The appli- cant requests that the Mayor and council reconsider this regulation and not require the 5% interior landscaping. BACKGROUND conditional Use Permit No. 90-51 is a request to permit the operation of a vocational trade school for heating and air conditioning repairs and service instruction in a 3,829 square foot building located on a .67 acre parcel at 1598 North "H" Street. Municipal Code section 19.56.120(A) (5) requires that at least 5% of the total paved parking area be landscaped. The applicant objected to the regulation at the planning commission hearing held on January 8, 1991. The Planning Commission denied the objection and approved the Conditional Use Permit with the requirement to provide the 5% interior landscaping, by a 7-0 vote. OPTIONS AVAILABLE TO THE MAYOR AND COUNCIL The Mayor and Council may deny the appeal and approve Condi- tional Use permit No. 90-51 or uphold the appeal in concept and continue the matter until staff has prepared the appro- priate findings for variance of the regulations. This is a small pie wedged shaped lot, which borders the freeway on the west, the 16th st. over ramp on the north, one small house to the east and a large vacant lot on the south. I am appealing the requirement regarding landscaping in the parking lot. This would limit my parking in the frc.nt. e To run a successful business, one must look busy and parking in the front does not deter or hinder anyone in the area. The back landscaping would serve no purpose, as we would then have a problem with weeds, gophers, and litter. I took the time tc. gather the consensus from my surrounding neighbors, in result they agreed that there would not be a significant purpose for the additional landscaping. They mentioned a few of their own concerns. For example, the water drought and the additional landscaping would create a hazardous condition for traffic at this location. This is a route that many neighborhood children have to go to and from school. It is very hard to see a 3 to 4 foot child behind a 5 foot bush. There has been occasions when a car didn't stop at the intersection and because of the bad visibility the stopped car proceeded and the two cars collided. Isn't our goal in San Bernardino, to have a clean good looking city? A haven for litter is not conducive to a clean city, and it would invite a place for undesirables to,hlde. It would use unnecessary water and with the drought conditions, is this wise? The building is already landscaped across the front with planted areas and also on the corner. Even at this time the corner collects litter. LOCATION AND LAND USE The irregularly-shaped, approximately 29,185 square foot (.67 acre) subject site is located on the southwest corner of "H" and 16th Streets, with frontages of 115 and 372 feet, respec- tively. The site is located within the uptown Redevelopment Area and IL, Industrial Light, General Plan land use desig- nation (Attachment F). MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE The proposed vocational trade school is in conformance with the Municipal Code and General Plan subject to approval of a conditional use permit as shown in Attachment A. CALIFORNIA ENVIRONMENTAL OUALITY ACT STATUS The proposed project is categorically exempt from the Cali- fornia Environmental Quality Act under section 15301, Class 3 for existing facilities of commercial structures changing use with only minor interior alterations and no major intensi- fication. BACKGROUND The applicant applied for the vocational trade school Condi- tional Use Permit on August 16, 1990. The Development Review Committee (DRC) members, at their September 13, 1990 regular- ly scheduled meeting attended by the applicant, required revised site plans. In addition to requesting the submittal of another site of plan, the applicant was also informed of additional landscaping requirements applicable to the project due to its location within the Uptown Redevelopment Area. During this period the applicant had already been granted a temporary certificate of Occupancy to begin operating the vocational school. The owner of the property had re-surfaced the front and rear parking lots with asphalt paving without contacting the Planning and Building Services Department for any landscaping or permitting requirements. At that time, the project was g1ven clearance onto the Planning Commission for their final determination. ANALYSIS Permitted Use The proposed vocational trade school is permitted IL, Industrial Light, General Plan land use districts subject to approval of a conditional use within the designated permit. site Design and Parking The subject .67 acre site is of adequate size and dimension for the proposed vocational trade school. A front lot, consisting of approximately 7,064 square feet, will have a one-way traffic aisle and be striped to accommodate 4 parking stalls, including one required handicap space. A rear lot, accessed by a 24 foot wide, two-way drive aisle will be striped for 31 additional parking spaces. This number exceeds the minimum 22 student and 6 faculty spaces required for parking based on the school's projected enrollment and maximum allowable building occupancy level of 34. The existing, one-story 3,829 square foot commercial building is of adequate size and dimensions for the proposed voca- tional school use. No exterior modifications are required and few interior minor alterations will be necessary to convert the existing offices into school and work areas for the vocational instruction. Traffic Circulation One-way traffic flow for the front lot and two-way traffic flow within the larger rear lot will provide adequate inter- nal circulation on the subject site. Ingress and egress for the vocation school will be from "H" Street. Properties to the east and north are designated Residential-Medium and Residential Suburban, respectively. The 215 Freeway abuts the site's rear property line to the west. A freeway over pass at 16th and "H" Streets buffers the subject site from residential properties to the north. The freeway provides a barrier between the light Industrial areas and residences further to the west. The Residentially designated properties to the east are improved with both single and mUltiple-family dwellings. Setbacks and Landscaping The project site's location within the Uptown Redevelopment Area requires a minimum of 10 percent of interior landscapinq for commercial parking lot areas, and a landscaped, minimum 10 foot front setback area. However, since the applicant is a tenant leasing the existing building and site, it was determined by the Redevelopment Agency to reduce the RDA landscaping requirement to 5 percent along with the still mandatory 10 foot minimum landscaped front setback. The applicant's site plans incorporate the 10 foot wide landscaped front setback area. However, the shown rear parking lot landscaped area still needs to be extended an additional, approximately, 90 feet westward along the site's northern property line to meet the revised 5 percent land- scaped interior parking lot requirement. All landscaped areas will be maintained and sprinklered with automatic irrigation systems as approved by the Public Works/Engineering and Parks and Recreation Departments. COMMENTS RECEIVED No comments from any adjoining or surrounding commercial or residential property owners have been received at this office regarding the project proposal as of the written date of this staff report. The school is already operating under a temporary permit. The project is categorically exempt from CEQA. The proposed use conforms to the objective of the City's General Plan in that such usage is permitted within the IL, Industrial Light land use designations, subject to approval of a Conditional Use Permit. 2. SETBACK AREAS All required aetbacks abutting a public right-of-way shall be land- scaped (except for walks and drive~ays ~hich bisect or encroach opon the required landscape area).
