STAFF REPORT
Subject:
Request for continuance for Tentative Tract No. 14112-located northeasterly of the intersection
of Foothill Drive and Sterling Avenue.
Background:
On November 7, 1990, the Planning Commission approved the Tentative Tract No. 14112, a 55-
lot, single family, residential subdivision.
On May 18, 1994, the Planning Commission authorized an extension of the time limit for
approval of the tentative tract map. An automatic two-year extension was granted according to
the provisions of Section 66452.11 of the Subdivision Map Act, which extended the approval date
to May 18, 1996. An additional extension was granted according to the provisions of Section
66452.13 of the Subdivision Map Act, extending the approval date to May 18, 1998. The
Planning Commission approved the final extension, extending the tentative map to May 18, 1999.
The Developer/owner requested that staff schedule Tentative Tract 14112 for final map approval
by the Mayor and Common Council for the meeting of May 17. 1999. Because the final map and
subdivision securities had not been submitted as of the date of the meeting, the Mayor and
Common Council approved a motion to continue the Resolution approving the final map to
August 16, 1999.

The following documents are required for approval of the final map:
1. Bonds - Faithful Performance Bond - $2,293,000.00, Labor Material - $1,146,500.00,
Guarantee and Warranty Bond - $573,250.00, Monumentation Bond - $17,000.00, Grading
Bond - $1,073,500.00;
2. Fees - Street Light Electrical Energy Fee - $14,656.80, Street Improvement Plan Checking Fee
- $61,152.00, Final Map - $2,650.00, Grading Plan Checking Fee - $1,295.50, Traffic Signal
Modification Fee - $20,000;
3. Three executed originals of the Subdivision Agreement;
4. Three mylar originals of the Final Map executed by the subdivider/owner and other required
signatories, the Engineer, and the County, together with the final Subdivision Guarantee;
5. Off-site improvement plans, including landscape and irrigation plans for the landscape
maintenance district all approved by the City Engineer.
The original bond amounts and fees were estimated in 1999 without benefit of approved
infrastructure improvement plans. The bonding and fee amounts have been increased by 26%
from the amounts calculated in 1999 based on the increase in the Engineering News Record cost
of construction index. Subsequent to the approval of the infrastructure improvement plans, a new
"Recording Requirements" letter will be sent to Sterling Heights, LLC indicating the actual
bonding and fee amounts. These actual amounts may vary significantly from the amounts
estimated above.
This map has been before the Council for the last seven years and the previous developer/owner
made no attempt to provide qny of the items required for Council approval and recordation of the
map.
The current developer, represented by Associated Engineers, has prepared design plans and is
diligently pursuing the processing of the project. However, problems processing the design of the
bridge over Daley Canyon Channel through the San Bernardino County Flood Control District
and the design of the south half of Foothill Drive through the County Transportation Department
has delayed completion of the project.
Associated Engineers has provided a schedule indicating that the map can be recorded within the
next 6 months. Based on the progress so far, staff concurs with the project Engineer's schedule
and recommends that a six (6) month continuance be granted.
If this request for continuance is not approved, Tentative Tract No. 14112 will expire and a new
tentative tract map application will be required.

Financial Impact:
The continuance fee has been paid as evidenced by Miscellaneous Cash Receipt No. 740749
issued by the City Clerk on April 18, 2007.
Recommendation:
That the Mayor and Common Council approve the request for continuance of the Final Map for
Tentative Tract No. 14112 to November 19, 2007.

As discussed in the last City Council meeting, we anticipate recording the Final Map for Sterling
Heights in early May 2007. The plans are currently at the City for second plan check. All fees
are paid and we anticipate recording the Map in the next few weeks.
We made the decision to request an extension of time on the Map in case some currently
unforeseen issue occurs which will keep us from recording prior to the expiration date on our
previous extension of time.
Please accept this letter, together with the receipt for the $75.00 extension fee, as our formal
request for an extension of time for Tract 14112.

Dear Ms. Ross,
Associated Engineers has been working diligently with Sterling Heights LLC, and the City of San
Bernardino staff on the final plans for Tract 14112. These plans will be complete and submitted on
Monday, October 16, 2006, and all plan check fees will be paid at that time.
Due to circumstances beyond our control, we will not be able to complete all the requirements for the map
recording within the 6 months time frame approved by the Mayor and Common Council on May 15, 2006.
Please accept this request to extend the Sterling Heights Project to May 21, 2007 to allow for the
formation of landscape maintenance district and plan check review.
