Initiation of a Development Code Amendment
Neighborhood-serving Grocery Stores
BACKGROUND
The Development Code permits supermarkets in many of the comm~rCial
land use districts subject to a development use permit. Superma kets
(and drug stores) over 15,000 square feet may sell alcoholic beverag s for
off-site consumption without having to comply with the locational cri eria.
Convenience stores, by definition, are establishments that sell groc ries,
staples, sundry items, and/ or alcoholic beverages, and have less than
5,000 square feet. Convenience stores are subject to a condition use
permit, with or without the sale of alcoholic beverages for 0 -site
consumption. In addition, locational criteria apply to the establishm nt of
a convenience store and for the sale of alcoholic beverages for 0 -site
consumption. ,

There are several small, full-service grocery stores in the City that ar~ not
able to sell alcoholic beverages for off-site consumption because they fit
the size definition of a convenience store and are subject to the IOCatOnal
criteria. However, these markets do not function as convenience s res.
They provide fresh fruits and vegetables, fresh meat, and food prepar d on
the site. These small, full-service grocery stores serve different nichrs in
the City; they generally serve the neighborhoods in which they are loc ted.
These markets are at a disadvantage because they cannot sell bee and
wine for off-site consumption like the larger grocery stores.
I believe these neighborhood grocery stores fill a need throughout thJ City,
and these stores should have the opportunity to sell beer and ~ine,
without being subject to locational criteria. If small, full-service m kets
are permitted, staff can establish development criteria such as ho rs of
operation, percentage or area for alcohol sales, inclusion of fresh fi ods,
etc. The Planning Commission can review these applications throug the
conditional use permit process.
FINANCIAL IMPACT ,
Staff estimates that preparation of a Development Code AmendmeJ will
cost approximately $2000. This includes legal advertisements IL and
copying charges. .
RECOMMENDATION
That the Mayor and Common Council direct staff to initia~ an
amendment to the Development Code to establish neighborhood-s rving
grocery stores as a permitted use, subject to a conditional use permi and
to prepare appropriate development criteria. '
