Mr. Reed: As per our meeting of Tuesday, March 5, 1991 at 2:15 P.M.,
we came to an agreement that should work for both the city and our
building.
We shall expand the landscaping in the front of our building for
a 10 Ft. wide strip as per the proposed site plan. The front
North East corner will be planted in climate tolerate plants
or landscape zero.
The back parking lot shall be landscaped as follows; the North-
East corner of the backlot shall be landscape zero or climate
tolerate low maintenance plants. The South side shall be in
honey-suckle vine or an equivalent vining type plant.
We shall put in a 6 Inch curb, 2 Ft. from the fence to accomodate
a curb stop.

REOUEST
The applicant, Joanne Simmonds, is making an appeal to the
Council under Chapter 2.64. The appeal concerns Municipal
Code Section 19.56.120(A)(5). This section requires 5%
interior landscaping of paved parking area. The applicant
request that the Mayor and Council repeal this regulation
and/or somehow exempt Conditional Use Permit No. 90-51 from
the 5% parking lot landscape requirement.
BACKGROUND
Conditional Use Permit No. 90-51 is a request to permit the
operation of a vocational trade school for heating and air
conditioning repairs and service instruction in a 3,829
square foot building located on a .67 acre parcel at 1598
North "H" Street. Municipal Code Section 19.56.120(a) (5)
requires that at least 5% of the total paved parking area be
landscaped. The applicant objected to the regulation at the
Planning commission hearing held on January 8, 1991. Even
though the objection was not a formal variance request, it
appears the facts of this case could not support the Findings
required to support a variance. The Planning commission
denied the objection and approved the Conditional Use Permit
with the requirement to provide the 5% interior landscaping,
by a 7-0 vote.
At the Council's February 18, 1991 meeting, the appeal was
continued until the Council's March 11th meeting.
This continuance was to allow staff time to meet with the
applicant and look at alternative parking lot landscape
designs. On February 20, 1991, staff called the applicant to
schedule a meeting to discuss landscape issues. The appli-
cant asked for a delay, because of family matters, until
after February 28th. Staff phoned on March 1, and was
informed that the applicant was out of town until Monday,
March 4th. At the time of writing this report, staff has not
been able to meet with the applicant.
ANALYSIS
The requirement of parking lots with 10 or more spaces having
5% interior landscaping (excluding setbacks) is based on
Municipal Code Section 19.56.120(A) (5). It is not enough
that the applicant does not like the 5% landscape provision,
(eg. to costly, place for litter to collect), to avoid this
provision. The Code must be either; one, amended to exempt
this property and other similar properties, or two, a finding

that the existing situation supports the granting of a
variance. In staff's review of the situation, there are no
physical practical difficulties unique to the site, prevent-
ing installation of landscaping. Installing landscaping will
not deny the use or enjoyment of the property, the granting
of a variance is not detrimental to the public welfare, but
probably would constitute the granting of special privilege,
and granting of a variance would be contrary to general
objective of the General Plan relating to the goal of pro-
viding high quality physical and visual developments.

I am in occupancy at 1598 N. I'HI. St., San Bernardino (Corner
of 16th ~ "H"l. This is a small pie wedged shaped lot, which
borders the freeway on the west, the 16th st. over ramp on
the north, one small house to the east and a large vacant
lot on the south. I am appealing the requirement regarding
landscaping in the parking lot. This would limit my parking
in the front.

To run a successful business, one must look busy and parking
in the front does not deter or hinder anyone in the area.
The back landscaping would serve no purpose, as we wc.uld
then have a problem with weeds, gophers, and litter.
I took the time to gather the consensus from my surrounding
neighbors, in result they agreed that there would not be a
significant purpose for the additional landscaping. They
mentioned a few of their own concerns. For example, the
water droc'ght and the additional landscaping would create a
hazardous condition for traffic at this location. This is a
route that many neighborhood children have to go to and from
school. It is very hard to see a 3 to 4 foot child behind a
5 foot bush. There has been occasions when a car didn't stop
at the intersection and because of the bad visibility the
stopped car proceeded and the two cars collided.
Isn't our goal in San Bernardino, to have a clean good
looking city? A ha....en fc.r litter is not conducive to a clean
city, and it would invite a place for undesirables to.hlde.
It would use unnecessary water and with the drought
conditions, is this wise? The building is already landscaped
across the front with planted areas and also on the corner.
Even at this time the corner collects litter.
I would appreciate a reconsideration on this requirement.

