Recommended motion:
That an expenditure of $1,820 plus an amount not to exceed $1,400 for out-of-pocket
expenses to employ the firm of ERNST & YOUNG to conduct an audit to check the accuracy
of the funds distributed to cities who participated in the litigation concerning
municipal court fines and forfeitures be approved.

STAFF REPORT
Victorville, et, al. v. San Bernardino County, et. al.
Municipal Court Fines and Forfeitures
February 10, 1992
As a result of the lawsuit brought against the County of San
Bernardino concerning the disbursement of municipal court fines and
forfeitures, the City of San Bernardino was awarded the sum of
$78,735.29. This award was received from the County of San
Bernardino and receipted on November 4, 1991.
We have been contacted by the city of victorville and told that
Elizabeth Silver of Meyers, Nave, Riback and Wes~who represented
the cities in this litigation feels that it is in the best interest
of each city involved to have Ernst and Young conduct an audit to
check the accuracy of the funds distributed to the cities.
The cost of such an audit is between $7,700 and $10,400, plus out-
of-pocket expenses, not to exceed 10% or $1,400. The City's
portion of the expense involved would be $1,820, which is based on
the top-end figure, plus a proportionate share of the out-of-pocket
expenses. The city's participation is recommended.
