Synopsis of Previous Council action:
November 19, 1986 - Resolution 86-480 adopted amending resolution 83-201 modifying
fees for uses of building, sports facilities and increasing fees
for recreational facilities.
August 15, 1988 - Resolution 88-307 adopted, amending resolution 86-480 modifying
fees for uses of buildings, sports facilities increasing fees for
recreational facilities, and setting fees for certain recreation
center facilities and for alcohol permits.

ATIONAL FACILITIES AND SETTING FEES FOR
CERTAIN RECREATION CENTER FACILITIES AND
FOR ALCOHOL PERMITS.
Through recent months requests from private non-profit groups to
use City parks and park parking lots for fund raising events have
been rapidly increasing.
Presently there are approved rental fees for use of other recre-
ational facilities and equipment however. no fees have ever been
approved specifically for parks or park parking lots.
It is appropriate now as a result of the increased requests for
use of parks and park parking lots that a fee be approved in con-
formance with previously established policy of charging fees. for
uses of other recreational facilities and equipment for various
activities.

The fees are a flat rate of $100 per day and are reasonable to en-
able the City to more closely cover costs of providing such ser-
vices.
The proposed fee .was approved by the Council Legislative Review
Committee in June 1989.

RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING
RESOLUTION NO. 88-307 ENTITLED IN PART "RESOLUTION .
MODIFYING FEES FOR . . . USES OF BUILDINGS, SPORTS FACILITIES
INCREASING FEES FOR RECREATIONAL FACILITIES, AND
SETTING FEES FOR CERTAIN RECREATION CENTER FACILITIES AND FOR
ALCOHOL PERMITS", AND SETTING FEES FOR USE OF PARKS AND PARK
PARKING LOTS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Findings. The Mayor and Common Council
hereby find:
A. A hearing has been held by the Mayor and Common
Council pursuant to the provisions of Government Code section
54990, et seg., to consider the levy of new and additional
fees and service charges for various services provided by the
Parks, Recreation and Community Services Department for uses
of parks and park parking lots which hearing was held
following public notice published in a newspaper of general
circulation in the City of San Bernardino.
B. There has been an increase in demand for use of
parks and park parking lots by private non-profit groups for
fund raising activities.
C. There are approv~a' rental fees for use of other
recreational facilities and equipment however there are no
rental fees established for the use of parks or park parking
lots.

D. The proposed fees and charges are reasonable and
necessary to enable the City of San Bernardino to more nearly
meet the actual costs of providing such services and
facilities.

D. Alcohol Permit Fees (on City Parks, Recreation and
Community Service Facilities).
1. Special Events. Athletic Events. Fundraisers
Sponsor must be an established, non-profit
organization. Beverages are restricted to beer and
wine.
A. Alcohol Permit Fee: $50.00 - when ABC Permit is
not required and participation is 150 or less:
$100.00 - when ABC Permit is required or
participation exceeds 150. (This fee is in
addition to any rental or staffing fees.)
2. Private Gatherinqs
A. Alcohol Permit Fee: $50.00 (0-150 participants):
$100.00 (151 or more participants). This fee is
in addition to any rental or staffing fees.
E. Priority of Use: The priorities of use shall be in
the following order:
1. Parks, Recreation and Community services
Department sponsored activities.
2. Parks, Recreation and Community Services
Department cosponsored activities and tax-
supported groups.
3. Non-profit, youth-servicing organizaitons located
permanently in and serving the city of San
Bernardino.

4. civic and social groups (resident and non-profit) .
5. civic and social groups (non-resident or
commercial.
F. Non-profit, youth-serving organizations located
permanently in and serving the city of San Bernardino are those
organizations whose principal purpose is to provide a service
or program to participants, generally under the age of 18, of
which at least fifty-one percent (51%) reside in the City of
San Bernardno. Groups in this classification shall pay no fee
for use of outdoor athletic facilities and fifty percent (50%)
of the stated rate for all other facilities and equipment.
G. A non-residency surcharge of ten percent (10%) for all
facility or equipment rentals, class registration fees, and
excursion fees, and a five dollar ($5.00) per non-resident
player surcharge for adults sports programs shall be charged.
H. The Mayor and Common Council may exempt non-profit
associations or corporations organized primarily for patriotic,
civic betterment or charitable purposes or any local civic or
charitable organization from the foregoing rates and fee
schedule for the use of park and recreation buildings and
facilities upon a finding.:titat the rental fee would create a
financial hardship jeopardizing the activity or event planned
for such use and that the activity or event will be of unusual
benefit to the inhabitants of the city and should be supported
with public funds. The word 'local' as used herein is defined
to mean an organization whose membership is comprised of more
than fifty percent (50%) of City residents."
