Background: The vehicles to be replaced have surpassed their economic life and have become an economic burden to maintain and will be placed in surplus for auction. The normal replacement mileage for safety pursuit motorcycles is between 45,000 and 65,000 miles. The four (4) new Kawasaki Patrol Police motorcycles will replace the following existing fleet, which are on the Vehicle Replacement list. Mileaae 46,307 53,338 64,790 56,809 "Unit #1010 was to be replaced with one of the motorcycles purchased with the initial Purchase Order No. 995633 in February 2002, however, due to an accident totally damaging Unit #1 002 motorcycle, Unit #1010 remains on the Vehicle Replacement list. Pomona Valley has agreed to honor the same price of $10,075.57 plus tax $780.86 each unit, as quoted on P.O. #995633, for this piggyback order to a total amount of $43,425.70. (see Attachments 1 and 2) Section 3.04.010 B.2 of the Municipal Code allows an exemption for purchases awarded within one year, which were competitively bid and for which more than one response was received, and the vendor has established a set price. In November 2001 two bids were received in response to RFQ F-02-30 for Four (4) Kawasaki Police Patrol Motorcycles, and Pomona Valley was awarded the bid. The local Kawasaki dealer, Chaparral Motorsports, was contacted October 29, 2002 and the service manager verified they cannot accommodate the City specifications for modifying the City motorcycles Also, their service department is not prepared to set up a police motorcycle at this time (see Attachment 3). FINANCIAL IMPACT Funds for the four (4) Kawasaki Police Patrol Motorcycles are available in FY2002/2003 budget, Account No. 635-341-5701, Motor Vehicles. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF A PIGGYBACK PURCHASE ORDER TO POMONA VALLEY KAWASAKI, INC. FOR THE PURCHASE OF FOUR (4) KAWASAKI POLICE PATROL MOTORCYCLES FOR THE POLICE DEPARTMENT TRAFFIC DIVISION. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council on January 22,2002 awarded a purchase order to Pomona Valley Kawasaki, Inc. , for the furnishing and delivery of four (4) Kawasaki Police Patrol Motorcycles for the Police Department Traffic Division; and that Pomona Valley Kawasaki, Inc. has agreed to provide additional purchases of the same vehicle for the same amount. Pursuant to this determination, the Purchasing Manager is hereby authorized to issue a piggyback purchase order for four (4) Kawasaki Police Patrol Motorcycles; in accordance with Bid Specification F-02-30 for the total amount of $43,425.70; . SECTION 2. Such award shall only be effective upon issuance of a Purchase Order by the Purchasing Manager. The authorization to execute the above referenced Piggyback Purchase Order is rescinded if it is not issued within sixty (60) days of the passage of this resolution. SECTION 3. The Purchase Order shall incorporate by reference this Resolution No. 2002- and shall read, "Pomona Valley Kawasaki", P.O.
