Appeal of Planning commission Denial of Conditional
Use Permit No. 89-20
Mayor and Council Meeting of December 18, 1989
REOUEST
The applicant, APC Holding Company, requests that the Mayor
and Council reconsider the Planning Commission denial of
Conditional Use Permit No. 89-20 and approve the project.
BACKGROUND
conditional Use Permit No. 89-20 is an application to con-
struct a 2,696 square foot AM/PM mini-market with the sale of
beer and wine at the northeast corner of Date Street and Del
Rosa Avenue.
On August 3, 1989, the Environmental Review Committee recom-
mended approval of a Mitigated Negative Declaration for the
project.

For an analysis of the proposed project, please review the
November 7, 1989 Planning commission staff report, Exhibit E.
At the October 3, 1989 Planning commission meeting, the
Commission was very concerned about the number of similar
outlets in the area and thought that there was an overconcen-
tration of such facilities. The Commission voted to request
that a market feasibility study be prepared to prove the need
for and viability of such a facility. The matter was con-
tinued to the November 7, 1989 Planning commission meeting to
allow time for the study to be prepared. At that meeting the
applicant did not present the feasibility study, but had a
representative of ARCO there to answer questions. After much
debate and testimony, the Planning commission voted 4 to 3 to
deny Conditional Use Permit No. 89-20 based on an overprolif-
eration of gas stations, a high concentration of off-sale
Alcoholic Beverage Control licenses in the area, and the
traffic problems that could be created at Date Street and Del
Rosa Avenue. (See letter from Roy Nierman, Exhibit C.)
It is the applicant's contention that the project is in
compliance with the City's General Plan, that the conditions
imposed mitigate the impacts associated with the project, and
that the Planning Commission erred in requiring a marketing
study as a condition of approval. (See Exhibit A.)

The Planning Commission did not require the marketing study
as a condition of approval. The Commission desired addi-
tional information prior to making their decision for
approval or denial. The basis of need is a valid concern of
the Planning Commission. The applicant decided not to
provide such a study, as requested.

OPTIONS OF THE MAYOR AND COUNCIL
The Mayor and Council may uphold the appeal and approve
Conditional Use Permit No. 89-20, subject to Findings of
Fact, Conditions of Approval and Standard Requirements
contained in the November 7 and October 3, 1989 Planning
Commission staff reports (Exhibit D); and, adopt the Miti-
gated Negative Declaration and Mitigation Monitoring/Report-
ing Program. (Supports appellant's request.)

Conditional Use Permit No. 89-20 based upon Findings of Fact
contained in the November 7, 1989 Statement of Official
Planning commission Action (Exhibit B). (Supports Planning

RECOMMENDATION
Staff's original recommendation was for approval, but because
of the testimony provided at the Planning Commission meeting
regarding the overproliferation. .of gas stations, high concen-
tration of off-sale ABC licenses in the area, and the appli-
cant's refusal to provide the marketing study information, as
requested by the Planning Commission, staff is recommending
denial of Conditional Use Permit No. 89-20.

FINDINGS OF FACT
1.
The project proposed in Conditional Use Permit No. 89-20
is consistent with the General Plan adopted by the Mayor
and Council on June 2, 1989, in that the General Plan
designates the site for CN, Neighborhood Commercial,
uses which include convenience stores with secondary
uses of gasoline and alcohol sales with approval of a
Conditional Use Permit.
2. The proposed use will adversely affect the adjoining
land uses and the growth and development of the area in
which it is to be located in that there is an overpro-
liferation of gas stations and convenience stores and
high concentration of off-sale Alcoholic Beverage
Control licenses.
3. The size and shape of the site proposed for the use is
adequate to allow the full development of the proposed
use in a manner not detrimental to the particular area
nor to the peace, health, safety and general welfare, in
that the required number of parking spaces and adequate
ingress/egress and interior circulation are provided.
4. The traffic generated by the proposed use will impose an
undue burden upon the streets and highways designed and
improved to carry the traffic in the area, even though
the applicant indicates he will contribute $100,000
toward a traffic signal to be installed at the intersec-
tion of Date Street and Del Rosa Avenue.

Dear Mayor Holcomb:
I wish to bring to your attention two items heard by the
Planning commission on November 7, 1989 that I am sure will
be appealed..
The first item is Conditional Use Permit #89-20 which isa
request to construct an A.M. P.M. Mini Market on the corner
of Date Street and Del Rosa Avenue.

