Synopsis of Previous Council Action:
November 6, 1995 - Resolution 95-388 authorizing a lease contract (County Contract 95-907) for cm between City,
County, and Authority for the Handicapped and terminating previous lease agreements.
October 16, 1978 - Resolution 78-708 establishing the Authority for the Handicapped, a joint powers authority
involving the City and County, for the purpose of constructing the cm facilities and administering operations.

Staff Report
Subiect:
Resolution of the City of San Bernardino amending a lease contract for the Center for Individual
Development between the City of San Bernardino, the County of San Bernardino, and the
Authority for the Handicapped to extend the term from July 1,2000 through June 30, 2005.
Backl!:round:
The Authority for the Handicapped was created in 1978 as a joint powers authority between the
City and County to oversee the construction and operation of the Center for Individual
Development. This 17,900 square foot facility, located at 8088 Palm Lane, serve as a recreation
and multi-use facility for the disabled. The three principal parties involved with the CID are the
school district which utilizes the therapy pool for swim lessons for students from Anderson
School, the County which operates individual and group counseling and other Behavioral Health
services, and the City which operates recreation services for developmentally disabled children
and adults.
The amended lease agreement, as in the current 5-year agreement, provides for the City and
County to pay for equal shares (50 percent) of the operating costs. The school district provides
maintenance for the grounds and the swimming pool.
The current lease agreement provides the option for five 5-year renewals. This renewal will be
the first of the five options.
Financial Impact:
The operating costs for the CID is budgeted in the Parks and Recreation Department's general
fund budget at $86, I 00. The City incurs the operating costs and bills the Authority for the
Handicapped on a quarterly basis. The Authority in turn bills the city and the county for 50
percent of the costs and then pays the city the full amount. There are no other financial impacts.
Recommendation:
Adopt the Resolution.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING A LEASE
CONTRACT FOR THE CENTER FOR INDIVIDUAL DEVELOPMENT BETWEEN THE
3 CITY OF SAN BERNARDINO, THE COUNTY OF SAN BERNARDINO, AND THE
AUTHORITY FOR THE HANDICAPPED TO EXTEND THE TERM FROM JULY 1, 2000
4 THROUGH JUNE 30, 2005.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. The Mayor of the City of San Bernardino or her designee is hereby authorized
8 to amend San Bernardino County lease contract 95-907 with the County of San Bernardino and the
9 Authority for the Handicapped for the Center ofIndividuals with Disabilities consisting of 17,900
10 square feet of building, real property and other improvements, for the sole purpose of extending the
II tenn of said lease contract from Jt:ly 1,2000 through June 30, 2005.
12 SECTION 2. The authorization granted hereunder shall expire and be void and of no further
13 effect if the Agreement is not executed by both parties and returned to the Office of the City Clerk
14 within sixty (60) days following the effective date of the resolution.

IT IS HEREBY AGREED AS FOLLOWS:

WHEREAS, the AUTHORITY, County of San Bernardino ("COUNTY"), and City of San Bernardino
("CITY") have previously entered into a Lease Agreement, Contract No. 95-907, wherein the AUTHORITY
agreed to lease to CITY and COUNTY certain real property; and,
WHEREAS, the CITY and COUNTY desire to exercise the option to extend the term of the lease; and,
WHEREAS, the CITY and COUNTY have reviewed the allocation of use of the Premises and
determined that the allocation of space and rent should remain the same.
NOW, THEREFORE, in consideration of mutual covenants and conditions, the parties hereto agree the
Lease Agreement, Contract No. 95-907, is amended as follows:
1. EXTEND the term of the lease as provided in Paragraph 6, TERM, from July 1,2000 through
June 30, 2005.
