Staff requests that the Mayor and Common council adopt the
attached ordinance of the Municipal Code in order to regulate
the construction and operation of convenience stores within
the city of San Bernardino.
An Initial Study was prepared by Staff and presented to the
Environmental Review Committee (ERC) on November 8, 1990. The
ERC determined that no significant impacts would result from
the ordinance and recommended a Negative Declaration. The
proposed Negative Declaration was advertised and available
for public review and comment from November 13, 1990 to
December 3, 1990. No comments were received from the public
during the review period.

ANALYSIS
The proposed convenience store ordinance was drafted in
response to growing concern over the proliferation and
concentration of convenience stores in the city. The concern
stems from the level of criminal, illegal and illicit
activity that typically occurs within the vicinity of
convenience stores, which leads to increased calls for police
service and threats to the peace, safety and general welfare
to the surrounding communities.
By restricting the level of concentration, and by establish-
ing specific standards of conduct on the premises of
convenience stores, the proposed ordinance is expected to
address and mitigate the negative impacts associated with
such business establishments. Such restrictions and
standards include:

Prohibiting convenience stores from being located within
1,000 feet of another convenience store, elementary
school, junior high school, or high school;
Requiring that convenience stores
restrooms located within the stores;
provide
public
Prohibiting pay phones from accepting incoming calls;
and
from being installed or
Prohibiting arcade games
operated on the premises.

ordinance.
CONCLUSION
The proposed ordinance addresses the concerns associated with
the establishment and operation of convenience stores. If
adopted, the ordinance is expected - over time to reduce
the number of police calls for service in the vicinity of
convenience stores and promote the peace, health, safety and
general welfare of the city.
A further advantage of the ordinance is that it will elimin-
ate the need to process many Conditional Use Permits for
proposals that don't meet the criteria of the ordinance. For
example, at the present time, many Conditional Use Permit
applications for convenience stores are denied because of
over concentration or proximity to schools. Adoption of the
ordinance will save prospective applicants costly processing
fees as well as eliminate the need for Staff to process these
applications which are, often times, ultimately denied.

CEOA STATUS
An Initial Study (Attachment "B") was prepared by Staff and
presented to the Environmental Review committee (ERC) on November

The proposed Negative Declaration was advertised anq the Initial
Study was available for public review and comment from November
15, 1990 to December 5, 1990. During the Public Review Period, no
comments were received.

C. DISCUSSION OF ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES
6e. section 19.23.020(D) of the proposed ordinance states that
"no conven1ence store shall be located less than 1000 feet
from an existing or previously approved convenience store, or
an existing elementary, junior high school or high school, as
measured from property line to another." This implies that
certain properties in land use designations that permit
convenience stores may not be developed or otherwise altered
to allow the operation of convenience stores. However, the
land use designations that allow convenience stores also allow
a wide variety of commercial and office type uses to the
extent that restricting convenience stores from being located
in certain areas will not significantly impede the
opportunities for development on those affected properties.
ge. Convenience stores, by their nature, attract a diversity of
customers who arrive and depart within a typically short time
interval, often leading to on-site traffic congestion as well
as circulation conflicts at and nearby points of ingress and
egress. The adoption of this ordinance may both
positively and negatively impact circulation patterns. On
the positive side, restricting the concentration of
convenience stores may reduce the number of traffic hazard
areas, as well as prevent the cumulative impact of convenience
stores being located within close proximity to each other. On
the negative side, if market forces within a geographic area
generate a demand for additional convenience stores, the
traffic congestion in the vicinity of the existing convenience
stores may increase significantly. Because the number of
convenience stores within the City is already considered to be
quite high, it is not likely that such an increased demand
would materialize. In any event, the city always has the power
to repeal this ordinance and/or otherwise amend the Municipal
Code if unlikely or unforseen negative circumstances occur as
a result of the adoption of this ordinance.

NOTICE OF PREPARATION OF NEGATIVE DECLARATION
OF ENVIRONMENTAL IMPACT
THE CITY OF SAN BERNARDINO proposes to adopt a Negative
Declaration for the following projects. The Environmental
Review Committee found that the project will not have a
significant effect on the environment on the basis of the
Initial Study and mitigation measures (if applicable).
PUBLIC WORKS PROJECT NO. 90-30 To install a storm
drain, consisting of 672 feet of 24-inch pipe and 72
feet of ls-inch pipe, in an existing, unlined ditch.
Project site is on the grounds of pioneer Cemetery,
located at the northeast corner or Sierra way and
Seventh Street, in the PF, Public Facilities, General
Plan land use designation.

