SUBJECT
Resolution authorizing termination of the City's participation in a contract with the cities of
Colton, Lorna Linda, Redlands, Rialto, and the County Fire Department and to transfer full
responsibility and ownership of the air truck to remaining participants.
BACKGROUND
On March 6, 1972 the Mayor and Common Council authorized the execution of an agreement
with the cities of Colton, Lorna Linda, Redlands and Rialto and the fire districts of Bloomington,
Fontana and Muscoy for mutual aid in the providing of supplemental fire protective services.
The agreement allowed agencies to have mutual advantage and benefit of other parties to render
supplemental fire protection. In the event of an emergency incident that was beyond the control
of the responsible agency they would activate the mutual aid response, requiring assistance from
one or all of the other involved parties.
On August 6, 1979, the cities of San Bernardino, Rialto, Redlands, Colton, Lorna Linda, and
Central Valley Fire Protection District (currently San Bernardino County Fire Department)
formed a Joint Powers Authority known as Confire. Confire also entered into an agreement to
purchase an air truck, now referred to as Breathing Support 221 (BS-221). Cities representing
Confire had equal ownership of this specialized apparatus. BS-221 is a truck with an air
compressor, two large air storage tanks, and a complement of spare breathing apparatus bottles
for use at major fire incidents.
The San Bernardino City Fire Department (SBCFD) has been responsible for the operation and
storage of BS-221, and Confire shared in maintenance costs. In the event one of the members of
Confire experienced a major incident, BS-221 was dispatched upon request. The SBCFD would
then respond with an operator and provide breathing air for all personnel at the emergency.
For the last 23 years, BS-221 has served Confire well; however, due to its age and required
maintenance, SBCFD recently purchased a new Breathing Support apparatus as its replacement.
Due to the age of the original BS-221, under normal conditions, we would surplus such an
apparatus. The BS-221 contract with Confire, however, delineates that parties withdraw from
ownership. When this is done, ownership defaults to the remaining Confire agencies. On page 5,
paragraph 11 of the 1979 agreement (Exhibit A) authorization is provided for any party to
terminate participation upon written notice to all other parties. There is no longer a need for our
department to maintain BS-221. Because of this contract with Confire, we need to withdraw
from ownership in lieu of a surplus process for this vehicle.
FINACIAL IMPACT
There will be no negative financial impact imposed upon the City of San Bernardino. By giving
our interest of BS-221 to Confire, the City of San Bernardino will no longer be responsible to
provide a share of routine maintenance and repairs for this apparatus.

SECTION 1. On March 6, 1972 the city established an agreement with cities of Colton,

Lorna Linda, Redlands, Rialto and the Fire Districts of Bloomington, Fontana, and Muscoy for

mutual aid in providing of supplemental fire protection services;

SECTION 2. On August 19, 1980 the Mayor and Common Council authorized the
12
execution of a first amendment to agreement with the cities of Colton, Lorna Linda, Redlands,
13 Rialto, and the Central Valley Fire Protection District substituting Central Valley Fire Protection
14 District as a party in place of the fire districts of Bloomington, Fontana, and Muscoy;
15
SECTION 3. On February 7,1979 the Mayor and Common Council adopted Resolution
16
No. 79-54 authorizing an agreement providing for the joint use of an air truck (now referred to as
17
Breathing Support 221) by the fire departments. The agreement (attached and incorporated herein
18
as Exhibit "A") established that all parties were responsible for the air truck and written notice is
19
required of an agency terminating its participation in this agreement;

SECTION 4. The San Bernardino City Fire Department recently purchased a new breathing
21

support apparatus and requests authorization to withdraw from ownership of BS-221;
23
SECTION 5. Based on the above, the Mayor and Common Council hereby terminate the
24
City's participation in the February 7,1979 agreement effective after thirty (30) days written notice
25 is provided by the Fire Chief.

6 Bernardino", the CITY OF RIALTO, a municipal corporation, herein-
7 after referred to as "Rialto", the CITY OF COLTON, a municipal
8 corporation, hereinafter referred to as "Colton", the CENTRAL
9 VALLEY FIRE PROTECTION DISTRICT, a San Bernardino County Special
10 !District, hereinafter referred to as "Central Valley", and
11 the CITY OF REDLANDS, a municipal corporation, hereinafter
12 referred to as "Redlands".

