Synopsis of Previous Council ection:
1/23/92: Resolutions 92-22, 92-23, 92-24, 92-25, 92-26 and 92-27 were adopted
calling for a special election to be held on Tuesday, June 2, 1992,
for the purpose of submitting to the qualified electors of the City,
for their approval or disapproval, proposed Charter Amendments.
Recommended motion:
MOTION: That the Finance Director be directed to prepare an impartial fiscal
HI analysis of the proposed Charter Amendments to be voted on at the June 2,
1992 election, showing the amount of any increase or decrease in revenue
or cost of these measures to the City of San Bernardino.

That the City Attorney be directed to prepare an impartial analysis of
the City measures to be voted upon at the June 2, 1992 election.

Pursuant to action taken at the Council meeting on January 23,
1992, today I am sending certified copies of Resolution Nos. 92-
22 to 92-27 to the County Board of Supervisors requesting that
the City's Special Municipal Election be consolidated with the
Primary Election to be held on Tuesday, June 2, 1992.
Article 4, Section 5011 of the Elections Code provides that:
"Whenever any city measure qualifies for a place on the ballot,
the governing body may direct the city clerk to transmit a copy
of the measure to the city attorney, . . . The city attorney
shall prepare an impartial analysis of the measures showing the
effect of the measure on the existing law and the operation of
the measure. If the measure affects the organization or salaries
of the office of the city attorney, the governing board may
direct the city clerk to prepare the impartial analysis. The
analysis shall be printed preceding the arguments for and
against the measures. The analysis shall not exceed 500 words in
length."
On September 15, 1981, Ordinance No. MC-97 was adopted amending
Chapter 2.56 of the San Bernardino Municipal Code by adding
Section 2.56.190 to provide for the preparation of fiscal
analyses of city election measures.
Since no direction was given at the January 23, 1992 Council
meeting to request that an impartial analysis of the measures be
prepared by the city attorney and to have an impartial fiscal
analysis of the measures showing the amount of any increase or
decrease in revenue or cost to the City of San Bernardino, I
would like to remind you that should you desire to have such
analyses submitted with the proposed charter amendments, such
action IDUst be taken no later than your next meeting of February
3, 1992, so that they can be submitted to the County Board of
Supervisors and Registrar of Voters Office in a timely manner.
