Staff Report
Subject:
Resolution of the Mayor and Common Council of the City of San Bernardino requesting that the
City of San Bernardino's Primary Municipal Election be consolidated with the November 6,
2007 Consolidated Election conducted by the County of San Bernardino.
Background:
The following City offices are up for election in November 2007: Offices of the City Attorney,
City Clerk, and City Treasurer, and Council seats in the Third, Fifth, Sixth, and Seventh Wards.
In 1992, City Charter Section 10 was amended to change the dates of the City's primary election
from March of odd-numbered years to November of odd-numbered years and the general
election dates from May to February. As a result of this change, the City has been able to
consolidate its primary elections with the Uniform District Election Law (UDEL) elections
conducted by the County and described in Sections 10500-10556 of the California Elections
Code, thereby saving considerable expense by not having to conduct stand-alone elections.
However, it should be noted that this year our share of the election costs may be higher due to
the fact that over 20 jurisdictions have moved their elections from the odd year to an even year.
Consequently, there will be fewer jurisdictions sharing in the cost of the November 2007
election.
Elections Code Section 10403 requires that a resolution requesting consolidation must be filed at
least 88 days prior to the date of the election. The 88th day prior to the November 6, 2007
election falls on August 10, 2007.
Nomination papers will be issued by the City Clerk's Office; however, the County Registrar of
Voters Office will designate polling places, issue absentee ballots, conduct the election, tally
votes, and conduct the canvass. The nomination period opens Monday, July 16, 2007, and closes
on Friday, August 10, 2007. Elections Code Section 10225 requires that if an incumbent officer
does not file nomination papers by the 88th day prior to an election, then the nomination period
for that office is extended to the 83rd day before the election.
Financial Impact:
Estimated cost is between $276,000 - $346,000 for the primary election, and we will
request funding in the FY 2007-2008 budget for the primary election. Estimated cost for a run-
off election will depend on whether it is a citywide run-off election or how many wards are
involved in the run-off election.
Recommendation:
Adopt resolution.

SECTION 1. Recitals.

A. On June 2, 1992, the voters of the City of San Bernardino voted to amend City
10
11 Charter Section 10 to change the dates of the City's primary election from March of odd-
12 numbered years to November of odd-numbered years and the general election dates from May
13 to the following February.
14 B. Section 2.56.010 A of the San Bernardino Municipal Code provides that a
15
primary election shall be held on the first Tuesday after the first Monday in November 1995,
16
17 and a like election shall be held on the first Tuesday after the first Monday in November every
18 four years thereafter, in the City for the nomination of candidates for the following offices:
19 1. Member of the Conunon Council from the Third Ward;
20 2. Member of the Common Council from the Fifth Ward;
21
3. Member of the Common Council from the Sixth Ward;
22
4. Member of the Common Council from the Seventh Ward;

24 5. City Clerk;
25 6. City Treasurer;

C. It is desirable that the City of San Bernardino's primary election be consolidated

with the consolidated election to be conducted by the County of San Bernardino on Tuesday,
5
6 November 6, 2007; that within the City of San Bernardino the precincts, polling places and
7 election officers for the two elections be the same; that the Registrar of Voters of the County
8 of San Bernardino canvass the returns of the City election; and that the consolidated election
9 and the City's primary election be held in all respects as if there were only one election.

SECTION 2. Primary Election Called. A primary election is called and will be held
11
12 in the City of San Bernardino on Tuesday, November 6, 2007, for the purpose of nominating
13 candidates for the following offices:
14 1. Member of the Common Council from the Third Ward;
15 2. Member of the Common Council from the Fifth Ward,
16 3. Member of the Common Council from the Sixth Ward;
17
4. Member of the Common Council from the Seventh Ward;
18
19 5. City Clerk;
20 6. City Treasurer;
21 7. City Attorney.
22 SECTION 3. Request for Consolidation of Elections. Pursuant to Section 10400 of
23 the Elections Code, the Mayor and Common Council of the City of San Bernardino request
24
that the Board of Supervisors of the County of San Bernardino consolidate the City's primary
25
26 election with the consolidated election to be held on Tuesday, November 6, 2007.

The polls for said election shall be open from 7 a.m. of the day of said election and
4
5 shall remain open continuously from said time until 8 p.m. of the same day when said polls
6 shall be closed, except as provided in Section 14401 of the California Elections Code.
7 SECTION 4. Canvass of Returns. The Registrar of Voters of the County of San
8 Bernardino is hereby authorized to canvass the returns of the primary election called by this
9 resolution and to conduct the primary election in all respects as if there were only one election
10
with only one form of ballot. Results of the primary election shall be certified to the Mayor
11
12 and Common Council of the City of San Bernardino.
13 SECTION 5. Notice of Election. The City Clerk is hereby directed to publish a
14 notice of the primary election which shall contain the following:
15 A. The time of the election.
16
B. The offices to be filled, specifying full or short term.

18 C. The hours the polls will be open.
19 SECTION 6. Conduct of Election. The primary election called by this resolution
20 shall be held in such precincts and at such polling places as shall be determined by the
21 Registrar of Voters of the County of San Bernardino. The Board of Supervisors of the County
22 of San Bernardino is hereby requested to issue instructions to the Registrar of Voters to take all
23
steps necessary for the holding of the consolidated election. The City Manager is hereby
24
2 authorized to execute a contract for the services necessary for conducting the primary election.

26 The City of San Bernardino recognizes that additional costs will be incurred by the County by
27 reason of this consolidation and agrees to reimburse the County for any such costs.

SECTION.7. Filing of Resolution. The City Clerk of the City of San Bernardino is

5 directed to file a certified copy of this resolution with the Board of Supervisors of the County
6 of San Bernardino.
7 I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and
8 Common Council of the City of San Bernardino at a joint regular meeting thereof, held on the