WHEREAS, it is to the mutual advantage of San Bernardino,

25 NOW, THEREFORE, in consideration of the mutual covenants,

promises, conditions and agreements herein contained, the parties

1. The term of this agreement shall be for a period of

one (1) year commencing July 1, 1979, and ending June 30, 1980;
3 thereafter, this agreement shall continue from year-to-year until
4 terminated by the parties hereto as hereinafter provided.

2. San Bernardino, Rialto, Colton, Central Valley,
6 and Redlands shall purchase and maintain a "high pressure air
7 compressor" at an estimated capital cost of $20,000; said equipmcn
8 to be used by the fire departments of the entities entering
9 into this agreement. The estimated cost of the air compressor
; does not include any charge for maintenance of the equipment.

i 3. San Bernardino, Rialto, Colton, Central Valley and
12 . Redlands shall mount this high pressure air compressor on a

13 ; sui table vehicle (truck cab-chassis) owned by San Bernardillo;

along with related equipment such as, but not limited to, spare
15 air bottles, electrical generator, electric lights and tools.

4. The original cost of the high pressure air compressor,
!the vehicle upon which it is to be mounted, and installation casts

i shall be prorated in the following manner:

sum of $20,000, then any such excess cost shall be prorated
equally amongst all of the parties to this agreement, excluding
San Bernardino.
5. A fund in the amount of $1,000 shall be established fori
the purpose of paying the maintenance of the high pressure air
compressor, vehicle and the other specialized equipment for
the fiscal year commencing July 1, 1979, and ending June 30,
1980. Said fund of $1,000 shall be in addition to the purchase
and installation cost and shall be prorated according to the
number of fire calls in the following manner:

It is understood and agreed by the parties hereto that the
: proration computed hereinabove is based upon fire calls for the

6. The amount of maintenance costs for each succeeding
4 year will be prorated in the above manner no later than February
51st of each calendar year for the following fiscal year by a
6 committee of the Chiefs of the participating fire departments.

7. In the event of major repairs or unforeseen costs with
8 respect to the maintenance and operation of the vehicle or equip-
9 ment, which exceeds the budgeted maintenance costs for the year,
10 each of the parties will bear its prorated percentage of the
11 amount of the deficit.

8. The maintenance and repair of the vehicle and high

13 I pressure air compressor will be performed by the San Bernardino

Fire Department who shall keep an accounting of the costs of such

I maintenance and repair and apportion the costs to each of the
!participants for their prorated share.

The party or parties providing the personnel for the

,operation of the equipment shall not be entitled to contributions

from the other parties for such personnel costs.
10. The vehicle and high pressure air compressor will be
available to all parties hereto on a daily basis for routine fill-
ing of air bottles and cascade systems and shall be subject to a
24-hour per day call for cmerg0ncies. In the event two or more

demands by different parties hereto arc made for the equipment on

or about the same time, then the basis for determining the party
3 first receiving the equipment shall be the basis that the first
4 demand is the first served.

11. Any party to this agreement may terminate its
6 participation upon giving thirty (30) days advance written notice
7 to all other parties. All outstanding debts arising out of this
8 Agreement on or prior to the date of termination shall be paid
9 within thirty (30) days after notification by the terminating
10 party. All vehicles and equipment purchased under this agreement
11 ;will become the property of the remaining participants. In
12 the event of termination of this agreement by the parties hereto,
13
the last remaining non-terminating party shall be entitled
I to the ownership and possession of the equipment and the other
[parties hereto agree to execute and deliver all necessary releases
I
or documents of title necessary to place the ownership of the
14

17 vehicle and equipment in the last remaining non-terminating
18 'party.

12. Legal title to the truck and to all installed equip-
:ment shall be held in the name of San Bernardino during the term

13. In the event one or more of the parties hereto termin-

l,part1es shall execute a new agreement embodying and setting
i forth the same terms and conditions as this agreement but omit-

15. Each party hereby agrees to hold the other party, its

elected officials, officers, agents and employees harmless from
3 any liability for damage or claims for personal injury, including
4 death, as well as from claims for property damage which may arise
5 from the indemnifying party's performance and operations under
6 this Agreement.
7 None of the parties shall be held responsible or liable to
8 the other party for any loss, damage, detention, or delay caused
9 by accidents, strikes, lockouts, fire, flood, act of civil or
10 military authority or by insurrection or riot or by any other
I cause which is beyond its control.
I 16. Nothing contained in this Agreement shall be construed
