In August 1984, the Agency entered into an agreement with the Colton
Redevelopment Agency for construction of public improvements on Hunts
Lane. The Commission has previously approved two (2) amendments to
this agreement.

That the Community Development Commission authorize the Executive
Director to execute a Third Amendment to Agreement between the
redevelopment agencies of the cities of San Bernardino and Colton
obligating the City of Colton to reimburse and additional fifty
thousand dollars ($50,000) for the construction of public
improvements on Hunts Lane.

STAFF REPORT
Colton/Htmts Lane Amendment
On August 6th, 1984, the redevelopment agencies of the cities of San
Bernardino and Colton entered into a cooperative agreement for the
construction of public improvements on Hunts Lane (a boundary street
between the two cities as shown on the attached site map). The
improvements are being installed by San Bernardino, but a portion of
the costs are reimbursed by Colton. The agreement was amended twice
and currently provides that Colton reimburse $296,525 of the total cost
of $614,025.
At this time, all of the public improvements have been completed with
the exception of the railroad crossing and a newly proposed storm drain
system. The storm drain would transport water from the intersection of
Hunts Lane and Caroline Street (in San Bernardino) across Hunts Lane to
a drainage ditch which runs parallel to the Southern Pacific railroad
tracks in Colton. The storm water originates on San Bernardino
properties and is deposited into a Colton collection system. It is
proposed that the costs be shared equally.
The estimated cost of the remaining improvements is approximately
$200,000. Colton is willing to split these costs evenly. However,
only approximately $50,000 remains in the reimbursement agreement. The
attached amendment will increase Colton's remainder to $100,000,
allowing it to cover its share of the anticipated costs. The Colton
City Cotmcil has approved the proposed amendment.
The Agency provided sufficient funds for the San Bernardino share of
the costs in its adopted budget for 1991-1992 and no increase in budget
is required.
Staff recommends adoption of the form motion.

THIS AMENDMENT TO AGREEMENT, made and entered into this
_day of
, 1991 by and between the REDEVELOPMENT
AGENCY OF THE CITY OF SAN BERNARDINO, CALIFORNIA ("San
Bernardino"), a public agency duly organized and existing under
the laws of the State of CalifOrnia, and the REDEVELOPMENT AGENCY
FOR THE CITY OF COLTON, CALIFORNIA ("Colton"), a public agency
duly organized and existing pursuant to the general laws of the
State of California,
WITNESSETH:
WHEREAS, the parties hereto executed an Agreement for the
funding of public improvements in the Hunts Lane area dated August
6, 1984, and
WHEREAS, the parties executed a First Amendment to said
Agreement providing for the payment of certain cost overruns for
said improvements dated October 7, 1985, and
WHEREAS, the parties executed a Second Amendment to said
Agreement providing for the payment of certain cost overruns for
said improvments dated May 20, 1986, and
WHEREAS, the anticipated improvements have been completed
with the exception of the Hunts Lane railroad crossing and a storm
drain system which will collect water from Caroline Street and
transport it across Hunts Lane, and

1 WHEREAS, estimates have been received which indicate that
2 completion of the project will cost an additional one Hundred
3 Thousand Dollars (SlOO,OOO), and
4 WHEREAS, the parties desire to further amend said Agreement
5 to provide for the payment of the additional costs,
6 NOW, THEREFORE, the parties hereto agree as follows:
7 That certain Agreement entered into between the parties
8 dated August 6, 1984, for public improvements to the Hunts Lane
9 area, as amended by the first amendment thereto executed on
10 October 7, 1985, and further amended by the second amendment
11 thereto executed on May 20, 1986, i. further amended by adding
12 thereto the following:
13 1. In addition to the undertakings previously provided for
14 under the basic agreement and the first and second amendments
15 thereto, Colton now agrees to pay additional costs in the amount
16 of S50,000.00, incurred by San Bernardino as Colton's share of
17 cost overruns for construction of Hunts Lane improvements. Such
18 extra costs consist of extra costs for the Hunts Lane railroad
19 crossing and a storm drain system which will collect water from
20 Caroline Street and tranaport it across Hunts Lane. The total
21 additional amount to be paid by the City of Colton under this
22 Third Amendment is S50,000.00.
23 2. To cover the additional costs recited herein, Colton
24 agrees to pay to San Bernardino, as reimbursament, under the same
25 terms and conditions as specified in the original agreement and
26 the first and second amendments, the additional surn of S50,000.00,
27 which, with the S296,524.87, heretofore agreed to in the original

agreement and the first and second amendments, constitutes an
agreement to pay a total sum of $346,524.87.
3. In all other respects, the agreement dated August 6,
1984, as amended by the first and second amendments thereto, shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement on the day and date first above shown.
