STAFF REPORT
Staff has received a request for the City to participate
in the cost of constructing a sewer line to serve "K" Street,
south of Congress Avenue. As described on the attached memo to
the City Administrator, Parcel Map 7174 was conditioned to
construct sewer to this development, prior to building permits.
Plans for the sewer extension, as shown on the attached
map, were completed in 1981, but no developer has been able to
fund the work as part of an overall development project on one
or more of the parcels created by Parcel Map No. 7174. Several
persons have tried to develop this land with various proposals,
but have not proceeded. The extraordinary cost for extending
the sewer is expected to be a major reason why none of the three
lots have been developed.
A request has been received from a prospective developer
of 278 South "K" Street for the City to participate in the cost
of extending the sewer main from "I" Street, in order to render
his proposed development financially feasible. Participation by
the City is authorized by Section 13.08.080 of the SBMC, pro-
vided that certain criteria are met. Attached is a copy of our
memo of 1-23-91 to the City Administrator, with our determina-
tions of these criteria.
The prospective developer has offered to participate in
the cost of extending the sewer main in the amount of $10,000.
The City Administrator is in agreement with the proposed cost
participation.
An amount of $50,000 was allocated in the 1990/91 Sewer
Line Construction Fund (245), under Account No. 245-365-57704.
Approval for the expenditure of $37,000, to extend a sewer main
to serve 2160 Roosevelt Street, was granted at the Council
meeting of 2-4-91. Supplemental funds will, therefore, be
needed in the amount of $74,000 to finance the total cost of
this project.
It is recommended that the transfer of $74,000 from
Account No. 245-365-57731, "Cajon Trunk Extension - Cable Creek
Channel to Little League Drive," to Account No. 245-365-57704,
"City's share of Sewer Main Extensions," be approved. The sewer
main extension in Cajon Boulevard has not been commenced, since
development of adjoining property has been deferred until an
environmental impact report has been completed. Therefore, the
transfer of $74,000 will not result in any further dalays to
this sewer main extension, since the funds can be replaced in
the 1991/92 Sewer Line Construction Fund Budget.
Staff, therefore, recommends approval of the City's
participation in the construction of a sewer, initially to serve
278 South "K" Street, in accordance with approved plans, with
funding being provided from Account No. 245-365-57704.

In 1980/81, Parcel Map No. 7174 was prepared for property
located on South "K" Street adjacent to Lytle Creek. It
created three parcel s and was condi ti oned to connect to the
sewer system of the Ci ty. Improvements on the sewer and the
streets were deferred on the map to the time of building
permits.
In the intervening years. there have been at least three
reques ts to wa i ve the requi rement of connec ti ng to the sewer
based on cost of construction. Plans were completed in 1981.
and easements secured for the line. but the overall length is
something over 1,700 feet. The most recent request concerns
one of three lots created. The owner has been advi sed that it
is a condi ti on on the map and does not meet the el i gi bil i ty
requirements for a waiver. He has subsequently asked about the
likelihood of reimbursement as provided for in Section
13.08.080.
Section 13.08.080, Part B. has 6 criteria we need to check:
1. Is it a logical extension of the system? Yes.
2. Do adjacent properties have reasonable development
potential in the next 10 years? Yes.
3. Are there sufficient monies unencumbered in the sewer line
fund? Likely. Account No. 245-365-57704 was set up for
this type of funding and has not as yet been used.
Presently. there is a balance of $50,000.00. Other funds
are available in the sewer construction fund that are
presently not encumbered for current projects.

Is applicant receiving any other form of government
financing for this project? None we are aware of.
Total estimated cost for construction is approximately
$87,000.00. It would appear reasonable that each of the three
parcels created be assessed equal shares (perhaps $10,000.00)
for a total of $30,000.00 leaving $57,000.00 to be funded by
the City. Under ordinary conditions, the Developer would
construct and ask for monies from the City but considering this
is a single family unit, it seems unreasonable to ask for
$87,000.00 for sewer line construction.
Plans are complete, easements are recorded and staff would
suggest that this be done as a City-initiated project and that
it represents a 1 ogi cal extensi on of the Ci ty sewer system.
The adjacent school, businesses, and the property farther to
the West (mobile home park) may indeed be interested in the
sewer being available.

Should you agree with this plan, please notify our office and
we will prepare a Council Acti on Request on thi s issue for
their consideration. Although unusual, it is not a unique
application of the code and appears to be the only realistic
solution to bringing sewer into this area. it has been nearly
10 years si nce desi gned and to date no one has been able to
complete the construction.
