Synopsis of Previous Council action:
Council approved resolution #94-103, agreeing to enter into a contract
for services with BlockBuster Pavilion. The City agrees to provide
police personnel, for traffic control, during scheduled events.
BlockBuster Pavilion agrees to reimburse the City for the cost of this
service. The agreement has expired.

STAFF REPORT
SUBJECT
Agreement for Service with Glen Helen BlockBuster Pavilion.
BACKGROUND
The BlockBuster Pavilion provides entertainment at Glen helen
Regional Park. The events draw large crowds sometimes in excess of
15,000 people. To facilitate traffic movement and minimize the
impact to residents in the area, the police department provides
overtime personnel for traffic control at key intersections.
BlockBuster reimburses the full cost of this service to the City.
Using trained police personnel for traffic control ensures
qualified personnel are performing this function. This creates a
natural coordination with the police department in the event of an
emergency or an unanticipated event. The department and
BlockBuster have successfully joined in this service agreement
since 1994. Using personnel on overtime eliminates a drain on
existing police services.
FINANCIAL IMPACT
NONE:
BlockBuster reimburses the City for all overtime costs
incurred.
RECOMMENDATION
It is recommended the Mayor and Common Council adopt the Agreement
for Services with BlockBuster Pavilion to provide overtime
personnel for traffic control during events at Glen Helen Regional
Park. All costs of services will be reimbursed to the City by Glen
Helen Raceway Park.
Failure to adopt this agreement will impact the flow of traffic to
and from BlockBuster events at Glen Helen Regional Park. This
impact will result in traffic congestion and increase the potential
for traffic accidents during the events. Both would negatively
impact the city of San Bernardino and the residents in the area of
Glen Helen Regional Park. Uncontrolled traffic has the potential
of increasing demands on existing police services, resulting in a
cost to the City for services provided.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is

hereby authorized and directed to execute on behalf of said City
8
a contract with Pavilion Partners, Inc., dba: Glen Helen
9
Blockbuster Pavilion relating to traffic control services within
10
11
City jurisdiction, a copy of which is attached hereto marked

Exhibit "An and incorporated herein by relerence as fully as
though set forth at length.
14 SECTION 2. The authorization to execute the above

15 referenced agreement is rescinded if the parties to the
16 agreement fail to execute it within sixty (60) days of the
17 passage of this resolution.

3 THIS AGREEMENT, made and entered into this
day of
4 1998, by and between the City of San Bernardino, acting by and
5 through the San Bernardino Police Department, hereinafter called
6 ~CITY" and Pavilion Partners DBA: Glen Helen Blockbuster
7 Pavilion, hereinafter called ~PARTNERS".
B WITNESSETH: By and in consideration of the covenants and the
9 conditions herein contained, the PARTNERS and CITY do hereby
agree as follows:
1. CITY agrees to pr~vide one Police Officer and four
Community Service Representatives (C.S.R.'sl* with
vehicles for traffic control during various events at the
Glen Helen Blockbuster Pavilion. Traffic control

services will be provided, as needed, at the following
locations:
a. 1-215 Northbound off ramp at Palm
b. Palm and Kendall
c. Palm/Institution and Cajon Boulevard
d. Institution and Powerline Road.
2. The S.B,P.D coordinator shall be Corporal Lance Otey,
Area Corporal for Area B, telephone number (909) 384-
5786. The PARTNERS coordinator shall be Mr. Nick Kotos,
telephone number (909) 880-6500.

3. The term of this agreement shall be May 1
1998
through December 31, 1999.
4. In consideration for the above services and upon receipt
of an itemized invoice, PARNTERS agrees to pay the Cit
in accordance with the following rates:
Police Corporal
$44.07 per hour
CSR II
$23.83 per hour
CSR I
$22.11 per hour
Vehicle/Equipment Usage
$79.76 ($99.70*) per event
*Events with expected attendance of more than 15,000
will require one additional CSR.
5. This agreement may be amended by written mutual consent
of both parties hereto.
6. In the event of disaster or unforeseen emergency, CITY

shall be excused irom providing scheduled traffic control
services without prior notice. Either party may cancel
this agreement by giving thirty-day notice to the other.
7. The rates indicated in this agreement are for estimate
purposes only.
In the event of a wage increase, PARTNERS
agrees to pay the increased rates.
8. PARTNERS agrees that reasonable additional charges may be
assessed for S.B.P.D. supplies expended (flares),
additional equipment utilized, damage to uniforms or
property repaired or replaced at CITY expense, etc.,

which are directly related to the services referenced
herein.
9. PARTNERS agrees that any cancellations of this request
for service later than 4:00 p.m. on the day preceding
the requested service may result in a charge of four (4)
hours for each officer assigned.
10. No additional gifts, donations, or gratuities may be
accepted by S.B.P.D. personnel in their behalf or in the
behalf of the Department.
11. PARTNERS shall indemnify, defend and hold CITY, its
officers, employe~s and agents, free and harmless from
any claim, demand, liability, suit, judgement or expense
(including, without limitation, reasonable costs of
defense) arising out of or related to CITY's performance

of services under this agreement, except that such duty
to indemnify, defend and hold harmless shall not apply
where injury to person or property is caused by CITY's
willful misconduct or sole negligence.
