Staff Report
SUBJECT:
Request from the First Presbyterian Church at 1900 North "D" Street for waiver of Fire
Department Standby fees in the amount of $241.02.
BACKGROUND:
The First Presbyterian Church has a kitchen with commercial cooking equipment that does not
have an extinguishing system. An automatic fire extinguishing system is required by the
California Fire Code, if cooking produces grease laden vapors. However, the Church has an
agreement with the Fire Department prohibiting such cooking; thereby exempting them from
installing an extinguishing system.
The Church contacted the City asking for a waiver of this regulation to allow such cooking in
connection with a dinner benefiting the SOS Read Benefit that was to be held on October 12,
2002.
Although the Fire Code does not allow exceptions to this requirement, the Church was notified
that the event could proceed on schedule as long as a Fire Prevention Officer was scheduled on
standby during the event.
The Church received a bill from the Fire Department for the Standby charges in the amount of
$241.02 for the 3 hour event. They have since requested a waiver ofthat fee. At their October
23,2002 meeting, the Ways and Means Committee recommended approval of the waiver to the
Mayor and Council
FINANCIAL IMPACT:
The approval of the waiver would realize a loss of revenue to the City in the amount of the
$241.02 Standby fee.
RECOMMENDATION:
Approve waiver of fees.