REOUEST
The applicant requests approval under authority of Municipal
Code Section 19.83.5.120 to permit the operation of a voca-
tional trade school for heating and air conditioning repairs
and service instruction within an existing 3,829 square foot
commercial building.
LOCATION AND LAND USE
The irregularly-shaped, approximately 29,185 square foot (.67
acre) subject site is located on the southwest corner of "H"
and 16th Streets, with frontages of 115 and 372 feet, respec-
tively. The site is located within the Uptown Redevelopment
Area and IL, Industrial Light, General Plan land use desig-
nation (Attachment F).
MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
The proposed vocational trade school is in conformance with
the Municipal Code and General Plan subject to approval of a
conditional use permit as shown in Attachment A.
CALIFORNIA ENVIRONMENTAL OUALITY ACT STATUS
The proposed project is categorically exempt from the Cali-
fornia Environmental Quality Act under Section 15301, Class 3
for existing facilities of commercial structures changing use
with only minor interior alterations and no major intensi-
fication.
BACKGROUND
The applicant applied for the vocational trade school Condi-
tional Use Permit on August 16, 1990. The Development Review
Committee (DRC) members, at their September 13, 1990 regular-
ly scheduled meeting attended by the applicant, required
revised site plans. In addition to requesting the submittal
of another site of plan, the applicant was also informed of
additional landscaping requirements applicable to the project
due to its location within the uptown Redevelopment Area.
During this period the applicant had already been granted a
temporary Certificate of Occupancy to begin operating the
vocational school. The owner of the property had re-surfaced
the front and rear parking lots with asphalt paving without
contacting the Planning and Building Services Department for
any landscaping or permitting requirements.

After several meetings with the applicant and individual
members of the, Redevelopment, E~gineering and Planning
Departments, rev~sed plans were subm~tted and reviewed by the
D~C on November 29, 1990. At that time, the project was
g~ven clearance onto the Planning Commission for their final
determination.
ANALYSIS
Permitted Use
The proposed vocational trade school is permitted
IL, Industrial Light, General Plan land use
districts subject to approval of a conditional use
within the
designated
permit.
Site Design and Parking
The subject .67 acre site is of adequate size and dimension
for the proposed vocational trade school. A front lot,
consisting of approximately 7,064 square feet, will have a
one-way traffic aisle and be striped to accommodate 4 parking
stalls, including one required handicap space. A rear lot,
accessed by a 24 foot wide, two-way drive aisle will be
striped for 31 additional parking spaces. This number
exceeds the minimum 22 student and 6 faculty spaces required
for parking based on the school's projected enrollment and
maximum allowable building occupancy level of 34.
The existing, one-story 3,829 square foot commercial building
is of adequate size and dimensions for the proposed voca-
tional school use. No exterior modifications are required
and few interior minor alterations will be necessary to
convert the existing offices into school and work areas for
the vocational instruction.
Traffic Circulation
One-way traffic flow for the front lot and two-way traffic
flow within the larger rear lot will provide adequate inter-
nal circulation on the subject site. Ingress and egress for
the vocation school will be from "H" Street. Based on the
projected student enrollment and limited building occupancy,
traffic flow will not be impacted significantly on surround-
ing roadways, nor will property owners be detrimentally
affected by the proposed school usage.

Compatibility with Neighborhood
The proposed vocational trade school is located in aIL,
Light Industrial designated district as are the adjoining
properties to the south. Properties to the east and north
are designated Residential-Medium and Residential Suburban,
respectively. The 215 Freeway abuts the site's rear property
line to the west.
A freeway over pass at 16th and "H" Streets buffers the
subject site from residential properties to the north. The
freeway provides a barrier between the light Industrial areas
and residences further to the west. The Residentially
designated properties to the east are improved with both
single and mUltiple-family dwellings.
Setbacks and Landscaping
The project site's location within the Uptown Redevelopment
Area requires a minimum of 10 percent of interior landscapinq
for commercial parking lot areas, and a landscaped, minimum
10 foot front setback area. However, since the applicant is
a tenant leasing the existing building and site, it was
determined by the Redevelopment Agency to reduce the RDA
landscaping requirement to 5 percent along with the still
mandatory 10 foot minimum landscaped front setback.
The applicant's site plans incorporate the 10 foot wide
landscaped front setback area. However, the shown rear
parking lot landscaped area still needs to be extended an
additional, approximately, 90 feet westward along the site's
northern property line to meet the revised 5 percent land-
scaped interior parking lot requirement.
All landscaped areas will be maintained and sprinklered with
automatic irrigation systems as approved by the Public
Works/Engineering and Parks and Recreation Departments.
COMMENTS RECEIVED
No comments from any adjoining or surrounding commercial or
residential property owners have been received at this office
regarding the project proposal as of the written date of this
staff report.

