Staff Report
SUBJECT:
Authorization to Proceed and Resolution Setting Public Hearing - Underground Utility District
No. 34 - generally located along portions OO'd Street, between Waterman Avenue and a point
205 feet east of the centerline of Shirley Avenue.
BACKGROUND:
In March of 2007, the Underground Utility Committee recommended the approval of an
underground utility district generally located along portions oO'd Street, between Waterman
A venue and a point 205 feet east of the centerline of Shirley Avenue, as shown on the attached
plat. Shirley Avenue is located east of Del Rosa Avenue.
San Bernardino City Municipal Code Section 13.36 provides for the formation of Underground
Utility Districts for the removal of overhead utilities, such as power, telephone and cable TV.
The funding for the electrical portion of the undergrounding of these utilities is typically funded
by Rule 20A Funds. These funds, which are mandated by the PUC (Public Utilities
Commission), are set aside by the various power companies for the purpose of undergrounding,
and are then allocated annually for use by various cities and counties within a power company's
service area. Other utilities, such as telephone and cable TV, are not governed by the PUC and
therefore have to provide their own funding. Any conversions required on private property
within a district are paid for by either Rule 20A funds or the various utility companies, and there
is no cost to the property owners and no City funds are used for Rule 20A projects.
Approximately $700,000 a year is allocated for use by the City by Southern California Edison.
The City's recent and pending projects have depleted allocations that were available, but Edison
allows cities to 'mortgage' future projects for up to five years of estimated allocations. This
project will be funded by Edison from future allocations. The estimated cost from Rule 20A
allocations for this project is $ 7 million. This amount covers the cost of design and construction
of the entire project by Edison.
Since portions of properties along 3'd Street are within County jurisdiction, and there are several
County owned facilities in the City portion of the proposed district, the County has agreed to a
joint project with the City and will pay one-half of the total cost of the project from their
allocations. With the County's funding, the estimated cost from the City's Rule 20A funds will
thus be $3.5 million. Although a portion of the proposed district is in the City of Highland
(Phase 2 as described below), Highland has stated that they have no allocations available for this
project, and the County's portion of allocations includes the City of Highland's portion.
Due to the high cost of this district, actual construction will be carried out in two phases. Phase
I: Waterman Avenue to Lena Road; Phase 2: Lena Road to a point 205 feet east of the centerline
of Shirley Avenue. This will allow another project to be established and completed between

phases if necessary. The formation, however, will still be established as one project to facilitate
design ofthe complete project. Once the district is formed, Edison is then authorized to start
designing the project and can determine the actual cost of the design and construction.
If authorization is given to proceed, approval of the attached resolution will set a public hearing
for July 2,2007. All affected utilities will be given mailed notice of the hearing. Although
property owners will not bear any costs, affected owners will also be given mailed notice of the
proposed district.

Including the 2007 allocations, the City has a negative balance of $2.09 million after the Victoria
Avenue project and the 13th Street project. The 3rd Street project and 40th Street project will be
funded through the mortgage of future allocations, which will defer new projects until 2011 or
2012.
FINANCIAL IMPACT:
No City funds will be used for this project. The City's future allocation of Rule 20A funds will
be diminished by approximately $3.5 million.
RECOMMENDATION:
Staff recommends that authorization to proceed with Underground Utility District No. 34 be
given, and that the attached resolution setting a public hearing be adopted.

RESOLUTION NO.
WHEREAS, Chapter 13.36 of the San Bernardino Municipal Code of the City of San
Bernardino provides for the establishment of an underground utility district within said City upon
a finding by the Mayor and Common Council after a public hearing that the public necessity,

health, safety or welfare requires the underground installation of utilities within said district; and

11 WHEREAS, the Underground Utilities Committee of said City has recommended the
12 formation of an underground utility district to include the real property described in this
13 resolution.
