STAFF REPORT
.
From time to time the Redevelopment Agency and the City have
allocated and confirmed the availability of 125 parking spaces to
the Pacific Federal Savings Building now known as the Pacific
First Bank Building. The current owner, Fred C. Sands, is
selling the building and the new owners want to be sure that the
parking that has been available to the building for many years
remains available.
It is therefore recommended that the resolution be adopted
to continue the availability of 125 parking spaces for the
Pacific First Bank Building.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO ALLOCATING 125 UNDESIGNATED PARKING SPACES IN THE
FIVE-LEVEL PARKING STRUCTURE FOR PACIFIC FIRST BANK BUILDING AND
REPEALING RESOLUTION NO. 84-366.

WHEREAS, the Redevelopment Agency of the City of San

Bernardino did on January 18, 1973, adopt Resolution No. 2658
7
providing for allocation of 125 undesignated parking spaces
within the five-level parking structure to Santa Fe Federal
8

Savings and Loan Association, the predecessor to Pacific Federal
Plaza Savings and Loan Association, and
WHEREAS, on September 10, 1984, the Mayor and Common
Council did adopt Resolution No. 84-366 concurring in the
allocation of such spaces, as provided for in the lease agreement
between the City and the Redevelopment Agency relating to use of
the five-level parking structure, and
WHEREAS, the Fred C. Sands, the current owner of the
building, now known as the Pacific First Bank Building, desires
to transfer such building, and
WHEREAS, the infusion of new owners into the downtown area
will be beneficial for the citizens of San Bernardino,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
125 undesignated parking spaces in the five-
level parking structure located adjacent to City Hall are hereby
allocated to the Pacific First Bank Building, for use of the
occupants of that building without charge except as specified
below, which allocation shall be effective solely in conjunction
with the ownership, use and operation of said buildi~g, which

allocation shall not be separately transferable or assignable.
In the event City hereafter elects to assess

Oear Mr. Barlow,
The purpose of this letter is to inform you that aa
the current owner of pacific Federal Savings Plaza,
located at. 330 North "D" Street, San Bernardino,
California, I am under contraot to s.ll the property
-t.o Mr. " Mrs. Anthony Duquette and Mr. Hutton
Wilkinson. The purchasers in this transaction
require assurance, prior to close of escrow, thAt
the 125 parking spac.s will be transferred to tbem
as the new ownen when they acquire title to the
building. I would therefore appreciate your
DringinlJ this matter to the City Council on Monday,
March 11th. I respectfullY request that the City
Council of San Bernardino authorize the change in
v..ting from Il'red C. Sands to the new owners,
effective at close of escrow, in regard to
Resolution 84-366 which grants 125 und.siqnated
parking spaces to Pacific redaral Savings Plaza.
We believe that by granting this requ~t the City
CO\1Oc11 ha. insw:ed the viability of the Civic
Center complex _ by c:ontinuinq to provide adequate
parking for exiating buildings within the City
center an<! thereby mitigating traffic and parkinq
problems within the aua.. By previously granting
Resolution 84-366, the City has ena:tlled vital
busin..... to be located close to City ..rvices,
which benefits all the citi~en. and residents of the
city of San Bernardino.

which qrant& the unreserved parkin9 and provides
that said parking is allocated solely in conjunction
with the ownership us. and operation of said
building. The property has changed owneub1p
approximiltely four times aioce its development and
in each inatance the parking resolution has been
tied to the ownership, which we believe was the
origin&l intent of the City. Therefore, we request
you approve this ch&nqe in vesting in order to
maintain the original intent of the Resolution.
