Synopsis of Previous Council action:
Recommended motion:
Provided that no qualified secretary is available from those being
laid off by the City, the City Attorney is authorized to employ a Temporary
Legal Secretary from an agency as a substitute for a Legal Secretary I who
is taking a medical leave of absence. The amount authorized for said tem-
porary employment shall not exceed $5,500.00 for the nine (9) week period.

STAFF REPORT
Due to pending surgery. a Legal Secretary I in the City Attorney's
Office will be taking medical leave of absence for approximately
nine (9) weeks. beginning at the end of February.
This office presently has two Legal Secretary positions vacant.
The present workl-Oad is such that there is no other secretary
available to cover the work of the attorney to whom this secretary
is assigned. Thirty-three (33) cases are currently assigned to the
attorney in question. It will be necessary to assign fifteen (15)
of those thirty-three cases out to outside counsel if there is no
secretary available to do the pleadings. (This secretary also
processes all of the criminal citations and complaints for the
Municipal Court from the City. There are between 10 and 15 of
those complaints each week).
The cost of farming those cases out to outside counsel will be
approximately 450 hrs. x 100 per hr. = $45.000.00*
The cost bids for a temporary are as follows:
Olston - $13.50 per hr. x 360 hrs. = $4.860.
Thomas 15.00 per hr. x 360 hrs. = 5.400.
Remedy 15.77 per hr. x 360 hrs. = 5.677.20
Manpower 18.81 per hr. x 360 hrs. = 6.771.60
I am requesting permission to hire a temporary if no qualified
secretary in the City is available. I request up to $5.500.00 for
this person.
It will cost $39.500.00 more to farm out the fifteen cases than it
will to hire a temporary. In addition to farming out cases if we
do not hire a temporary. we will still be required to process the
citations for Court, and the attorney will be expected to continue
representation of the City in the remaining eighteen cases that are
not farmed out as well as advise the departments assigned to that
attorney.
I have conferred with Personnel Committee Chairperson Tom Minor
and he advises that this matter be taken directly to the Council

rather than going through his committee due to the budget
situation.
*The cost will actually be greater as the 450 hour estimate does
not include the time the outside attorney or attorneys will need
to become familiar with the case.
