STAFF REPORT
The Water Department began the upgrades to the City's water system
in 1990 in accordance with the Water System Master Plan. One of
the major components of the master plan is the installation of a
major water transmission facility to move water from the lower end
of the basin to the higher elevations in the water system. The
overall project also requires additional water storage reservoirs
and pumping facilities.
A portion of the capital funding for the transmission facilities
and funds to acquire property for the additional water storage
reservoir sites was included in the bonds issued in 1990 by the
West End Water Conservation and Development Joint Powers Authority.
Water Department staff conducted extensive investigations to find
property at the required elevations and in close proximity to the
transmission lines. ~here are very few parcels of land available
along the transmission route that are not already developed.
A site was found for. the upper reservoir, elevation 1415', and
Water Department staff has tried to negotiate with the property
owners to acquire the property. Attached is a map which shows the
location of the parcels to be acquired. It may be necessary to
take the property through eminent domain proceedings if successful
negotiations of value cannot be accomplished with the property
owners.
The resolution of necessity for the taking of these parcels of land
is necessary for the Water Department to proceed with eminent
domain should that action become necessary~
It is recommended that the resolution be approved.

NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND. COMMON COUNCIL,
2 CITY OF SAN BERNARDINO THAT:
3 SECTION 1. There is a necessity for the taking, in fee simple
4 absolute, Parcel Numbers: 267-171-03, 267-171-04 and 267-171-
5 05, also known as Lots 224, 225 and 226 of Tract 2258, Map
6 Book 32, pages 72-77, of the San Bernardino County records,
7 said lots being located on the southerly side of Ogden Street,
8 westerly of Cajon Boulevard in the County of San Bernardino,

SECTION 2.
Said parcels of property are required for the
public use of a water storage reservoir and pumping facility,
authorized for public use by Streets and Highway Code section
5101(h).
14 SECTION 3. That all actions necessary to acquire said parcels
of property shall be by and through the Board of Water
