Staff Report
SUBJECT:
Resolution authorizing and directing execution of easement documents for Southern California
Edison Company across City-owned property located at 40th Street, East of Waterman Avenue
and East of Electric Avenue.
BACKGROUND:
On December 21, 1998, Resolution No. 98-342 was adopted, creating Underground Utility
District No. 27 along portions of 40th Street between Electric Avenue and Waterman Avenue.
The district requires Southern California Edison Company (Edison) to underground its existing
overhead facilities. In order for Edison to comply with the undergrounding of portions of these
facilities, they will need to cross City property. As shown on the attached map, Edison will be
required to obtain easements from the City for property located specifically on the East side of
Electric Avenue at 40th Street, and on the East side of Waterman Avenue at 40th Street
(Wildwood Park). The proposed easements will not conflict with the City's present use of these
areas.
FINANCIAL IMPACT:
None. The facilities will be installed by Edison at no cost to the City.
RECOMMENDATION:
Staff recommends that the attached Resolution, authorizing and directing execution of easement
documents for Southern California Edison Company across City-owned property located at 40th
Street, East of Waterman Avenue and East of Electric Avenue, be adopted.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AND
DIRECTING EXECUTION OF EASEMENT DOCUMENTS FOR SOUTHERN
CALIFORNIA EDISON COMPANY ACROSS CITY-OWNED PROPERTY LOCATED AT
40TH STREET, EAST OF WATERMAN A VENUE AND EAST OF ELECTRIC A VENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor of the City of San Bernardino is hereby authorized and
directed to execute, on behalf of said City, easement documents to Southern California Edison
relating to certain City-owned real property located on the East side of Waterman Avenue at 40th
Street (Wildwood Park), copies of which are attached hereto as Exhibits "A" and "B."

On October 20, 2000, Resolution No. 2000-306 was adopted, authorizing and directing execution
of easement documents for Southern California Edison Company across city-owned property
located on 40th Street. Attached for your information is a copy of the correspondence sent to
Marmac Engineering regarding the recordation of the easement documents. Due to unforeseen
circumstances, Edison has abandoned the project and has instructed Marmac Engineering to stop
all pending projects, including recordation of existing documents.
At this time, it is uncertain when the project will be complete. If you have any questions
regarding this matter, please feel free to call me at 5328.
