2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF
3 THE CITY OF SAN BERNARDINO TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY
DESCRIBED HEREIN AND DESIGNATED ANNEXATION DISTRICT NO. 261 (LAFC 945), AND
4 GIVING NOTICE OF THE PROPOSED ANNEXATION.

5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
6 BERNARDINO AS FOLLOWS:

SECTION ONE: That pursuant to the provisions of the Annexation of
8 Uninhabited Territory Act of 1939, proceedings have been initiated by the
9 Council of the City of San Bernardino, on its own motion, to annex to the City
10 of San Bernardino all that uninhabited territory situate in the County of San
11 Bernardino, State of California, hereby designated as Annexation District No.
12 261 (LAFC 945), and described as follows:
13 Lot 9 and that portion of Lot 10, ARROWHEAD SUBURBAN FARMS,
TRACT "A" as per plat thereof recorded in Book 21 of Maps,
14 Page 6, records of the County Recorder of San Bernardino
County, State of California; and Lots 1 and 6 ARROWHEAD
15 SUBURBAN FARMS TRACT "D" as per plat thereof recorded in
Book 23 of Maps, Page 35, records of the County Recorder of
16 said County and those portions of adjoining streets, described
as follows:

Beginning at a point on the present corporate limits of the
City of San Bernardino, said point being the intersection
of the center lines of "c" Street, now known as Fortieth
Street and Newmark Avenue; thence West along said center
line of Fortieth Street and said City Limit Line, a distance
of 330 feet more or less to the East line of Acre Lane,
said point being an angle point in said City Limit Line;
thence North along said East line of Acre Lane and said
City ~it Line, a distance of 276 feet more or less to the
North line of the South 256 feet of said Lot 10; thence
leaving said City Limit Line, West along said North line
of the South 256 feet of said Lot 10, a distance of 330
feet to the East line of said Lot 9; thence North along
said East line, a distance of 384 feet more or less to the
Northeast corner thereof; thence West along the North line
of said Lot 9, a distance of 330 feet more or less to the
Northwest corner thereof; thence South along the West line
and the Southerly prolongation thereof, a distance of 660
feet more or less to the center line of said Fortieth
Street, said point being on the Corporate Limit line of said
City; thence East along said center line and said City
Limit Line, a distance of 330 feet more or less to the
Northerly prolongation of the West line of said Lot 1, said
point being an angle point in said Corporate Limit Line of
said City; thence South along said City Limit Line and
said Northerly prolongation and said West line of Lot 1,
a distance of 148 feet more or less to the Southwest corner
thereofi thence leaving said City Limit Line and East along
the South line of said Lot 1, a distance of 310 feet to
the Southeast corner thereof, said point being on the West

line of said Acre Lane; thence continuing East 20 feet to the
Southwest corner of said Lot 6, said point being on the East
line of said Acre Lane; thence continuing East along the South
line of said Lot 6 and the Easterly prolongation thereof, a
distance of 330 feet to the center line of said Newmark
Avenue; thence North along said center line a distance of
148 feet to the point of beginning.

Containing approximately 9.75 acres.

That there are less than twelve qualified electors residing in said
territory, and that said territory is. uninhabited as defined by said Act.
SECTION tWO: That the said council of the City of San Bernardino
desires to annex said uninhabited territory to the City of San Bernardino for
the following reasons: Said territory is contiguous to the City of San
Bernardino and its proposed annexation will contribute and facilitate the
orderly growth and development of both the City of San Bernardino and the
territory proposed to be annexed, and will provide and facilitate proper
over-all planning and zoning of lands in said City and said uninhabited
territory in a manner most conducive to the welfare of said city and said
uninhabited territory.

SECTION THREE: That upon the completion of said annexation of said
19 (LAFC 945) shall be taxed equally with the other property within the City of
20 San Bernardino to pay the bonded indebtedness and any and all general
21 indebtedness of the City of San Bernardino contracted prior to or existing or
22 outstanding at the time of the aforesaid proposed annexation of said described
23 property as provided in said Act.

SECTION FOUR: That Monday, the 16th day of February, 1971, at the
26 Garner Building, 392 Court Street, San Bernardino, California, is hereby fixed
27 as the time and place when and where any person owning real property within
28 the uninhabited territory, above described and proposed to be annexed to the
29 City of San Bernardino, and having any objections to the proposed annexation
30 may appear before the Council of the City of San Bernardino and show cause
31 why such uninhabited territory should not be so annexed to the City of San
32 Bernardino. Such protest must be in writing, may be filed with the City Clerk

at any time before the hour set for hearing objections to the proposed
annexation, and shall state the name or names of the owner or owners of
property affected, and the description of such property in general terms.
SECTION FIVE: The City Clerk of the City of San Bernardino is hereby
authorized and directed to cause a copy of this resolution to be published at
least twice but not oftener than once a week in the San Bernardino Free Press,
a newspaper of general circulation published in the City of San Bernardino,
the city to which it i8~proposed to annex the aforesaid territory, and also in
the Highland Messenger, a newspaper of general circulation published outside
the City of San Bernardino but in the County of San Bernardino, California, the
county in which is located the territory proposed to be annexed to the City of
San Bernardino, said publication to be complete at least twenty (20) days prior
to the date set for hearing;
The said City Clerk is further authorized and directed to cause
written notice of such proposed annexation to be mailed to each person to whom
lands within the territory proposed to be annexed is assessed in the last
equalized county assessment roll available to said clerk on the date the above
said proceedings were initiated, at the addresses shown on said assessment roll,
or known to said Clerk, and to any person who has filed his name and address
and the designation of the lands in which he has an interest, either legal or
equitable, with said Clerk, such notice to be given not less than twenty (20)
days before the first public hearing on the proposed annexation;
And in the event that any land within the territory proposed to be
annexed is owned by a county, the said City Clerk is directed to cause written
notice of such proposed annexation to be mailed to the Board of Supervisors
of such county, such notice to be given not less than twenty (20) days before
the first public hearing on the proposed annexation;
And in the event there is upon the land proposed to be annexed a
structural improvement owned, being acquired or leased by a county fire protec-
tion district, the said City Clerk is directed to cause written notice of such
proposed annexation to be mailed to the governing body of such district, such
notice to be sent not less than ten (10) days before the first public hearing

upon such proposed annexation;

And the City Clerk is directed to cause written notice to be given to
such other persons as may be legally entitled thereto, in the manner required
by law.
