree to all of the above terms.