This matter first came before the Planning Commission in
October 1989 and was continued to November 1989 so that the
applicant could provide the Planning Commission with a
marketing study concerning the effect this A.M. P.M. Mini
Market would have on the existing gas stations, mini markets
and liquor stores.
The applicant failed to provide a marketing study and the
representative of ARCO Products refused to allow the Planning
Commission to have a copy of their marketing study.
There were at least seven business owners in the audience who
objected to an additional mini market, liquor store or gas
station in the area.
There are presently five gas stations on the corners of Del
Rosa and Date Street or Date Place. There are nine stores
selling off site alcohol within a six block area.
There are seven existing mini markets within a six block area
of the proposed development.
In that area we have already had one Circle K store close and
a Safeway Market close.
Recently, one of the liquor stores was forced to sell or face
bankruptcy.

It was felt by a majority of the Planning Commission (four to
three vote) that the addition of another gas station, mini
market and alcohol sales to the area would be detrimental to
the neighborhood and would result in an over supply of
competition to the area which is going to result in one or
more stores closing and creating additional blight in the
area.
We have two people who have purchased either an existing
liquor store or an existing gas station in the past four
months and those operations are presently marginal.
The installation of another twenty-four hour store in this
area is also going to substantially increase the traffic off
of the interstate freeway.
For those reasons the Planning Commission felt we should not
have another mini market, gas station or alcohol sales in
that area.

The Planning staff recommended approval of this project and
the Commissioners voted four to three to deny the proposed
project.
A second item which was heard on November 7, 1989 which I
believe will be appealed is Conditional Use Permit '86-26 on
tentative track '13365.
The applicant, Darwin K. Pearson, was requesting a one year
extension of time for tentative track '13365 and Conditional
Use Permit '86-26 to construct a forty-two unit condominium
project on the corner of Del Rosa Avenue and Marshall
Boulevard.
The Planning commission unanimously denied the extension of
time based on the following reasons.
1. After almost two years of attempting to have the
applicant remove a burned out deserted house, the City had to
remove the house at a cost of almost $17,000.00 to the city.
2. The project is proposed as a condominium with individual
ownership.
Condominiums have notoriously not sold well in the San
Bernardino area and the size and location of these
condominiums would make them less than acceptable as owner

occupied condominiums.
It was the feelinq of the Planninq Commission that these
condominiums would be sold to absentee landlords who would
then rent them out to tenants and in the end we would have a
project similar to that on Sterlinq and Hiqhland.
It was the feelinq of the Planninq Commission that we would
rather see the construction of an apartment complex that is
individually owned so there could be uniform control over all
tenants rather than havinq forty-two condominiums owned by
forty-two absent landlords.
It was the feelinq of the Planninq Commission that to install
a condominium project in that area would be completely
incompatible with the neiqhborhood and would result in
absentee landlord ownership of some forty-two separate units.
I very seldom write concerninq any items decided by the
Planninq Commission but I feel most strongly that the
Planninq Commission took the riqht action in both of these
matters and I am equally certain that both of these items
will be appealed to the Kayor and Common Council.

CONCLUSION
The item was continued to enable the applicant to perform a
feasibility analysis to substantiate the need for the
proposed mini market. That study has not been received by
the city. Information received indicates the applicant will
request final action of the Planning commission be taken
tonight. There is a proposed Negative Declaration.
RECOMMENDATION
In the original staff repor~ staff recommended the Planning
commission approve Conditional Use Permit 89-20.
Staff continues to recommend the planning commission approve
the project subject to the Findings of Fact, cmditions and
Standard Requirements contained in the staff report dated
October 3, 1989 (Attachment "B"), plus; impose the
additional Condition as requested by the City Engineer; and,
.adopt the Negative Declaration and the Mitigation
Monitoring/Reporting Program.

This Department is establishing a new standard requirement that
all new developments with a high motor vehicle turn-over rate
construct their parking lot of PCC Concrete. This new
requirement is necessary becaus. dripping oil and gasoline from
short stops and restarts causes rapid deterioration. of as.phalt
concrete parking lots.
We request that you add this new requirement for PCC Concrete to
be used in all on-site parking and driving areas of the subject
project. In the future. we will evaluate each new project
individually to determine if this Standard Condition should
apply.

