CITY' OF SAN BER.RDINO - REQUEST tpR COUNCIL ACTION STAFF REPORT A request was received by this office to vacate a portion of the "paper" street and the remainder of an East/West alley lying South of Highland Avenue and West of Valaria Drive, from Virgil Franks, the owner of the two pieces of property separated by the alley. On 10-07-91, authorization was given to proceed with the proposed vacation, and Plan No. 8574 was approved. All of the interested City Departments and utility Co~ies were notified of the proposal on 10-28-91, with a reply due by 11-27-91. The responses are attached for your information. A request was received for an easement for public utility purposes for Southern California Edison. as set forth in the attached Resolution of Intention. On 01-13-92, a Notice of Exemption was filed with the County Board of Supervisors and a finding of consistency with the General Plan was IIUlde. The rellUlining fee of $375.00 has been paid and it is reco.ended that favorable consideration be given to the requested vacation. The Resolution of Intention, which sets a protest date of 03-02-92 has been attached hereto for your action also. RESOLlJI'ION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF PORTIONS OF A "PAPER" STREET AND THE RmlAINDER OF THE EAST/WEST ALLEY LYING SOlJI'H OF HIGHLAND AVENUE AND WEST OF VALARIA DRIVE, AND RESERVING AN EASEMENT FOR PUBLIC lJI'ILITIES THEREIN. BE IT RESOLVED BY THE MAYOR AND COMHON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Hayor and Co.on Council of the City of San Bernardino hereby declare their intention to order the vacation of a portion of the "paper" street and the remainder of the East/West alley lying South of Highland Avenue and West of Valaria Drive, described as follows: A portion of that certain street and alley as delineated on the Hap of Tract No. 3996 as per plat thereof recorded in Book 52 of Maps, Page 64, records of the County Recorder of San Bernardino County, State of California, described as follows: Beginning at the Northeast corner of Lot 2 of said Tract No. 3996; thence West along the North line of said Lot 2, to the Northwest corner thereof; thence South along the West line of said Lot 2 to the Southwest corner thereof: thence West along the Westerly prolongation of the South line of said Lot 2 to a point in a line which is parallel with and 41.25 feet West of the West line of said Lot 2; thence North along said parallel line to a point in the South line of that certain vacated street and alley as vacated by the City of San Bernardino, Hay 26, 1969, by Resolution No. 9847; thence East along said South line to the West line of Valaria Drive, 60 feet wide, as delineated on the Hap of said Tract 3996; thence South along the Southerly prolongation of said West line to the Northeast corner of said Lot 2 and the Point of Beginning. SECTION 2. That the Hayor and C~on Council of the City of San Bernardino, in vacating the above described portion of said streets, elect to proceed under and in accordance with the provisions of the "Public Streets, Highways and Services Vacation Law", being Division 9. Part 3, of the Streets and Highways Code of the State of California. SECTION 3. SECTION 4. Nothing in this Resolution shall in lIJlY way affect or disturb lIJlY existing easements for public utility purposes belonging either to the City of SlIJl Bernardino or to lIJlY public utility and there is hereby specifically reserved for Southern California Edison an easement over the entire area of the 10 foot wide East/West alley portion of the subject 13 vacation, lIJl easement to construct, place operate, inspect, maintain, 14 repair, replace, and remove such aerial lllld underground electrical trans- 15 mission structures, as the company may from time to time require, consisting 16 of poles, anchors, wires, cables, eonduits, manholes, markers, lllld necessary 17 fixtures lIJld appurtenances, and said easement shall include rights of 18 ingress lllld egress. 19 SECTION 5. That the City Engineer of the City of SlIJl Bernardino 20 hereby is directed to cause Notices of Street Vacation to be posted as 21 required by the Public Streets, Highways lIJld Services Vacation Law. 22 SECTION 6.
