Agenda Item No. 3/ CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Resolution of the Mayor and Common Council of the City of San Bernardino establishing a voluntary payroll deduction program for the "Save Our Services" (SOS) fund. Background: Governor Davis has called a special session of the Legislature on December 9, 2002, to start budgetary negotiations. According to the League of Cities, he is proposing $5 billion in cuts as a starting point, a mid-course correction to address the $6.1 billion anticipated shortfall for the current fiscal year. By January 10, 2003, the Governor is required to submit a balanced budget plan for Fiscal Year 2003/2004. With the state's projected Fiscal Year 2003/2004 budget deficit projected at $21 billion, City services are likely to be negatively impacted to protect the state's budget and services. Cities can work to counteract the loss of services by lobbying at the grassroots level and in Sacramento, and by preparing to support or oppose measures on the 2004 statewide ballot and beyond. In order to accomplish this, funds must be raised to help pay for the cost of campaigning for and against measures that affect city services and revenues. The League of California Cities created Action for Better Cities (ABC) to lead this effort. Action for Better Cities has established the separate "Save Our Services" (SOS) fund to pay the typical costs of these campaigns such as polling, signature gathering, brochures, etc. City officials and employees are invited to contribute to the separate "SOS" Fund by check or voluntary payroll deduction. These donations will only be used for League-approved statewide ballot measure advocacy to protect city services and revenues. If the League sponsors a ballot measure to constitutionally protect city revenues, the "SOS" Fund will support a major part of the expenses of that campaign. Fiscal Impact: There is no cost to the City for the establishment of this program. Recommendation: Adopt Resolution. e 9 10 II 12 13 e 14 15 16 17 18 19 20 21 e I RESOLUTION NO. 2 RESOLUTION OF THE MA YOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ESTABLISHING A VOLUNTARY PAYROLL DEDUCTIO'\ 3 PROGRAM FOR THE "SAVE OUR SERVICES" (SOS) FUND. 4 WHEREAS, as a general rule, city leaders are in a better position than State government 5 to make decisions governing local affairs, educate the citizenry as to the benefits of strong local 6 government, and advocate on behalf of cities; and 7 WHEREAS, measures enacted through the legislative process, as well as by statewide 8 ballot initiatives, over the past 20 years have produced the unintended consequences of destabilizing city finances and have weakened the ability of city residents to govern local affairs through their elected community representatives; and WHEREAS, the state of California is currently using over $800 million each year in city property tax funds to balance the state budget; and WHEREAS, the California Legislative Analyst's Office has projected that the state is facing a structural budget deficit of over $10 billion per year over the next five (5) years, and city services and revenues are at risk of further state raids; and WHEREAS, the League of California Cities is currently conducting research on various ways to secure constitutional protection of city services and revenues and may sponsor a statewide ballot measure for this purpose in 2004 or thereafter; and WHEREAS, Action for Better Cities was created by the Board of Directors of the League of California Cities to advocate voter approval of constitutional protection of city services and revenues and opposition to ballot proposals that reduce local democratic control of local services 22 and revenues; and 23 WHEREAS, Action for Better Cities has established the "Save Our Services" (SOS) Fund 24 to finance the cost of any statewide ballot measure campaign to preserve and protect city services 25 and revenues; and 26 WHEREAS, elected and appointed city officials and employees have the opportunity to 27 provide leadership in Action for Better Cities through voluntary financial contributions to the 28 "SOS" Fund; and HTC/js[SOS.RESOLUTION] I l/'I ,Ie). )/ :..., ),,-, G:-'/c.'~ ,-' e I RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ESTABLISHING A VOLUNTARY PAYROLL DEDUCTlO:\ ~ PROGRAM FOR THE "SAVE OUR SERVICES" (SOS) FUND. 3 WHEREAS, the expenditure of monies in the "SOS" Fund by Action for Better Cities shall 4 be limited and dedicated to ballot measure campaigns that are designed to specifically strengthen 5 the services and revenues of city governments. 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 7 OF SAN BERNARDINO AS FOLLOWS: e 8 SECTION 1.
