I . r\ PROPOSED SOUTHEAST INDUSTRIAL PARK REDEVELOPMENT PROJECT AREA PLAN AMENDMENT - EMINENT DOMAIN DATE: November 12,2002 SvnoDsis of Previous Commission/ConnciVCommittee Action(s): On January 24, 2000, the Community Development Commission authorized the Executive Director to prepare plan amendments to reinstate eminent domain in those Project Areas recommended by the Redevelopment Committee: Central City North, Uptown, Central City East, Meadowbrook and Central City South. On July 13, 2000, the Redevelopment Committee voted to recommend to the Commission that the plan for the Mt. Vernon Project Area be amended to extend the powers of eminent domain. On August 7, 2000, the Commission authorized the Executive Director to prepare a plan amendment to extend eminent domain in that Project Area. On March 18, 2002, based on the recommendation of the Redevelopment Committee, the Commission voted to authorize the initiation of a plan amendment to reinstate eminent domain over non-residentially designated property in the State College Redevelopment Project Area. ParkeMgenda\CDC 2002\02.11.18 Southeast Industrial Park Amend.doc COMMISSION MEETING AGENDA Meeting Date: 11/18/2002 Agenda Item Number: ~ ECONOMIC DEVELOPMENT AGENCY STAFF REPORT -------------------------------------------------------------------------------------------------------------------------- ProDosed Southeast Industrial Park RedeveloDment Proiect Area Plan Amendment - Eminent Domain BACKGROUND: At the Redevelopment Committee meeting of October 21, 1999, a discussion was held regarding amending the Agency's existing Redevelopment Project Areas to extend the ability to use eminent domain when necessary. As a consequence, the Committee directed Staff to evaluate the need to re- establish the power of eminent domain in selected Project Areas. Staff and Special Counsel surveyed each Project Area considering the need and potential for future development. Based upon that survey, it was recommended that the following Project Areas be considered for amendment to extend the power of eminent domain: . Central City North - The Entire Project Area . Uptown - The Entire Project Area . Central City East - The Entire Area, Except Government Buildings . Meadowbrook - The Entire Area Project Area . Central City South - The Entire Project Area On January 24, 2000, the Community Development Commission authorized the Executive Director to prepare plan amendments to reinstate eminent domain in those Project Areas recommended by the Committee. On July 13, 2000, the Redevelopment Committee, realizing that the Agency would lose its powers of eminent domain in the Mt. Vernon Corridor Redevelopment Project Area by June of 2002, voted to recommend to the Commission that the plan for that Project Area be amended to extend the powers of eminent domain. On August 7, 2000, the Commission authorized the Executive Director to prepare a plan amendment to extend eminent domain in the Mt. Vernon Corridor Redevelopment Project Area. On March 18, 2002, based on the recommendation of the Redevelopment Committee, the Commission voted to authorize the initiation of a plan amendment to reinstate eminent domain over non-residentially designated property in the State College Redevelopment Project Area. As of today, the Redevelopment Plans for the Central City East, Central City South, Meadowbrook and the Mt. Vernon Corridor Redevelopment Projects have been successfully amended. Plan amendments for the State College, Uptown and Central City North Projects are well underway. Economic Development Agency Staff Report Southeast Industrial Park Page 2 However, because of issues related to environmental assessment and the formation of Project Area Committees, the Uptown and Central City North plan amendments most likely will not be presented for Council/Commission consideration until the Fall of2003. CURRENT ISSUE: As previously acknowledged by the Commission, the Agency has lost its powers of eminent domain in the Southeast Industrial Park Redevelopment Project Area. Because of problems in the Southeast Industrial Park including impaired investments, stagnant lease rates, underutilization of commercial sites and incompatible land uses vis-a-vis current market directions, the Mayor has directed Staff to seek Committee/Commission consideration of amending the Redevelopment Plan for the area to reinstate the powers of eminent domain. On November 7, 2002, the Redevelopment committee considered the matter and voted to recommend to the Commission that it authorize the Executive Director to prepare a plan amendment to reinstate eminent domain in the Southeast Industrial Park Redevelopment Project Area. ENVIRONMENTAL IMPACT: Not applicable. FISCAL IMPACT: Estimate - $35,000.