CONDITIONAL USE PERMIT NO. 90-64 To convert an
existing 19,000 square foot retail building into a Blood
Donor Center and expand an adjoining commercial building
to 23,100 square feet for auxiliary offices on a 3.15
acre site located on the north side of Orange Show Road,
approximately 440 feet west of Arrowhead Avenue. The
subject site is within the CG-1, Commercial General,
General Plan land use designation.

CONDITIONAL USE PERMIT NO. 90-51 - Subject property is an
irregularly-shaped parcel of land consisting of approximately
.67 acres located at the southwest corner of 16th Street and
"H" Street having a frontage of approximately 372 feet on the
south side of 16th Street and a frontage of 115 feet on the
west side of "H" Street and further described as 1598 North

the Hillside Management Overlay District, and to amend San
Bernardino Municipal Code 19.08.040 and 19.72.010 relative to

GENERAL PLAN AMENDMENT NO. 90-07 - Several parcels of land
consisting of up to 5.63 acres located on the west side of
"E" Street having a frontage of approximately 720 feet on "E"
Street extending approximately 635 feet north of Courtland
Drive and 125 feet south of Courtland Drive. The parcels
also have approximately 240 feet of frontage of the west side
of an extension of Acacia Avenue, approximately 255 feet
north of Courtland Drive. Also included are parcels having
approximately 200 feet of frontage of the east side of "F"
street, approximately 120 feet north of Courtland Drive. The
proposal is to change the land use designation from CG-1,
commercial General to RS, Residential Suburban and RU-1,
Residential Urban and from RH, Residential High to RS,
Residential Suburban and RU-1, Residential Urban.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO DO ORDAIN AS FOLLOWS:
SECTION 1. Chapter 19.23 of the San Bernardino
Municipal Code is added as follows:
"Chapter 19.23
CONVENIENCE STORE REGULATION
19.23.010 Applicability and Review
The regulations set forth in this Chapter shall
apply to convenience
which
defined as
stores

establishments which provide for the retail sales of
groceries, staples, sundry items and/or alcoholic beverages
within structures of less than five thousand (5,000) square
feet of gross floor area.
The establishment of new
convenience stores shall be allowed in the CN, CG-1, CG-2,
CG-3, CG-4 and CR-2 Land Use Designations and approval.
19.23.020 Regulations
Convenience stores shall be constructed and operated
in the following manner:
A. The minimum site area shall be ten thousand (10,000)

The site shall have direct frontage along a major or
secondary street.
The site shall not have direct
access on a local residential street.

One access drive may be permitted for each street
frontage.
The design and location of the access
drive(s) shall be subject to the approval of the
Development Review Committee. Additional access drives
may be approved subject to the recommendation of the
City Engineer.

No convenience store shall be located less than one
thousand (1,000) feet from an existing or previously
approved convenience store, or an existing elementary,
junior high school, or high school, as measured from
the nearest distance from one property line to another.
E.
All on site lighting shall be energy
efficient,
stationary and directed away from adjoining properties
and public rights-of-way.
F.
All on-site signage shall comply with the provisions of

Chapter 19.60 of this Code.
All on-site parking and landscaping shall comply with
the provisions of Chapter 19.56 of this Code. A
parking plan shall be developed as part of the permit
review process.
All installed landscaping shall be
permanently maintained.

The premises shall be kept in a neat and orderly
condition at all times.

OPERATION OF CONVENIENCE STORES
THE
I.
Every parcel with a structure shall have a trash
receptacle on the premises. The trash receptacle shall
comply with adopted Public Works Department standards
and be of sufficient size to accommodate the trash
generated. The receptacles(s) shall be screened from
public view on at least three (3) sides by a solid wall
six (6) feet in height and on the fourth side by a
solid gate not less than five (5) feet in height. The
gate shall be maintained in working order and shall
remain closed except when in use. The wall and gate
shall
be
architecturally
compatible

The cashier location shall provide direct visual access
to the pump islands and the vehicles parked adjacent to
the islands.
K.
A bicycle rack design to accommodate a minimum of six
(6) bicycles
shall be installed in a convenient
location visible from the inside of the store.
L.
Each convenience store shall provide two (2) public
restrooms located within the store; one (1) for men and
one (1) for women.
M.
Public pay telephones provided on-site shall not be set
up for incoming calls.
Public telephones shall be
featured with callout service only.
