Dear Presiding Judge Welch:
This will confirm the recent telephone conversation with my office concerning the
procedural implementation of Assembly Bill 2022 (Longville) relative to filing fee surcharges for
the County's Courthouse Construction Fund.
Effective January 1,2003, California Government Code ~26826.4 is repealed. Therefore,
in order for the County of San Bernardino to continue to impose a thirty-five dollar ($35) filing fee
surcharge, the proceeds of which would be deposited in the County's Courthouse Construction Fund
on and after January 1,2003, it is imperative that the Board of Supervisors, "after giving notice and
holding a public hearing on the proposal," adopt such a filing fee surcharge.
You may wish to forward a copy of this letter to the appropriate County department( s) which
would be involved with such an implementation in order to ensure that it is completed in a timely
fashion so that there is no gap, or break, in the County's ability to impose this filing fee surcharge
effective January I, 2003.