1. REOUEST
Applicant requests approval under San Bernardino Municipal
Code (SBMC) section 19.83.500 to construct a 2,696 square
foot convenience store with two gasoline pump islands and
sales of beer and wine for off-site consumption.

2. SITE LOCATION
The subject property is a 0.7 acre site located on the
northeast corner of Date Street and Del Rosa Avenue (Attach-
ment IlJIl). The property is bounded to the east by an
existing flood control channel and to the north by vacant San
Bernardino County Flood Control property. Across Date Street
and Del Rosa Avenue to the south and west are existing
commercial properties. The nearest residential uses are
located to the northeast of the site on the far side of the
flood control channel.
3. MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
Conditional Use permit 89-20 is consistent with the San
Bernardino Municipal Code and General Plan as shown on
Attachment "A".
4. CALIFORNIA ENVIRONMENTAL OUALITY ACT STATUS
An Initial Study was prepared by staff which addressed
several concerns (Attachment "E"). It was presented to the
Environmental Review Committee (ERC) on August 3, 1989. The
ERC is recommending a Mitigated Negative Declaration. A
Mitigation Reporting/Monitoring Plan has been prepared by the
applicant and reviewed by staff (Attachment "F"). The
Initial Study was available for public review from September
7 to 20, 1989. No comments wer~ received.
5. BACKGROUND
The application of Conditional Use Permit 89-20 was submitted
on June 6, 1989. Following a site inspection and
preliminary application and project review, the
application was deemed incomplete on June 15, 1989, and
the applicant requested to provide some additional

information and materials. The application was deemed
complete on August 21, 1989, following receipt of the
needed information/material, and environmental review
proceeded. The project was reviewed by the Development
Review COlDlllittee (DRC) on August 31, 1989. The -DRC has
recolDlllended approval of the project subject to revision
of the site plan and the attached Conditions of Approval
and standard Requirements (Attachments "C" and "D"). The
site plan floor plans elevations in Attachment "I" and the
project as discussed in this staff report "incorporated the
revisions requested by the DRC.
6. ANALYSIS
e
Business Operations
The proposed convenience store is to operate 24 hours a day,
seven days a week with not less than two employees on site
at all times. The request is for approval to sell beer and
wine. In addition, the store will sell gasoline from two
pump islands of 4 pumps each, grocery items and pre-packaged
food items for off-site consumption.

vacant flood control property. Due to the physical barriers
which exist, there does not appear to be a conflict.
There are 13 existing off-site liquor licenses in the Census
Tract, including R & S Liquor store on the east side of Del
Rosa 1/10 of a mile away, a stop and Go on the west side of
Del Rosa 2/10 of a mile away and Victoria Guernsey Dairy on
the east side of Del Rosa 2/10 of a mile away.

The project design includes extensive landscaped setbacks
along both street frontages and along the flood control
-channel. All exterior equipment has been enclosed within the
building and a low-profile monument sign will be used to be

The Police Department states that the Reporting District, in
which the project is located, has crime stats 128 percent
above average for the city. 26.25 percent of Part II arrests
are alcohol related with 50 percent of Part II arrests during
the past 90 days being alcohol related. The Police Depart-
ment made recommendations to alleviate expected police
problems. These recommendations have been incorporated into
the Conditions of Approval for this Conditional Use Permit
(see Attachment "G").
Traffic and Circulation
The city Traffic Engineer has indicated that the intersection
of Date street and Del Rosa Avenue has excessive delays and
accidents. The intersection, therefore, needs a traffic
signal. The project has been conditioned that the applicant
make a monetary contribution towards the installation of the
traffic signal.
There are two points of ingress and egress to the site, one
from Date street and one from Del Rosa Avenue. The proposed
use requires 11 parking spaces and 1 loading zone, which have
been provided. -

8. CONCLUSION
.
The size and shape of the parcel are adequate to accommodate
the proposed use as a convenience store with sales of gaso-
line and alcohol (beer and wine) for off-site consumption.
The proposal meets the current San Bernardino Municipal Code
development requirements. The oevelopaent Review Committee
determined that the potential circulation problems would be
adequately mitigated if a traffic signal was installed at Del
Rosa Avenue and Date Street. However, there was still some
concern about the ability or inability to turn left on Del
Rosa Avenue from the convenience store. A median to prevent
left hand turns was not considered appropriate. Therefore,
location and design of the project, as conditioned, should
not be a detriment to the surrounding area.
9. RECOMMENDATION
It is recommended that the Planning commission:

