Staff Report
Subject:
Resolution authorizing the Director of Finance to increase the Purchase Order amount
for the provision of professional building plan review services with Willdan Associates,
Esgil Corporation, and California Code Check and to extend existing services
agreements.
Background:
On May 3, 2004 the Mayor and Common Council adopted Resolution 2004-120
approving Services Agreements with Willdan Associates, Esgil Corporation, and
California Code Check for the provision of expeditious professional building plan review
services. The resolution authorized purchase order amounts totaling $350,000 in
aggregate per year and had a 3-year term (initial year plus two one-year extensions)
which expired May 3, 2007.
Demand for expeditious professional building plan review services is contingent on a
number of factors such as the level of construction activity, the availability of City staff,
the complexity of the construction projects submitted, and the desire of applicants to
fast-track their projects. During the first half of the current fiscal year the Department
had two (of five) Plans Examiner positions vacant in the Plan Check Division. As a
result, plan review turn-around times became excessive and customers elected to
utilize outside plan review services at an increased rate. As a consequence, current
and anticipated invoices from the three vendors will exceed the current purchase order
limit of$350,000. Invoices received for work performed through April 2007 exceed the
purchase order amount by $66,000. It is anticipated that by the end of the fiscal year
the total of invoices will exceed the purchase order by $150,000.
A new RFP (F-07-48) for Expeditious Building Plan Review Services has been prepared
and bids will be received by June 27, 2007. Vendors will be selected and presented to
the Mayor and Council shortly thereafter.
The Department is requesting that the current purchase orders (No.'s 207253, 207255,
and 999782) be augmented by $250,000 to a total of$600,000 in aggregate and that
the existing services agreements with Willdan Associates, Esgil Corporation, and
California Code Check be extended to September 4, 2007 or until the completion of the
competitive bid process.
Financial Impact:
There is no impact to the City's general fund that will result from an increase to these
purchase orders for expeditious professional building plan check services. These
services are used when applicants request expeditious review of their plans. A portion
of the plan check fees collected, in an amount equal to the consultant charges, is
deposited to a trust account and payment to the consultant is drawn from the trust
account.
Recommendation:
Staff recommends that the Mayor and Council adopt said resolution.

10 WHEREAS, a Notice Inviting Bids (RFP F-07-48) was issued by the Finance
11 Department on May 30, 2007 and bids for professional building plan review services are due on
June 27, 2007, which will result in the selection of vendors and the establishment of new
12 Services Agreements, and
13 WHEREAS, due to increased demand for professional building plan review services it
14 is necessary to increase the current purchase order amount for FY06-07, and
15 WHEREAS, it is necessary to establish an interim purchase order for FY07-08 and to
extend the Services Agreements with the existing vendors to provide for said services until the
16 completion of the competitive bid process.
17 THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
18 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
19 SECTION 1. That the Director of Finance is authorized to increase the purchase order
20 amount by $150,000, from $350,000 to $ 00,000, in aggregate, for the provision of
21 professional building plan review services with Willdan Associates, Esgil Corporation, and
22
California Code Check.

24 SECTION 2. That the City Manager is authorized to execute Amendment 'pro. 1
25 extending the Services Agreements with Willdan Associates, Esgil Corporation. and California
26 Code Check to September 4, 2007 (Attached and incorporated herein as Exhibits A, B. and C).

2 SECTION 3. That the Director of Finance is authorized to establish an interim
3 purchase order for fiscal year 2007-08 in the amount of S100,000, in aggregate, for the

5 provision of professional building plan review services with Vdilldan Associates, Esgil

THIS AMENDMENT NO. 1 TO SERVICES AGREEMENT is entered into this

WITNESSETH:
A. WHEREAS, on May 3, 2004 the Mayor and Common Council adopted

services with Willdan Associates, Esgil Corporation, and California Code Check, and
B. WHEREAS, said Services Agreements expired on May 3, 2007, and
C. WHEREAS, a Notice Inviting Bids (RFP F-07-48) was issued by the Finance
Department on May 30, 2007 and bids for professional building plan review services are due on
June 27, 2007, which will result in the selection of vendors and the establishment of new
Services Agreements, and

NOW THEREFORE, the parties hereto agree as follows:
1. Section 4 of said Services Agreement for professional building plan review services dated
May 3, 2004 is hereby amended to extend the term of the agreement to September 4, 2007 or
to the completion of the competitive bid process currently underway pursuant to
RFP F-0748, whichever occurs first.
2. All other terms of the Services Agreement dated May 3, 2004 shall remain unchanged.
