A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO RATIFYING THE EXECUTION OF AN AGREEMENT
BETWEEN SAID CITY AND OPERATION SECOND CHANCE, INC.. RELATING TO
THE USE OF DELMAN HEIGHTS COMMUNITY CENTER FOR A DANCE..
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE

SECTION 1. The execution of the Agreement between the
7 City of San Bernardino and Operation Second Chance, Inc.., relating
8 to the use of Delman Heights Community Center for a dance, a copy
9 of which is attached hereto, marked Exhibit "A" and made a part
10 hereof as fully as though set forth at length is hereby ratified.

AGREEMENT
(Community Center Dance)
THIS AGREEMENT made and entered into this ___ day of
________ 1971, by and between the City of San Bernardino,
a municipal corporation, hereinafter called "City", and
Operation Second Chance, Inc., a non-profit corporation,
hereinafter called "Corporation".
WITNESSETH:
The parties hereto agree as follows:
1. The Corporation is authorized to use thos portions of the
Delman Heights Community Center designated by the
Director of the Parks and Recreation Department of the City for the
conducting of a dance during the evening of December 28, 1970, and
may charge an admission to said dance not to exceed $1.50 per person
for the purpose of defraying the costs thereof and any other costs of
that certain program entitled "Operation Second Chance" dated
February 22, 1968, on file with the City and of other programs permitted
under the agreement between the parties hereto. Any profit received from
said admission charges shall be held in trust by Corporation for said
purpose and an accounting of the expenditure of such revenue or profit
for such purpose shall be made to the City Administrator of City within
30 days after December 28, 1970, and thereafter as may be requested by
the City Administrator. Corporation shall reimburse City the amount of
any expenditures from said profit for any unauthorized purpose.
2. Corporation agrees to conduct said dance in accordance with the
rules and regulations governing the use of the Delman Heights Community
Center and as prescribed by the said Director of City and agrees to be bound
by each of such rulesand regulations, whether now in effect or as may later be
promulgated by Director.
3. Corporation shall pay to City all costs and expenses
of the operation of the Center presently estimated at $34.00 and
of providing two uniformed patrolmen during the dance.
4. Corporation shall first comply with the insurance coverage
requirements of the City Administrator before using the Center.
5. The provisions of paragraphs 6, 7, 8, 9 and 10 of the agreement
authorized by Resolution No. 10144 between the parties hereto shall
apply to this agreement.
IN WITNESS WHEREOF the parties hereto have executed this
agreement the day and year first above written.