FINDINGS OF FACT
1. The project propqsed in conditional Use Permit 89-20 is
consistent with the General Plan adopted by the Mayor
and council on June 2, 1989, in that the General Plan
designates the site for CN, Neighborhood Commercial,
uses which includes convenience stores with secondary
uses of gasoline and alcohol sales with approval of a
conditional Use Permit.
2.
The proposed use will not adversely affect the
adjoining land uses and the growth and development of
the area in which it is to be located in that the
project meets all San Bernardino Municipal Code
development requirements for the CN, Neighborhood
commerical, land use district, including extensive (10
to 14 foot) landscape setbacks along both street fronts
and use of a monument sign.
3. The size and shape of the site proposed for the use is
adequate to allow the full development of the proposed
use in a manner not detrimental to the particular area
nor to the peace, health, safety and general welfare in
~~?t the required number of parking spaces and adequate
ingress/egress and in~erior circulation is provided

4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and highways
designed and improved to carry the traffic in the area,
in that the applicant.., shall contribute $100,000
toward a traffic signal to be installed at the
intersection of Date Street and Del Rosa Avenue.
5. The granting of the Conditional Use Permit under the
conditions imposed will not be detrimental to the
peace, health and safety"and general welfare of the
citizens of the city of San Bernardino based on the

should provide for reasonable access to the channel for
maintenance activities, i.e., not prevent maintenance
equipment from occupying space along the channel in
which to operate when working on Flood Control facili-

Conditional Use Permit 89-20 shall be in effect for a
period of 12 months from the date of approval. However, if no
development has been initiated at the end of the 12 month
period, the application shall expire. Additional time' may be
approved upon request of the applicant prior to expiration of
the l2-month period. Expiration Date: October 3, 1990.

11 standard off-street parking spaces.
b. All parking and driving aisles shall be surfaced with two
inches of AC over a suitable base or equivalent as approved
by the city Engineer. Parking spaces shall be striped and
have wheel stops installed at least three feet from any
building, wall, fence, 'property line, or walkway.
Whenever an off-street parking area is adjacent to or
across an alley from property zoned residential, a solid
decorative wall six feet in height shall be erected and
maintained along the property line so as to separate the
parking area physically from the residentially zoned
property provided such wall shall be three feet in height

such wall shall be three feet in height when located within

The project site is an irreqularly-shaped parcel and is

cashier booth in order that customer's activities can be
monitored.

On or about 9/6/89, I received the investigation for CUP #89-20, in
the name of Phillip Graham Combs, Architects, Inc., for a proposed
business site, located on the northeast corner of Date Street and Del
Rosa Avenue. The nature of this project will be an Arco AM/PM Mini
Market, a 24 hour, 2,696 square foot convenience store, selling gasoline,
groceries, snack items and beverages. They will also include the off-
site sales of beer and wine. There will be two employees per shift
and a total of 10 employees. The applicant requests a Conditional Use
Permit to sell beer and wine in a 2,696 square foot convenience store.
This project is not currently under construction. The proposed site
is located within Reporting District 1050, which has crime stats 128%
above the average for Reporting Districts in San Bernardino. 26.25%
of the Part II arrests in this Reporting District were alcohol related.
During the past 90 days, 50% of all Part II arrests were alcohol related.
The proposed site is located within Census Tract 62. The census count
for this tract as of 1/1/86, was 5,573. The boundaries for this Census
Tract are Highland Avenue on the south, Marshall Blvd., on the north,
Sterling Avenue on the east and Valencia Avenue on the west. There
are 29 existing off-sale license locations within this Census Tract
and only eight are allowed. There are no pending applications.

COMMENTS FROM AREA RESIDENTS.
During the course of this investigation, I contacted several residents
who live in the immediate vicinity of the proposed site.
I talked with Terry Rudh, who resides at 6015 Elmwood Street. Mr. Rudh
told me he had no objections to this. project.
I spoke with Bill Johnson, who resides at 6020 Elmwood Street and he
also told me he had no objections to the project.
I contacted Benny Gonzales, who lives at 25363 Holly Vista. He said
he was opposed to this project, and believes that an AM/PM Market would
create problems of panhandling and people hanging around, like the Stop
N Go, which is located further south on Del Rosa Avenue.

