Synopsis of Previous Council Action:
January 21, 2007 - The Legislative Review Committee requested staff to draft an ordinance
establishing a Historical Preservation Commission, outlining the composition of its members and
duties.
March 6, 2007 - The Legislative Review Committee recommended item for Mayor and Council
approval.

STAFF REPORT
Subiect:
Ordinance of the City of San Bernardino adding Chapter 2.23 to Title 2 of the San Bernardino
Municipal Code establishing the Historical Preservation Commission.
Backl!:round:
At the request of the Legislative Review Committee, Councilman Kelley requested staff to
research the feasibility of establishing a Historical Preservation Commission in the City of San
Bernardino. Neighboring communities with established commissions were contacted regarding
the roles and duties of their commission members. Cities included in the analysis were
Redlands, Riverside, and Colton.
Additionally, staff met with the San Bernardino Pioneer Society to gain an understanding of the
organization's role with regard to historic preservation and what its members envision regarding
the historical preservation of the city. There is concern that there is lack of education and
knowledge in the area of historic preservation. Society members expressed desire that some type
of committee be formed to address historical preservation issues in the city and create awareness
in the community.
The purpose of these commissions is to promote the general welfare of the community by
preserving buildings, sites and structures that are relevant to the historical integrity of their
respective cities. Generally, their role is to advise the Planning Commission and/or the Mayor
and Council on issues pertaining to historic preservation.
This ordinance establishes a nine-member commission plus one non-voting member. The Mayor
and Council may appoint commission members outside their respective wards, but they must be
residents and registered voters of the City. In order to expand the availability of expert
knowledge in the area of historical preservation, the non-voting member need not be a resident of
the City. The ordinance also outlines the commission's role and duties, which include:
o Serve in an advisory capacity to the Planning Commission in making recommendations
relating to the designation, preservation and protection of historical properties.
o Assist in reviewing Mills Act applications.
o Make recommendations, as requested, to the Planning Commission regarding proposed
general plan, zoning, and map changes that impact designated areas.
o Promote public interest in, and understanding of, historical and scenic properties and the
preservation thereof.
o Seek the means and resources to appropriately identify landmarks, historic districts, and
structures of merit with state and national historic registers.
o Seek out information and advise the Mayor and Council on funding opportunities for
preservation.
o Meet quarterly or as requested by the Planning Commission or Mayor and Common Council.

2.23.010 Purpose
The purpose of the Historical Preservation Commission is to promote the general welfare ofthe
City by providing for the identification, protection, and enhancement of buildings, structures,
areas, streets, districts, neighborhoods, sites, and natural landscapes that have special historical,
archeological, cultural or aesthetic value to the City.
2.23.020 Members - Appointment - Term
The Historical Preservation Commission shall consist of nine (9) voting members who shall
serve without compensation at the pleasure of the Mayor and Common Council. Members shall
be nominated and appointed and shall serve pursuant to the provisions of Chapter 2.17, except
that members need not be residents of the ward of the nominating Council member. The Mayor
shall nominate two (2) members, who are residents and registered voters of the City, plus one
(I) non-voting advisory member, who need Mt be a resident of the City, to serve for the term
of the Mayor. All members must have a prior demonstrated interest, competence or knowledge
of the historical preservation of the City.
2.23.030 Duties.
The Historical Preservation Commission Shall:
(A) Serve in an advisory capacity to the Planning Commission in making recommendations
relating to the designation, preservation and protection of historical properties.

2.23.040 Meetings - Chairperson - Absences
The Historical Preservation Commission shall hold meetings and shall function pursuant to the
provisions of Chapter 2.17 except that meetings shall be held quarterly or as requested by the
Planning Commission or the Mayor and Common Council.