CONCLUSION
The subject site's proposed vocational trade school use is
permitted within the IL, Industrial Light, General Plan land
use designation subject to approval of a conditional use
permit. The scale and intensity level of the proposed school
does not project to be a detrimental impact to either sur-
rounding commercial or residential properties. The school is
already operating under a temporary permit. The project is
categorically exempt from CEQA.
RECOMMENDATION
Staff recommends that the Planning Commission:

COMMERCIAL. INDUSTRIAL
1. Conditional Use Permit No. 90-51 shall be in effect for a
period of 12 months from the date of approval. However, if no
development has been initiated at the end of the 12 month
period, the application shall expire. Additional time may be
approved upon request of the applicant prior to expiration of
the l2-month period. Expiration Date: January 8. 1992
2. PARKING:
a. This development shall be required to maintain a minimum
of 35 standard off-street parking spaces.
b. All parking and driving aisles shall be surfaced with two
inches of AC over a suitable base or equivalent as
approved by the city Engineer. Parking spaces shall be
striped and have wheel stops installed at least three
feet from any building, wall, fence, property line, or
walkway.
c. Whenever an off-street parking area is adjacent to or
across an alley from property zoned residential, a solid
decorative wall six feet in height shall be erected and
maintained along the property line so as to separate the
parking area physically from the residentially zoned
property provided such wall shall be three feet in height
when located within the required front or street side
yard setback. Where no front or street side yard is
required, such wall shall be three feet in height when
located within ten feet of the street line.
d. Whenever an off-street parking area is located across the
street from property zoned for residential uses, a solid
decorative wall or equivalent landscape berm not less
than three feet in height shall be erected and maintained
along the street side of the lot not closer to the street
than the required depth of the yard in the adjoining
residential area. No fence or wall located in the front
setback shall obscure the required front setback

3. REFUSE ENCLOSURES:
Whenever refuse bins are located within or adjacent to a
parking area used by the public, they shall be enclosed by a
decorative wall six feet in height along the rear and sides
and screened gate(s) six feet in height along the front. The
enclosure shall not be placed within the required front or
street side yard setback area. Exact location and size of
refuse enclosures are to be determined by the Planning
Department and Division of Public Services Superintendent.
WALLS:

4. LANDSCAPING:
The intent and purpose of this section is to prevent trees and

Grading and revegetation shall be staged as required by the
city Engineer in order to reduce the amount of bare soil
exposed to precipitation.
7. During construction, the city Engineer may require a fence
around all or a portion of the periphery of the site to
minimize wind and debris damage to adjacent properties. The
type of fencing shall be approved by the City Engineer to
assure adequate project site maintenance, clean-up and dust
control.

COMPOSITE DEVELOPMENT PLAN
A Composite Development Plan (COP) shall be filed with the
Engineering, Planning, and Building and Safety Departments
prior to Final or Parcel Map processing by the City pursuant
to Ordinance No. MC-592. The COP shall provide additional
survey and map information including, but not limited to,
building criteria (e.g. setbacks), flood control criteria,
seismic and geological criteria, environmental criteria and
easements of record. The COP shall be labeled with the title
"Composite Development Plan", and contain a section entitled
"Composite Development Plan Notes". The applicant shall have
listed under the COP Notes section the following conditions or
mitigating measures required for the development of the
subject property:
10. The property owner shall sign a covenant running with the land
agreeing that if the required landscaping is not maintained,
the City may enter on the the property and install and main-
tain the required landscaping and may lien the property for
the costs. The covenant shall be signed and recorded with the
~ounty of San Bernardino Recorder's Office prior to the
1ssuance of any Certificate of Occupancy. In addition, a
landscape maintenance easement shall be filed with the Recor-
der's Office, which gives the City the right to enter the

Engineer and a grading permit will be required. The grading plan
shall be prepared in strict accordance with the City's "Grading
Policies and Procedures" and the City's "Standard Drawings",

E. SETBACK AREAS
All required aetbacks abutting a publiC right-of-way ehall be land-
scaped (except for walks and driveways ~hich bisect or encroach opon
the required landscape area). The required setbacks shall be land-
scaped ~ith trees, shrubs, and groundcover. Landscaped earth berms
ehall be erected and maintained within the eetback along the above
indicated property line. Bermed areas shall have a maximum of 3:]
slope and be planted with a tall fescue type turf grass, or otber
approved landscaping.

Gravel and decorative rock are not appropriate materials to be used
as ground cover or bedding material and will be considered hardscape.
G. SLOPES
1. To protect against damage by erosion and negative visual impact,