Vista with no response at any of those locations.
The proposed site will be located 4/10 of a mile from Jefferson Hunt
School. located at 1342 E. Pumalo. The site will be located 4/10 of
a mile. from Del Vallejo School. located at 1885 E. Marshall and 3/10
of a mile from Aquinas High School. The proposed site will be located
1/2 mile from Immanuel Baptist Church. which is located on pumalo.
The site will be located 1 mile from Aquinas Triangle Park. which is
located at Sterling and Citrus.
The nearest on-sale license locations will be the Boston House of Pizza.
located at 2990 N. Del Rosa Avenue, Suite #F. The Boston House of Pizza
will be located 1/10 of a mile from the proposed site. Mario's Italian
Deli. which is located at 2868 Del Rosa Avenue. will be located directly
across the street from the proposed site. Wackley's Restaurant, which
is located at 2601 Del Rosa Avenue. Suite #100. will be located 3/10
of a mile from the proposed site. There are three off-sale license
locations in close proximity to the proposed site. The R&S Liquor Store
is located at 2950 Del Rosa Avenue. it will be located 1/10 of a mile
from the proposed site. A Stop N Go Market, located at 2734 Del Rosa,
will be located 2/10 of a mile from the proposed site. Victoria Guernsey
drive-in dairy is located at 2729 Del Rosa, it will be located 2/10
of a mile from the proposed site. The proposed site will be located
approximately 1/10 of a mile from the Rainbow Garden Apts., .located
at 1700 E. Date Street.
The nearest residence located at 6020 Elmwood Road will be approximately
93' from the proposed site.
POLICE DEPARTMENT RECOMMENDATIONS:
If this Conditional Use Permit is approved, it could reasonably be
expected crime and police calls for service will be increased in that
Reporting District. An increase in activites, such as juveniles buying
or attempting to buy alcoholic beverages. panhandling. littering.
loitering. drinking in public. public intoxication and drinking and
driving could very possibly be expected. It should be noted that ABC
Rules' 61.3 (undue concentration and crime) and Rule 61.4 (proximity
to residences) could also apply and an ABC License may be denied by
ABC. per those rules. If this Conditional Use Permit is approved, the
following conditions ~ould be reco~ended by the police department and
if implemented would .certainly alleViate or lessen the aforementioned
expected police problems.
1. No single cans and/or bottles of beer to be sold.
2. No sales of wine in less than 750ml containers.
3. No game machines, video or otherwise.
4. No sales of ice in less than 7 Ib bags at or above prevailing
prices.

commercial site is located between Del Rosa Avenue and Del Rosa

City of San Bernardino.
This site has previously been reviewed by this office and a copy
of our last letter to the City of San Bernardino, dated August 9,
1984, is included for your reference. Our comments and recommendations
remain the same. Comment #1 has been satisfied.

I am writing you in support of Conditional Use Pennit 89-20 and the
proposed ARCO AM/PM mini- mart to be located on the North-East corner
of Date and Del Rosa.
As the manager of the 251 unit Rainbow Garden Apartments, located next
to the proposed project, it is my belief that the proposed developoont
will be of benefit to our tenants and their families. Many of our ten-
ants are working families who desire canpetitively priced products and
convenient locations at which to shop. ARCO gasoline is generally pri-
ced much lower than other major oil carpany's in our neighl:x::>rhood. The
convenience of a nearby, 24 hour a day operation, plus significant price
savings to the consumer, will benefit the surrounding neighl:x::>rhoods, as
well as our tenants.
It is also our understanding that the project will provide the monies
necessary to install traffic lights at the intersection of Date Street
and Del Rosa Avenue. As well, we understand the project will be re-
quired to make improvements to the flood channel. Both of these im-
provements are needed and will be a plus for our area.

Please accept this letter in support of the proposed AM/PM
mini-mart:et to be located at Date Street and Del Rosa Ruenue.
I don't belieue that such a business will be a detriment to our
neighborhood. To the contrary, I belieue that an RRCO facility will not
only prouide competiuely priced gasoline, but a safe and conuenient
place for our senior citizens and others to shop os well.
