STAFF REPORT
Resolution No. 10584 establishes "uniform and orderly methods
of communications between the city and its employees for the
purpose of promoting improved employer-employee relations."
section 6 (F) of that resolution states:
"The formally recognized employee organization may be
represented at scheduled meet and confer sessions with
City representatives by not more than five (5) City
employees and three (3) non-employee members of the
formally recognized employee organization, with an equal
number for management. The recorder shall not be
considered a representative hereunder."
section 6(H) provides that "city employees authorized to
attend such meetings during work hours shall suffer no loss
in compensation."

The city Attorney's office interprets section 6 to permit up
to 5 employees to meet with City management on City time on
any matter within the scope of representation including a
proposed work rule impacting just 1 position in the bargain-
ing unit. Staff feels that it is inappropriate that this
occur and recommends that a maximum of three City employees
attend meet and confer sessions on matters other than a new
MOU on City time. If the City elects to have more than three
representatives at the table for any such meet and confer
session, the same number of City employees in the appropriate
bargaining unit shall be authorized to attend such meetings,
without loss of pay. The attached resolution incorporates
those proposed changes.
The attached memorandum was sent to the four bargaining units
on November 16 advising them of this agenda item.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
4 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Resolution No. 10584 section 6 Subsection (F
is hereby amended to read as follows:
"The formally recognized employee organization may be
represented at scheduled meet and confer sessions with City
representatives on a new Memorandum of Understanding by not
more than five City employees and three non-employee members
of the formally recognized employee organization, with an
equal number for management.
The recorder shall not be
considered a representative hereunder. For meet and confer
sessions on matters other than a new MOU, not more than three

City employee members of the formally recognized employee
organization may attend. If the City elects to have more than
three representatives at the table for any such meet and
