Synopsis of Previous Council Action:
On October 6, 1997, the Mayor and Common Council approved the Memorandum of
Understanding between the City of San Bernardino and employees in the Middle Management
Employees' bargaining unit of the City of San Bernardino represented by the San Bernardino
Public Employees' Association (SBPEA).
On December 1, 1997, the Mayor and Common Council approved a resolution amending
Resolution 6413, Section Five and One-Half, for all non-safety management and confidential
employees of the City of San Bernardino represented by the San Bernardino Confidential and
Management Unit (SBCEA).
On February 2, 1998, the Mayor and Common Council approved the Memorandum of
Understanding between the City of San Bernardino and employees in the General Unit
Employees' bargaining unit of the City of San Bernardino represented by the San Bernardino
Public Employees' Association (SBPEA).

BACKGROUND
Mid-Mana2:ement
On October 6, 1997, the Mayor and Common Council approved the Memorandum of
Understanding between the City of San Bernardino and employees in the Middle Management
Employees' bargaining unit of the City of San Bernardino represented by the San Bernardino
Public Employees' Association (SBPEA).
Article ill, Section 5, fERS, of said MOU states in paragraph 4, "The City agrees to amend its
PERS contract to pay the employer contribution for the Fourth Level 1959 Survivors' Benefit,
contingent upon approval of a lower employer rate by the PERS Board ($3.50/month) and
agreement with the other two (2) miscellaneous bargaining units.

On December I, 1998, the Mayor and Common Council approved a resolution amending
Resolution 6413, Section Five and One-Half, subsection (1), to apply to all non-safety
management and confidential employees of the City of San Bernardino represented by the San
Bernardino Confidential and Management Unit (SBCEA), "The City agrees to amend its PERS
contract to pay the employer contribution for the 4th Level of 1959 Survivors' Benefit,
contingent upon agreement by the other miscellaneous bargaining units. "
General Unit
On February 2, 1998, the Mayor and Common Council approved the Memorandum of
Understanding between the City of San Bernardino and employees in the General Unit
Employees' bargaining unit of the City of San Bernardino represented by the San Bernardino
Public Employees' Association (SBPEA).
Article ill, Section 2, fERS, of said MOU states in fourth paragraph, "The City agrees to
amend its PERS contract to pay the employer contribution for the Fourth Level 1959 Survivors'
Benefit. "
Pursuant to PERS regulations, the Mayor and Common Council must adopt a Resolution of
Intention and an ordinance approving an amendment to the PERS contract. Also, an employee
election must be held, giving each PERS member in the miscellaneous bargaining units a choice
of receiving this benefit or not. The cost to each employee electing to be covered by this benefit
will be $2.00 per month (nonrefundable).

ANALYSIS
The attached Resolution of Intention (Exhibit A) states the intention of the Mayor and Common
Council of the City of San Bernardino to amend its contract with the Public Employees'
Retirement System to provide Section 21574 (Fourth Level of 1959 Survivors' Benefit) for local
miscellaneous members who elect to be covered. This benefit provides a monthly allowance to
survivors of a member who dies prior to retirement. The benefit is paid in addition to the Basic
Death Benefit. Eligible survivors are:
. Spouse with two or more children; or three or more dependent children alone
. Spouse with one dependent child; or two dependent children alone
. One dependent child; or surviving spouse at age 60, or
. Dependent parents.
COSTING
The cost to the City will be $3.50 per month per each employee electing to be covered by this
benefit. Costing done during MOU negotiations was $31,500 for all miscellaneous groups.
General Unit was $23,500 and Mid-Management and Management/Confidential groups were a
total of $8,000.
These costs were part of MOU negotiations that were approved by the Mayor and Common
Council; the costs have already been included in the FY 97-98 budget and projections for FY
98-99 .
RECOMMENDATION
Based on the foregoing, it is recommended that the Mayor and Common Council adopt:
. Resolution of the Mayor and Common Council of the City of San Bernardino expressing
its intention to approve an amendment to contract between the Board of Administration
of the Public Employees' Retirement System and the City of San Bernardino.

WHEREAS, the Public Employees' Retirement Law permits the participation of public
agencies and their employees in the Public Employees' Retirement System by the execution of a
contract, and sets forth the procedure by which said public agencies may elect to subject themselves

and their employees to amendments to said Law; and
WHEREAS, one of the steps in the procedures to anlend this contract is the adoption by
the governing body of the public agency of a resolution giving notice of its intention to approve an I
amendment to said contract, which resolution shall contain a summary of the change proposed in said !
contract; and
WHEREAS. the following is a statement of the proposed change:
To provide Section 21574 (Fourth Level of 1959 Survivor Benefits) for local miscellaneous
members.
NOW, THEREmRE, BE IT RESOLVED, that.the governing body of the above agency

The Board of Administration, Public Ecpioyees' Retirement System, hereinafter referred to as
Board, and the go',erning body of above public agency, hereinafter referred to as Public Agency,
having entered into a contract effective March 1,1945, and witnessed February 6,1945, and as
amended effecti-,e November i, 1949. September I, 1951, January I, 1952, July I, 1954,
February I, 1965, February 24,1969, March 8, 1971, October 1,1973, October 28,1974, March
17, 1975, April 28, 1975, November 10, 1975, July 6, 1977, January 7, 1985, May 27, 1985,
September 16, ]988, August 27,1990, August I, ]996, July 3,1997 and January ], 1998 which
pro"ides. for participation of Public Agency in said System, Board and Public Agency hereby
agree as follows: .'

