Recommended motion:

1. That the public hearing to receive, consider and rule upon written protests
in the matter of annexation of the territory generally located East of
Waterman Avenue, South of Central Avenue, designated LAFCO 2644, is hereby
closed.

STAFF REPORT
This office received a notice of filing for annexation from the Local Agency
Formation Commission, after a petition of registered voters was submitted to the
commission.
On December 12, 1990, authorization to proceed with the annexation was granted,
and Resolution No. 90-486 was adopted, determining the amount of property tax
transfer from the County to City, if the annexation is approved.
On January 21, 1991, Resolution No. 91-34 was adopted, setting a public hearing
for February 18, 1991, relative to the proposed annexation. That resolution was
published in the Sun on February 3, 1991, and all affected agencies were mailed
notice of the hearing.
As of this date, no written protests have been received. It is therefore
recommended that the hearing be closed and that the attached resolution,
approving the annexation, be adopted.
URGENCY CLAUSE: This hearing was set by Resoltion No. 91-34 and must be heard on
February 18, 1991.

RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THAT LESS
THAN TWENTY FIVE PERCENT OF PROTESTS BY REGISTERED VOTERS AND LESS THAN
TWENTY-FIVE PERCENT OF PROTESTS BY PROPERTY OWNERS HAVE BEEN FILED AND
ORDERING ANNEXATION NO. 351 (LAFCO 2644) FOR THE TERRITORY GENERALLY
LOCATED EAST OF WATERMAN AVENUE, SOUTII OF CENTRAL AVENUE, AND DETACHMENT
FROM CSA 38, CSA 38-G, CSA 70, CSA 70-A AND CSA SL-l.
WHEREAS, pursuant to the provisions of the Cortese-Knox Local
7 Government Reorganization Act of 1985, Division 3, commencing with section
8 56000 of the California Government Code, proceedings were initiated by the
9 Common Council of the City of San Bernardino, to annex to the City of San
10 Bernardino, certain contiguous inhabited territory hereinafter described;
11 and
12 WHEREAS, a petition for annexation to the City of San Bernardino
13 was filed by registered voters with the Executive Officer of the Local
14
Agency Formation Commission of San Bernardino County, to receive extended
15 urban services; and
16 WHEREAS, the Local Agency Formation Commission has set forth the
17 following terms and conditions in its Resolution No. 2307, adopted December
18 19, 1990 :

"Condition No.1. The conducting authority for this
20 proceeding shall be the City Council of the City of San Bernardino.

"Condition No.2. The boundaries are approved as set forth
22 in Exhibit "A" attached.

"Condition No.3. The following distinctive short form
designation shall be used throughout this proceeding: LAFC 2644.
"Condition No.4.
The date of issuance of the Certificate
of Completion shall be the effective date of this annexation.
WHEREAS, a public hearing was set for the 18th day of February,
1991, at the hour of 10:00 am in the Council Chambers of City Hall, 300 N.

"D" Street, San Bernardino, California, and the same was the day, hour and
2 place designated where any and all persons registered to vote within the
territory proposed for annexation or persons owning land within the
territory proposed for annexation may file a written protest with the City
Clerk, prior to the conclusion of said hearing; and
WHEREAS, all registered voters and owners of land within the
territory proposed for annexation, and all affected agencies were notified
of said hearing by mailing, publication and posting of a "Notice of Public
Hearing" pursuant to the provisions of California Government Code Section
57025.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That pursuant to Section 57050 of the California
Government Code, a hearing was held on the day, and at the time and place as
set forth hereinabove, and protests were filed and received by less than
twenty-five percent (25%) of the registered voters residing in the territory
proposed for annexation and protests were filed and received by less than
twenty-five percent (25%) of the property owners owning less then twenty-
five percent (25%) of the total assessed value of the area proposed for
annexation, by the conclusion of said hearing.
SECTION 2. Said territory herein described as Annexation No. 351,
designated as LAFCO 2644, is hereby annexed and incorporated in and made a
part of the City of San Bernardino.
SECTION 3. The territory herein referred to as being annexed to
the City of San Bernardino is more particularly described in the Exhibit
"A", attached hereto and incorporated by reference as though fully set forth
in length.
SECTION 4 .
The above described territory will be subject to
taxation equally with the property within such municipal corporation.

TO
CITY OF SAN BERNARDINO
That certain island of unincorporated land lying East of
Waterman 'Avenue, South of Central Avenue, West of Tippecanoe
Avenue and North of Interstate 10, being more particularly
described as follows:
Beginning at the center line intersection of Waterman Avenue
limits line of San Bernardino;
and Pioneer street, said point being also on the existing city
Thence North along said city limits line and continuing
along said line, following all of its various courses to the
