RR R,; RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING A POLICY FOR THE ASSIGNMENT AND TAKE-HOME USE OF CITY-OWNED VEHICLES. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. The Mayor and Common Council find and determine that, whereas: A. The City owns, maintains and operates a fleet of motor vehicles to meet the transportation needs of its employees in the performance of their duties; B. The efficient functioning of the City requires that designated officers and employees of the City be authorized to have immediate access to City vehicles on an around the clock basis; C. A reimbursement allowance paid to any such officer or employee for the use of his or her personal motor vehicle for purposes of conducting City business will be a benefit to the City; D. It is necessary to establish rules and regulations for the operation of City vehicles and for the payment of any reimbursement allowance towards the end of controlling the costs of such allowances and limiting the City's liability arising from such usage. The Mayor may authorize take-home use of a City vehicle or, in lieu thereof, a monthly vehicle reimbursement allowance for any Elected Official, Department Head, Deputy City Administrator or the City Administrator when the Mayor finds that the position and responsibilities of the position require such use or allowance and that such use will be in the best interest of the City of San Bernardino. The amount of any allowance shall be as adopted by resolution of the Mayor and Common Council. B. When an Elected Official, Department Head, Deputy City Administrator, or City Administrator is given authority for the take-home use of a City vehicle, such use shall be in conformance with the administrative policy established for such use by the City Administrator, which policy shall set forth as a minimum: (1) limitations on the use of City vehicles and procedures for the take-home use of such vehicles; (2) that City-owned vehicles are for the use of officers and employees only. Use shall not be granted or extended to persons not specifically authorized the use of the subject vehicle by written authority of the City Administrator; (3) that City vehicles are intended for official City business and there shall be no personal use of City-owned vehicles other than commuter/incidental trips as defined by the City Administrator. Such action shall not constitute a reduction in rank or compensation as those terms are used for purposes of the application of Charter Section 254. (5) That adequate provision for insurance shall be made and that all persons authorized the take-home use of a City vehicle or a reimbursement allowance under this Section shall first undergo a course of driver training to be provided by the City and, present proof of such training to the City Administrator. C. With respect to the take-home use of City vehicles or, the payment of a reimbursement allowance to persons other than any elected official, Department Head, Deputy City Administrator or City Administrator, such use and the amount of any such allowance shall be as determined by the City Administrator pursuant to a written policy which shall contain at a minimum all of the provisions set forth at Subsection B above. D. No person is hereby given a right to the use of a City vehicle or to the receipt of a reimbursement allowance.
