Recommended motion:

That the appeal of Niel Nathason relative to the assessment made by the
Board of Building Commissioners with regard to the abatement of weeds
and debris from property located at Belleview and Mt. Vernon Streets be
denied and the decision by the Board of Building Commissioners be upheld.

STAFF REPORT
On July 21, 1989, a "Notice to Clean Premises" was mailed to Niel Nathason,
215 S. Guadalupe Avenue, Redondo Beach, CA 90277, regarding property Parcel No:
0137 061 08, located at Belleview and Mt. Vernon Streets. A copy of the notice is
attached as Exhibit "A".
The above parcel required hand work and hauling and this was done by H & H
Enterprises on August 11, 14, and 15, 1989, (the hand work consisted of cleaning
and hauling of debris at a cost of $1,141.00. The administration fee of $75.00 was
added to this charge for a total amount due of $1,216.00).
On Septe!ltler 19, 1989, along with his bill, Mr. Nathason was sent a notice of
hearing before the Board of Building Comnissioners, scheduled for Nove!ltler 3, 1989,
regarding the assessment costs for the abatement of his parcel.
The hearing on the assessment on Mr. Nathason' s property was held on Nove!ltler
3, 1989. Evidence was presented to the Board of Building Comnissioners regarding
Mr. Nathason I s abatement and assessment costs, he was present at this hearing.
Based on the evidence presented, the Board unanimously adopted the sum of $1,216.00
to be assessed against Mr.. Nathason and ordered that a lien be placed on their
property, if the assessment was not paid. A copy of the Board of Building
Comnissioners order is attached as Exhibit "B".

ORDER OF THE BOARD OF BUILDING COMMISSIONERS OF THE
BERNARDINO ASSESSING COSTS OF ABATEMENT OF PUBLIC NUISANCE.

3 WHEREAS, pursuant to the San Bernardino Municipal Code, Title 8, Chapter
4 8.27, the Director of Public Services of the City of San Bernardino has given
5 notice of and thereafter abated a public nuisance found to exist on the
6 properties described in Exhibit "A" attached to and hereby incorporated in
7 this order: and
8 WHEREAS, pursuant to San Bernardino Municipal Code, the Director of
9 Public Services served notice to all property owners listed in Exhibit "A",
10 of the hearing before the Board of Building COIIIllissioners of the City of San
11 Bernardino relating to abatement costs to be assessed the owners and their
12 right to appear at said hearing and protest the assessments; and
13 WHEREAS, every property owner against whom an assessment has been
14 proposed has been afforded an opportunity to be heard by the Board of
15 Building COIIIllissioners heretofore;
16 NOO, THEREFORE, THE BOARD OF BUILDING COMMISSIONERS OF THE CITY OF SAN
17 BERNARDINO ORDERS THE FOLLCMING:
18 1. Based upon the evidence submitted by the Director of Public Servies
19 or his representative, it is found and determined that the properties
20 described in Exhibit "A", constituted a public nuisance- which had to be
21 abated by the City at the costs stated in Exhibit "A".
22 2. These costs should be assessed in the amounts set forth in Exhibit
23 "A" against the respective properties and may be made a personal obligation
24 of the property owner by commencement of court proceedings against the owner.
25 3. Any person aggrieved by this order may appeal to the COIIIllOn Council
26 by filing with the City Clerk a written statement of the order appealed from,
27 the specific ground of appeal and the relief or action sought from the Common
28 Council pursuant to the San Bernardino Municipal Code.