inclusive:
I. All words and tenns used herein which are defmed in the Public Employecs'
Retirement Law shall have the meaning as defined therein unless otherwise
specifically provided. "Nonna! retirement age" shall mean age 60 for local
miscellaneous members and age 50 for local safety members.
2. Public Agency shall participate in the Public Employees' Retirement System from
and after March 1. 1945 making its employees as hereinafter provided, members
of said System subject to all provisions of the Public Employees' Retirement Law
except such as apply only on election of a contracting agency and are not provided
for herein and to all amendments to said Law hereafter enacted except those,
which by express provisions thereof, apply only on the election of a contracting
agency.
3. Employees of Public Agency in the following classes shall become members of
said Retirement System except such in each such class as are excluded by law or
this agreement:
a.
Local Fire Fighters (herein referred to as local safety members);

b.
Local Police Officers (herein referred to as local safety members);

miscellaneous members).

In addition to the classes of employees excluded from membership by said
Retirement Law, the following classes of employees shall not become members of
said Retirement System:
a. CROSSING GUARDS IDRED ON OR AFTER JANUARY 1, 1952;
b. LIBRARY PAGES HIRED ON OR AFTER MARCH 17, 1975;
c. LIFEGUARDS;
d. SENIOR LIFEGUARDS;
e. SUPERVISING LIFEGUARDS;
r. RECREATION INTER..'iS;
g. RECREATION AIDES;
h. RECREATION LEADERS;
i. SENIORRECREATIONLEADER~ .
j. RECREATION SPECIALIST;

Prior to January I, 1975, those members who were hired by Public Agency on a
temporary and/or seasonal basis not to exceed 6 months were excluded fror.!
PERS membership by contract. Government Code Section 20336 superseded this
contract provision by providing that any such temporary and/or seasonal
employees are excluded from PERS membership subsequent to January I, 1975.
Legislation repealed and replaced said Section with Government Code Section
20305 effective July I. 1994.
6. The percentage of final compensation to be provided for each year of credited
prior and current service as a local miscellanem.ls member shall be determined in
accordance \\ith Section 21353 of said Retirement Law (2% at age 60 Full).
7. The percentage of final compensation to be provided for each year of credited
prior and current service as a local safety member shall be determined in
accordance with Section 2 I 362 of said Retirement Law (2% at age 50 Full).

Public Agency, in accordance with Government Code Section 20790, ceased to be
an "employer" for purposes of Section . 20834-. effective .on April 28, 1975.

thereafter shall be held by the Board as provided in Government Code Section

10. Public Agency shall contribute to said Retirement System the contributions
determined by actuarial valuations of prior and future service liability with respect
to local miscellaneous members and local safety members of said Retirement
System.
II. Public Agency shall also contribute to said Retirement System as follows:
a. Per covered member. SO per month on account of the liability for the 1959
Survivor Benefits provided under Section 21573 of said Retirement Law.
(Subject to annual change.) In addition, all assets and liabilities of Public
Agency and its employees shall be pooled in a single account. based on
term insurance rates. for survivors of all local fire members.
b.
Per covered member. S3.50 per month on account of the liability for the
1959 Survivor Benefits provided under Section 21574 of said Retirement
Law. (Subject to annual change.) In addition. all assets and liabilities of
Public Agency and its employees shall be pooled in a single account,
based on term insurance rates. for survivors of all local miscellaneous
memb..rs.

A reasonable amount, as fixed by the Board, payable in one installment
within 60 days of date of contract to cover the costs of administering said
System as it affects the employees of Public Agency, not including the
costs of special valuations or of the periodic investigation and valuations
required by law.

d. A reasonable amount, as fixed by the BOll1'd, payable in one installment as
the occasions arise, to cover the costs of special valuations on account of
employees of Public Agency, and costs of the periodic investigation and
valuations required by law.
12. Contributions required of Public Agency and its employees shall be subject to
adjustment by Board on account of amendments to the Public Employees'
Retirement Law, and on account of the experience under the Retirement System
as detennined.. by the 'periodic investigation and valuation required by said
Retirement Law.
13.

Contributions required of Public Agency and its employees shall be paid by
Public Agency to the Retirement System within fifteen days after the end of the
period to which said contributions refer or as may be prescribed by Board
regulation. . If more or less than the correct amount of contributions is paid for any
pe:iod, proper adjustment shall be made in connection with. subsequent
remitta:lces.. Adjustments 011- account of errors in. contributions required of any

After your governing body has adopted the Resolution ofIntention, the next procedure with
respect to the 1959 Survivor Benefits is to allow each current member to make an individual
election. Members in employment on the effective date of the iimendment may elect whether to //
be covered. Participation is required of all future entrants into membership. The supervision ofV'"
this election and the details of its conduct are under the control and direction of your agency.
_ A ballot, Form CON-24c, including the summary of benefits is to be distributed to all eligible
employees to complete and sign. The oriltinal ballots must be returned to this office alon2 with a
listin in du licate, of the employees, their Social Security numbers and category
miscellaneous, fire, police, etc.) wherein the employees are grouped according to those: 1) who
e ected coverage; 2) who did not elect coverage; and 3) who did not return the ballot. Employees

The list should confirm the results of the election, which are certified on the enclosed Form
