Description: Gas Tax Fund Finance: Council Notes: r,}lJ/b7 Agenda Item No. li e e e CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Resolution awarding a contract to Hardy & Harper, Inc. for cul-de-sac Street Improvements on 4th Street at Mt. V ernon Avenue (SS06-0 I), per Project Plan No. 11882, and authorization for the Director of Finance to amend the FY 2006/07 Budget. Background: On August 7, 2006, the Mayor and Common Council allocated funds, as part of the FY 2006/07 Capital Improvement Program (CIP) for 4th Street cul-de-sac at Mt. Vernon Avenue. This project consists of the following: I. Removal of existing asphalt pavement and concrete curbs. 2. Installation of asphalt roadway, curbs and driveways. 3. Replacement of roadway improvements. The plans and specifications for this project were completed and the project was opened to public bidding on April 3, 2007. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid Ameri,c:;. Online, Construction Bid Source, Bid Ocean, the City's web sites, and with the San Bernardino Area Chamber of Commerce. Corporation Perris $ 248,888.00 Enl!ineer's Estimate $ 199,895.00 Based on review of the sealed competitive bids received, staff has determined that Hardy & Harper, Inc. of Santa Ana, the apparent low bidder, has met the minimum requirements of the specifications and bid guidelines; and, therefore, recommends that the Mayor and Common Council award the referenced contract to Hardy & Harper, Inc. The estimated project costs are as follows: $ 169,000.00 $ 25,350.00 $ 25,650.00 $ 220,000.00 2 05/09/20078,29 AM e e e CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT - Continued If approved, this project is expected to begin construction in late July of 2007 and be completed by October of 2007. Financial Impact: Approximately $155,100 is available in Account No. 126-369-5504-7581 (SS06-01) "4th Street cul-de- sac at Mt. Vernon Avenue" and $50,000 is available to transfer from Account No. 126-369-5504-7322 (SS04-36) "E Street Bus Stop Relocation" and $15,000 is available to transfer from Account No. 126- 369-5504-7359 (SS-G) "School of the Month." After the budget adjustment, the total amount of this funding will be adequate. The '"E Street Bus Stop Relocation" project (SS04-36) has been completed. After the budget adjustment, an amount of$13,500 will remain in the account to cover close out costs. The "School of the Month" project (SS-G) is an annual allocation for improvements around schools that are requested at the monthly School of the Month meeting. A balance of $50,000 will remain the account which will be adequate for the remainder ofFY 06/07. Recommendation: I. Authorize the Director of Finance to amend the FY 2006/07 Budget by transferring $50,000 from Account No. 126-369-5504-7322 (SS04-36) "E Street Bus Stop Relocation" and $15,000 from Account No. 126-369-5504-7359 (SS-G) "School of the Month" to Account No. 126-369-5504- 7581 (SS06-01) "4th Street cul-de-sac at Mt. FOR CUL-DE-SAC STREET IMPROVEMENTS ON 4TH STREET AT MT. VERNON AVENUE (SS06-01), PER PROJECT PLAN NO. 11882, AND AUTHORIZATION FOR THE DIRECTOR OF FINANCE TO AMEND THE FY 2006/07 BUDGET. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Hardy & Harper, Inc., 1312 E. Warner Avenue, Santa Ana, CA 92705, is the lowest responsible bidder for Cul-de-sac Street Improvements on 4th Street at Mt. Vernon Avenue (SS06-01), per Project Plan No. 11882. A contract is awarded accordingly to said bidder in a total amount of $169,000.00, with a contingency amount of $25,650.00, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The City Manager is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of passage of the resolution.
