BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS "FOLLOWS : SECTION 1. Recitals. A. The Community Development Commission of the City of San Bernardino (Commission) proposes to sell to the City of San Bernardino (City), those certain parcels of property identi- fied as APN 134-141-08 and a portion of APN 135-101-30, more particularly described on Exhibit A attached hereto and incorporated herein by reference, for the sum of One Dollar ($1.00) which will be paid by City in cash. B. Notice of the time and place of hearing has been given as required by law. C. The Commission has made available for public inspection and copying a summary of financial aspects of the proposed sale. D. A summary of financial aspects represent that the fair market value of the interest to be conveyed by Commission, determined at the highest use permitted for such property, is Six Hundred Ten Thousand and Thirty Dollars ($610,030.00). E. All hearings have been held as required by Health and Safety Code Section 33433. SECTION 2. Determination. Based upon the representation of Commission, it is found and declared that the consideration for the real property described above, in accordance with covenants and conditions 1 DAB: cm "l .7_QQ , '. "-. governing the sale, is less than the fair market value of the property determined at the highest use ,'permitted for such property, such lesser consideration is necessary in order to compensate the City for funds previously expended by it in developing the necessary parking spaces within the boundaries of the City parking district, and the Central City Project Area, which the Mayor and Common Council deem to be in the public interest, and is necessary to effectuate the pruposes of the Plan for the Central City Project Area. SECTION 3. Approval. The Mayor and Common Council' of the City of San Bernardino hereby approve the sale of said property upon the terms and conditions set forth in this Resolution, and the summary of financial aspects.
